The decision of a Romanian magistrate seems to be based not only on explicit legal statutes, but also on the conclusions of a report by the institute that has assumed the authority to define what anti-Semitism means. To elaborate further, a Romanian citizen appears to be denied the possibility of setting up a non-profit organization because of personal beliefs that neither contravene legal rules nor involve criminal activity. This circumstance raises concerns about the potential violation of constitutional rights for those who identify themselves as patriots and nationalists.<\/p>\n

Indeed, the actions of the Institute appear to be a clear violation of the law governing its establishment and operation, as set out in GD 902\/2005, including subsequent amendments. In particular, this legal framework does not specify and does not give the Institute any mandate or responsibility for activities related to antisemitism. In addition, it is noteworthy that the term \u201cantisemitism\u201d is not mentioned in the original legal acts defining the scope and responsibilities of the Institute from its establishment until today. This substantial inconsistency underlines the dubious position of the Institute in interpreting and applying the law.<\/p>\n
