Kyle Busch’s final months weren’t just defined by racing, records and one last trip to Victory Lane. Away from the track, the two-time NASCAR Cup Series champion had also been fighting a major financial battle that ended quietly before his sudden death.

Busch and his wife, Samantha, reached an out-of-court settlement with Pacific Life Insurance Company in an $8.5 million lawsuit over life insurance policies they claimed had been marketed to them as safe retirement plans.

The settlement was disclosed in a February 26 court filing, with the terms kept confidential.

“Both sides worked constructively to achieve a confidential result that is mutually acceptable and avoids further legal proceedings,” Pacific Life said in a statement.

The lawsuit was filed last October, months before Busch died at 41 after being hospitalized with what his family, Richard Childress Racing and NASCAR described as a severe illness. 

The settlement, though not connected to his health or death, has drawn renewed attention because it came during the final stretch of his life.

Why Busch sued Pacific Life

According to the lawsuit, Kyle and Samantha Busch claimed they lost more than $8.5 million after being misled into purchasing indexed universal life insurance policies.

The Busches alleged they paid more than $10.4 million in premiums after being shown misleading illustrations and promised guaranteed returns. 

The complaint accused Pacific Life and one of its agents of presenting the policies as “tax-free retirement plans” while relying on speculative projections that did not properly explain the risks, costs and long-term obligations.

The lawsuit also accused the company of prioritizing commissions over the interests of policyholders and alleged violations of North Carolina’s Unfair and Deceptive Trade Practices Act.

Pacific Life pushed back in January, filing for dismissal. The company argued that the Busches had signed documents agreeing to the policy terms and had not fully funded the policies as required. 

It also argued that the complaint came too late, saying the policies had been started seven years before the lawsuit and exceeded the three-year statute of limitations.

The settlement ended the dispute before it reached trial.

A final legal fight before NASCAR mourned Busch

In the week before his death, Busch won the Ecosave 200 at Dover Motor Speedway, extending his NASCAR Craftsman Truck Series record to 69 victories. 

It was his 234th win across NASCAR’s three national series, adding to 102 wins in what is now the O’Reilly Auto Parts Series and 63 Cup Series victories.

After that Dover win, Busch reflected on why success still mattered after so many years.

“Because you never know when the last one is, you know?” Busch said.

Those words have become heartbreaking in hindsight. Busch was known as “Rowdy” for a reason. He was fiery, difficult, brilliant and unapologetically competitive. 

In his later years, he also became a husband, father, mentor and advocate, someone who spoke more openly about perspective and legacy.
