Se va intampla in cazul in care Legislativul va implementa o <b>propunere facuta in acest sens de Uniunea Nationala a Barourilor din Romania (UNBR), condusa de Traian Briciu<\/b>. <\/span><\/span><\/p>\n<hr>\n<p>\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span>Astfel, UNBR a anuntat duminica, 20 octombrie 2024, ca a trimis un memoriu catre Guvern, Senat si Camera Deputatilor in care explica necesitatea unei modificari legislative care sa vizeze instituirea asistentei juridice obligatorii prin avocat a persoanei fizice atat in faza precontractuala de negociere, cat si la momentul semnarii contractului de vanzare a unui imobil. Scopul aceste masuri, arata UNBR, este de a proteja persoanele fizice de posibilitatea semnarii unor acte care vor produce consecinte semnificative asupra patrimoniului, fara a intelege continutul, semnificatia termenilor si efectele pe care clauzele stipulate le pot produce. Or, in cazul transpunerii in lege a propunerii UNBR, ar exista un standard de certitudine si securitate juridica \u2013 sociala, manifestat prin oferirea unui aviz din partea unui avocat.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><b>Prezentam comunicatul UNBR:<\/b><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><i><span><span>\u201cUNBR considera esentiala instituirea asistentei juridice obligatorii si in faza precontractuala a actelor de vanzare cumparare a unui imobil<\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>-UNBR a trimis autoritatilor un memoriu cu propunerea instituirii pe cale legislativa a obligativitatii asistentei juridice a persoanelor fizice in tranzactiile imobiliare inca din faza negocierilor<\/b><\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>-Scopul urmarit este protejarea persoanelor fizice la semnarea unor acte care vor produce consecinte semnificative asupra patrimoniului<\/b><\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>-O astfel de reglementare ar determina eliminarea timpurie a clauzelor profund dezechilibrate sub aspectul drepturilor si obligatiilor asumate<\/b><\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>-UNBR considera ca cea mai eficienta cale de asigurare a protectiei partii vulnerabile este cunoasterea si intelegerea deplina de catre aceasta a mecanismelor promisiunii de vanzare iar acest lucru se poate realiza numai cu ajutorul unui profesionist, care sa o consilieze!<\/b><\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><i><span><span>UNBR se implic\u0101 pentru a propune un cadru legislativ coerent, care s\u0101 protejeze interesele consumatorilor prin eliminarea cauzelor care intretin discrepantele majore intre interesele vanz\u0101torului si cele ale cump\u0101r\u0101torului, in cazul promisiunilor de vanzare.<\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>In contextul unei realitati socio-juridice nefavorabile, soldate cu efecte sociale negative si de natura sa destabilizeze piata rezidentiala, UNBR vine cu propunerea unei initiative legislative care sa reinstituie echilibrul contractual dintre profesionistul-dezvoltator imobiliar si consumatorul-persoana fizica si sa asigure garantii suplimentare de protectie a consumatorilor.<\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>In data de 18 octombrie 2024, UNBR a trimis un memoriu, adoptat de Comisia Permanenta, catre Guvern, Senat, si Camera Deputatilor, care argumenteaza ca se impune o modificare legislativa care sa vizeze instituirea asistentei juridice obligatorii prin avocat a persoanei fizice atat in faza precontractuala de negociere, cat si la momentul semnarii contractului de vanzare a unui imobil. Activitatile prestate de catre avocat in asistarea clientului constau in oferirea de consultatii juridice de specialitate pentru explicarea cauzelor contractuale si a efectelor pe care acestea le produc.<\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>Scopul urmarit este de a proteja persoanele fizice de posibilitatea semnarii unor acte care vor produce consecinte semnificative asupra patrimoniului, fara a intelege continutul, semnificatia termenilor si efectele pe care clauzele stipulate le pot produce. in acest fel, exista un standard de certitudine si securitate juridica \u2013 sociala, manifestat prin oferirea unui aviz din partea unui avocat.<\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>Un prim argument al acestei propuneri este faptul ca avand in vedere impactul financiar al contractelor de vanzare a unui imobil asupra patrimoniului persoanei fizice, legiuitorul a optat pentru obligativitatea formei autentice a acestor contracte, ceea ce presupune obligatia informarii partilor de catre notar asupra continutului contractului, explicarea clauzelor si a efectelor pe care le produc. Obligativitatea formei autentice ar trebui sa existe si in cazul promisiunilor de vanzare intrucat, chiar daca nu se transmite proprietatea, in realitate se stabilesc clauze obligatorii cu privire la vanzarea ulterioara, care nu mai pot fi modificate unilateral cu ocazia autentificarii contractului de vanzare. Continutul prevederilor promisiunii de vanzare nu este asadar mai putin important decat cel al contractului de vanzare cumparare.<\/b><\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>De asemenea, o astfel de reglementare ar determina evitarea clauzelor profund dezechilibrate sub aspectul drepturilor si obligatiilor asumate, defavorabile partii vulnerabile, si ar oferi o perspectiva de negociere a acestor tipuri de contracte.<\/b><\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><i><span><span>Actualmente, din cazuistica actuala, atat de abundenta in mass-media, observam ca, de regula, dezvoltatorul impune un contract tipizat si abuziv, care diminueaza considerabil sansele de reusita in cazul unei eventuale dispute generate de nemultumiri ale beneficiarului promisiunii de vanzare. Notarul SI-A facut datoria . Notarul care nu a sfatuit patea sa ceara institutirea unui sechestru, o ipoteca, &#8230; ceva acolo,  A FOST DE NOTA 10, c altfel pesedeul nu mai avea bani de la NORDIS de alegeri. Aaaa! si ca sa fie off-topic, tot notari buni sunt si cei care aurtentidica acordul dat de victime cu cutitul sau pistolul la tampla ca sa isi vanda casa sau ca au imprumutat meleoane de la sportivi, pianisti, ghenosi, &#8230; etc. .
