Pe l\u00e2ng\u0103 suferin\u021ba uman\u0103 cauzat\u0103 de caracterul inferior al produselor \u0219i serviciilor, corup\u021bia submineaz\u0103 func\u021bionarea pie\u021belor \u0219i dezvoltarea economic\u0103<sup><span><a class=\"sdfootnoteanc\" name=\"sdfootnote3anc\" href=\"https:\/\/www.luju.ro\/coruptia-transfrontaliera-consideratii-privind-noua-infractiune-de-dare-de-mita-in-legatura-cu-un-functionar-al-unui-stat-strain-si-cu-desfasurarea-unor-operatiuni-economice-internationale#sdfootnote3sym\"><sup>3<\/sup><\/a><\/span><\/sup><span> \u0219i distorsioneaz\u0103 condi\u021biile de concuren\u021b\u0103 interna\u021bional\u0103. <\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Conven\u021bia de la Paris privind combaterea coruperii func\u021bionarilor str\u0103ini \u00een cadrul opera\u021biunilor economice interna\u021bionale (denumit\u0103 \u0219i \u201e<i>Conven\u021bia Anti-Mit\u0103<\/i>\u201d) a fost adoptat\u0103 sub egida OECD, pornind de la dou\u0103 realit\u0103\u021bi de net\u0103g\u0103duit, \u0219i anume, <i>caracterul interna\u021bional<\/i> al multor opera\u021biuni economice derulate de diferite autorit\u0103\u021bi din statele semnatare, \u0219i, respectiv, <i>frecven\u021ba actelor de corup\u021bie \u0219i a practicilor corupte<\/i> \u00een care sunt implica\u021bi func\u021bionari ai unor astfel de autorit\u0103\u021bi, \u0219i care impun, \u00een mod corelativ, adoptarea \u0219i implementarea unor instrumente prompte \u0219i adecvate de drept penal pentru investigarea \u0219i sanc\u021bionarea unor astfel de practici. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Astfel, statele semnatare ale Conven\u021biei Anti-Mit\u0103 \u0219i-au asumat obliga\u021bia de a sanc\u021biona la standardul impus de actul interna\u021bional <i>corup\u021bia activ\u0103<\/i>, adic\u0103 fapta persoanei care promite sau ofer\u0103 bani sau alte foloase necuvenite func\u021bionarului str\u0103in \u00een contextul unor opera\u021biuni economice interna\u021bionale. Corup\u021bia pasiv\u0103, adic\u0103 fapta persoanei care prime\u0219te bani sau alte foloase necuvenite \u00een acela\u0219i context va fi sanc\u021bionat\u0103 conform legii na\u021bionale a fiec\u0103rui stat semnatar. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Prin Legea nr. 202\/2023<sup><span><a class=\"sdfootnoteanc\" name=\"sdfootnote4anc\" href=\"https:\/\/www.luju.ro\/coruptia-transfrontaliera-consideratii-privind-noua-infractiune-de-dare-de-mita-in-legatura-cu-un-functionar-al-unui-stat-strain-si-cu-desfasurarea-unor-operatiuni-economice-internationale#sdfootnote4sym\"><sup>4<\/sup><\/a><\/span><\/sup>, Rom\u00e2nia a aderat la Conven\u021bia Anti-Mit\u0103, iar prin Legea nr. 319\/2024 a stabilit unele m\u0103suri pentru punerea \u00een aplicare a acestei Conven\u021bii, prin adoptarea unor norme de drept penal substan\u021bial \u0219i a unor adoptarea unor norme de procedur\u0103 speciale, respectiv, prin reglementarea unei noi infrac\u021biuni de corup\u021bie, \u00een conformitate cu prevederile Conven\u021biei. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>\u00cen concret, prin dispozi\u021biile art. 3 din Legea nr. 319\/2024, legiuitorul a incriminat noua infrac\u021biune de <i>dare de mit\u0103 \u00een leg\u0103tur\u0103 cu func\u021bionar al unui stat str\u0103in<\/i>, const\u00e2nd \u00een fapta persoanei care, direct sau indirect, promite, ofer\u0103 sau d\u0103 unui func\u021bionar public str\u0103in, pentru acesta sau pentru altul, bani ori alte foloase care nu i se cuvin, \u00een leg\u0103tur\u0103 cu \u00eendeplinirea, ne\u00eendeplinirea, urgentarea ori \u00eent\u00e2rzierea \u00eendeplinirii unui act ce intr\u0103 \u00een \u00eendatoririle de serviciu ale respectivului func\u021bionar public str\u0103in sau \u00een leg\u0103tur\u0103 cu \u00eendeplinirea unui act contrar acestor \u00eendatoriri, dac\u0103 fapta este de natur\u0103 s\u0103 \u00eei procure acesteia sau oric\u0103rei alte persoane bani sau alte foloase sau s\u0103 \u00eei men\u021bin\u0103 asemenea avantaje \u00een leg\u0103tur\u0103 cu desf\u0103\u0219urarea de opera\u021biuni economice interna\u021bionale \u0219i pedepsit\u0103 cu \u00eenchisoare de la 2 la 7 ani \u00een cazul persoanelor fizice, respectiv, amend\u0103 \u00een cazul persoanelor juridice, suma corespunz\u0103toare unei zile-amend\u0103 pentru persoana juridic\u0103 fiind cuprins\u0103 \u00eentre 3.000 lei \u0219i 300.000 lei.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<ol type=\"I\" start=\"2\">\n<li>\n<p align=\"JUSTIFY\"><span><span><b>Clarific\u0103ri \tterminologice <\/b><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span><span>Actul normativ opereaz\u0103 cu o serie de <i>concepte specifice<\/i>, care se interpreteaz\u0103, de altfel, la fel ca \u00eentreaga reglementare, prin raportare la Comentariile privind Conven\u021bia Anti-Mit\u0103 adoptate de Conferin\u021ba de negociere a acestei Conven\u021bii la 21 noiembrie 1997 (\u201e<i>Comentariile<\/i>\u201d). <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>\u00cen primul r\u00e2nd, legea opereaz\u0103 cu o defini\u021bie specific\u0103 a conceptului de \u201e<i>f<\/i><i>unc\u021bionarul public str\u0103in\u201d<\/i>, definit (art. 2 lit. a) din Legea nr. 319\/2024) drept \u201e<i>orice persoan\u0103 numit\u0103 sau aleas\u0103, care de\u021bine o func\u021bie legislativ\u0103, administrativ\u0103  \u0219i judiciar\u0103 \u00eentr-o \u021bar\u0103 str\u0103in\u0103, orice persoan\u0103 care exercit\u0103 o func\u021bie public\u0103 pentru o \u021bar\u0103 str\u0103in\u0103, inclusiv pentru o agen\u021bie de stat sau o \u00eentreprindere public\u0103, \u0219i orice func\u021bionar sau agent al unei organiza\u021bii publice interna\u021bionale<\/i>. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>No\u021biunea de \u201e<i>\u021bar\u0103 str\u0103in\u0103<\/i>\u201d include (conform art. 2 lit. b) \u201e<i>toate nivelurile \u0219i subdiviziunile de guvernare, de la cele na\u021bionale p\u00e2n\u0103 la cele locale<\/i>\u201d, inclusiv teritorii autonome sau jurisdic\u021bii fiscale distincte. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>\u00cen conformitate cu textul Comentariilor, \u201e<i>func\u021bie public\u0103<\/i>\u201d \u00een sensul Conven\u021biei Anti-Mit\u0103 \u00eenseamn\u0103 orice activitate de interes public, \u00eencredin\u021bat\u0103 de o \u021bar\u0103 str\u0103in\u0103, cum ar fi, spre exemplificare, \u00eendeplinirea unor atribu\u021bii \u00eencredin\u021bate \u00een leg\u0103tur\u0103 cu proceduri de achizi\u021bie public\u0103. O \u201e<i>agen\u021bie public\u0103<\/i>\u201d define\u0219te o entitate constituit\u0103 conform dreptului public, pentru a \u00eendeplini activit\u0103\u021bi de interes public. \u201e<i>\u00centreprinderea public\u0103<\/i>\u201d, reprezint\u0103 orice \u00eentreprindere, indiferent de forma concret\u0103 de organizare, asupra c\u0103reia unul sau mai multe state pot exercita, direct sau indirect, o influen\u021b\u0103 dominant\u0103. Exemplificativ, iar nu limitativ, men\u021bion\u0103m situa\u021bia de\u021binerii de c\u0103tre stat a majorit\u0103\u021bii capitalului social, controlul majorit\u0103\u021bii voturilor aferente ac\u021biunilor, sau dreptul de a desemna majoritatea membrilor organelor de conducere sau supraveghere. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Un func\u021bionar al unei \u00eentreprinderi publice va fi <i>prezumat<\/i> a \u00eendeplini o func\u021bie public\u0103 \u00een sensul Conven\u021biei Anti-Mit\u0103, cu excep\u021bia situa\u021biei \u00een care \u00eentreprinderea opereaz\u0103 pe baze normale, comerciale \u00een pia\u021ba relevant\u0103, similar unei \u00eentreprinderi private, f\u0103r\u0103 a beneficia de subven\u021bii sau alte privilegii. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Mai mult, Comentariile extind sfera de aplicare a Conven\u021biei Anti-Mit\u0103 inclusiv la persoane care, <i>de\u0219i nu de\u021bin oficial o func\u021bie public\u0103 \u00een stat, pot exercita, \u00een anumite circumstan\u021be, autoritatea public\u0103,<\/i> spre exemplificare, oficiali de partid \u00een state \u00een care nu exist\u0103 pluripartitism, ci partid unic, \u0219i care, <i>de facto,<\/i> pot fi considerate c\u0103exercit\u0103 o func\u021bie public\u0103. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>\u201e<span><i>Organiza\u021bii publice interna\u021bionale<\/i><\/span><span>\u201d \u00eenseamn\u0103 orice organiza\u021bie interna\u021bional\u0103 format\u0103 de c\u0103tre state, guverne, sau alte organiza\u021bii publice interna\u021bionale, indiferent de forma de organizare, scop sau atribu\u021bii, inclusiv, spre exemplu, o organiza\u021bie de integrare economic\u0103 regional\u0103 precum Comunitatea European\u0103. <\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<ol type=\"I\" start=\"3\">\n<li>\n<p align=\"JUSTIFY\"><span><span><b><span>Subiectul \tactiv<\/span><\/b><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span><span><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2025\/12\/mihai_mares_2.jpg\" width=\"400\" height=\"601\" title=\"mihai_mares_2\">Subiectul activ al infrac\u021biunii poate fi orice persoan\u0103 fizic\u0103 sau juridic\u0103, a c\u0103rei r\u0103spundere poate fi atras\u0103 \u00een condi\u021biile generale reglementate de Codul penal (art. 135 \u0219i urm.). De remarcat faptul c\u0103, prin derogare de la dispozi\u021biile art. 137 alin. (2) Cod penal, cuantumul zilei-amend\u0103 este mai mare, pentru a asigura pedepse disuasive \u0219i eficiente pentru infrac\u021biunile s\u0103v\u00e2r\u0219ite de persoane juridice, \u00eentruc\u00e2t \u00een mod obi\u0219nuit acestea sunt entit\u0103\u021bile implicate \u00een tranzac\u021bii interna\u021bionale \u0219i beneficiari ai actelor de corup\u021bie. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<ol type=\"I\" start=\"4\">\n<li>\n<p align=\"JUSTIFY\"><span><span><b>Elementul \tmaterial<\/b><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span><span>Cu privire la<span> modalit\u0103\u021bile de comitere a faptei<\/span>, sunt incriminate  promisiunea, oferirea sau darea c\u0103tre un func\u021bionar public str\u0103in, pentru acesta sau pentru altul, bani ori alte foloase care nu i se cuvin, \u00een leg\u0103tur\u0103 cu \u00eendeplinirea, ne\u00eendeplinirea, urgentarea ori \u00eent\u00e2rzierea \u00eendeplinirii unui act ce intr\u0103 \u00een \u00eendatoririle de serviciu ale respectivului func\u021bionar, sau \u00eendeplinirea unui act contrar acestor \u00eendatoriri, \u00eentr-o form\u0103 identic\u0103 infrac\u021biunii de dare de mit\u0103 reglementat\u0103 de art. 290 Cod penal. \u00cen acest scop, legea define\u0219te (la art. 2 lit. c) <i>actul contrar \u00eendatoririlor de serviciu <\/i>\u00een sensul autonom, conven\u021bional, al no\u021biunii drept \u201e<i>folosirea necorespunz\u0103toare de c\u0103tre func\u021bionarul public str\u0103in a func\u021biei sale, dac\u0103 actul este realizat \u00een leg\u0103tur\u0103 cu \u00eendatoririle sale de serviciu sau \u00een leg\u0103tur\u0103 cu calitatea sa\u201d. <\/i><\/span><\/span><\/p>\n<ol type=\"I\" start=\"5\">\n<li>\n<p align=\"JUSTIFY\"><span><span><b>Cerin\u021be \tesen\u021biale <\/b><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span><span><span>Cerin\u021ba esen\u021bial\u0103<\/span> a infrac\u021biunii de la art. 3 din Legea nr. 319\/2024 este ca <i>fapta s\u0103 fie de natur\u0103 s\u0103 procure mituitorului sau oric\u0103rei alte persoane bani sau alte foloase, sau s\u0103 \u00eei men\u021bin\u0103 asemenea avantaje<\/i><i>\u00een leg\u0103tur\u0103 cu desf\u0103\u0219urarea de opera\u021biuni economice interna\u021bionale. <\/i><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>No\u021biunea de \u201e<i>opera\u021biuni economice interna\u021bionale<\/i>\u201d include toate tipurile de tranzac\u021bii cu element de extraneitate, inclusiv, f\u0103r\u0103 limitare, achizi\u021bii publice, contracte de finan\u021bare, sau orice alte opera\u021biuni de comer\u021b ori investi\u021bii investi\u021bii. Legea nu distinge dup\u0103 cum mituitorul \/ ter\u021bul beneficiar ar fi fost sau nu \u00eendrept\u0103\u021bit s\u0103 \u00ee\u0219i procure \u201e<i>bani sau alte foloase<\/i>\u201d, dar conceptul de \u201e<i>avantaje<\/i>\u201d consider\u0103m c\u0103 nu se poate referi dec\u00e2t la foloase la care la care mituitorul\/beneficiarul nu era \u00eendrept\u0103\u021bit \u00een mod obiectiv (<i>i.e<\/i>., avantaje necuvenite, comerciale sau de alt\u0103 natur\u0103, \u00een limbajul Conven\u021biei). Similar celorlalte infrac\u021biuni de dare de mit\u0103 reglementate la nivel na\u021bional, banii, valorile sau orice alte bunuri oferite sau date sunt supuse <span>confisc\u0103rii<\/span>, \u00een natur\u0103 sau prin echivalent. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<ol type=\"I\" start=\"6\">\n<li>\n<p align=\"JUSTIFY\"><span><span><b><span>Norme \tspeciale de procedur\u0103 \u0219i drept penal substan\u021bial<\/span><\/b><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span><span>Din perspectiv\u0103 procedural\u0103, <span>competen\u021ba de investigare<\/span> a infrac\u021biunii de la art. 3 din Legea nr. 319\/2024 revine exclusiv Direc\u021biei Na\u021bionale Anticorup\u021bie, indiferent de valoarea mitei \u0219i de calitatea mituitorului. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Semnal\u0103m totodat\u0103 c\u0103, <span>prin derogare de la principiul personalit\u0103\u021bii legii penale<\/span>, reglementat dispozi\u021biile art. 9 alin. (2) din Codul Penal, \u00een considerarea obliga\u021biilor care deriv\u0103 din Conven\u021bia Anti-Mit\u0103 (conform art. 12 Cod penal), pentru aplicarea normei de incriminare de la art. 3 din Legea nr. 319\/2024 infrac\u021biunilor s\u0103v\u00e2r\u0219ite de cet\u0103\u021beni rom\u00e2ni sau persoane juridice rom\u00e2ne \u00een afara teritoriului na\u021bional nu este aplicabil\u0103 condi\u021bia dublei incrimin\u0103ri, la fel cum nu este necesar\u0103 nici autorizarea prealabil\u0103 a procurorului ierarhic superior pentru \u00eenceperea urm\u0103ririi penale. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<ol type=\"I\" start=\"7\">\n<li>\n<p align=\"JUSTIFY\"><span><span><b><span>Aplicarea \tlegii penale \u00een timp<\/span><\/b><\/span><\/span><\/p>\n<\/li>\n<\/ol>\n<p align=\"JUSTIFY\"><span><span>Din perspectiva <span>succesiunii de legi penale \u00een timp<\/span>, de\u0219i reglementarea introdus\u0103 de Legea nr. 319\/2024 este una nou\u0103, av\u00e2nd o sfer\u0103 specific\u0103 de aplicare, anterior intr\u0103rii \u00een vigoare a acestui act normativ legea rom\u00e2n\u0103 sanc\u021biona <i>darea de mit\u0103 s\u0103v\u00e2r\u0219it\u0103 \u00een leg\u0103tur\u0103 cu func\u021bionari str\u0103ini<\/i> prin dispozi\u021biile art. 294 din Codul penal, cu denumirea marginal\u0103 \u201e<i>Fapte s\u0103v\u00e2r\u0219ite de c\u0103tre func\u021bionari str\u0103ini sau \u00een leg\u0103tur\u0103 cu ace\u0219tia\u201d , <\/i>raportat la art. 290 Cod penal. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Practic, dispozi\u021biile art. 294 opereaz\u0103, dac\u0103 prin tratatele interna\u021bionale la care Rom\u00e2nia este parte nu se dispune altfel, o <span>extindere a aplicabilit\u0103\u021bii normei care sanc\u021bioneaz\u0103 darea de mit\u0103 de la art. 290 Cod penal <\/span>(precum \u0219i celelalte infrac\u021biuni de corup\u021bie din Capitolul I al Titlului V din Codul Penal, cu denumirea marginal\u0103 \u201e<i>Infrac\u021biuni de corup\u021bie<\/i>\u201d, respectiv, art. 289 \u201e<i>Luarea de mit\u0103<\/i>, art. 291 \u201e<i>Traficul de influen\u021b\u0103<\/i>\u201d, art. 292 \u201e<i>Cump\u0103rarea de influen\u021b\u0103<\/i>\u201d) la fapte s\u0103v\u00e2r\u0219ite de c\u0103tre sau \u00een leg\u0103tur\u0103 cu anumite categorii definite de persoane, \u00eentre care \u0219i <i>func\u021bionarii  care \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea pe baza unui contract de munc\u0103, precum \u0219i altor persoane care exercit\u0103 atribu\u021bii similare, \u00een cadrul unei organiza\u021bii politice interna\u021bionale la care Rom\u00e2nia este parte ori \u00een cadrul Uniunii Europene \u0219i func\u021bionarii unui stat str\u0103in<\/i>. Not\u0103m \u0219i c\u0103 anterior intr\u0103rii \u00een vigoare a Codului Penal, la data de 1.02.2014, infrac\u021biunea de la art. 294 se reg\u0103sea \u00eentr-o form\u0103 identic\u0103 la art. 8<sup><span>1<\/span><\/sup><span> din Legea nr. 78\/2000<\/span><span><span><sup><span><a class=\"sdfootnoteanc\" name=\"sdfootnote5anc\" href=\"https:\/\/www.luju.ro\/coruptia-transfrontaliera-consideratii-privind-noua-infractiune-de-dare-de-mita-in-legatura-cu-un-functionar-al-unui-stat-strain-si-cu-desfasurarea-unor-operatiuni-economice-internationale#sdfootnote5sym\"><sup>5<\/sup><\/a><\/span><\/sup><span>, text abrogat prin Legea nr. 187\/2012<\/span><sup><span><a class=\"sdfootnoteanc\" name=\"sdfootnote6anc\" href=\"https:\/\/www.luju.ro\/coruptia-transfrontaliera-consideratii-privind-noua-infractiune-de-dare-de-mita-in-legatura-cu-un-functionar-al-unui-stat-strain-si-cu-desfasurarea-unor-operatiuni-economice-internationale#sdfootnote6sym\"><sup>6<\/sup><\/a><\/span><\/sup><\/span><span><span> prin care a fost pus \u00een aplicare Codu<\/span>l penal actual. <\/span><\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>No\u021biunea de \u201e<i>func\u021bionar<\/i>\u201d utilizat\u0103 de art. 294 Cod penal se raporteaz\u0103 la prevederile art. 175 Cod penal, fapta nefiind sanc\u021bionat\u0103, \u00een raport de prevederile art. 308 Cod penal, atunci c\u00e2nd este comis\u0103 \u00een leg\u0103tur\u0103 cu alte persoane dec\u00e2t func\u021bionarii publici. Astfel, dispozi\u021biile art. 294  raportat la art. 290 Cod penal au \u00een vedere fapte de dare de mit\u0103 comise \u00een leg\u0103tur\u0103 cu persoane care, cu titlu permanent sau temporar, cu sau f\u0103r\u0103 remunera\u021bie, exercit\u0103: (i) atribu\u021bii \u0219i responsabilit\u0103\u021bi stabilite \u00een temeiul legii, \u00een scopul realiz\u0103rii prerogativelor puterii legislative, executive, sau judec\u0103tore\u0219ti; (ii) o func\u021bie de demnitate public\u0103 sau o func\u021bie public\u0103 de orice natur\u0103; (iii) atribu\u021bii legate de realizarea obiectului de activitate \u00een cadrul unei regii autonome, al altui operator economic sau al unei persoane juridice cu capital integral sau majoritar de stat; (iv( exercit\u0103 un serviciu de interes public pentru care a fost \u00eenvestit\u0103 de autorit\u0103\u021bi publice sau care este supus\u0103 controlului ori supravegherii acestora cu privire la \u00eendeplinirea respectivului serviciu public, dar \u00een cadrul ori \u00een leg\u0103tur\u0103 cu un stat str\u0103in. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Astfel, av\u00e2nd \u00een vedere, pe de o parte, suprapunerea elementului material, precum \u0219i identitatea conceptual\u0103 dintre no\u021biunile de \u201e<i>func\u021bionar str\u0103in<\/i>\u201d de la art. 294 Cod penal \u0219i \u201e<i>func\u021bionar public str\u0103in<\/i>\u201d de la art. 3 din Legea nr. 319\/2024, apreciem, \u00een raport de dispozi\u021biile art. 3-5 Cod penal, c\u0103 infrac\u021biunea de la art. 3 din Legea nr. 319\/2024 nu reprezint\u0103 dec\u00e2t <span>o form\u0103 special\u0103<\/span> a infrac\u021biunii de dare de mit\u0103 de la art. 294 raportat la art. 290 Cod penal, iar nu o incriminare veritabil nou\u0103. \u00cen acest sens, se observ\u0103 \u0219i identitatea tratamentului sanc\u021bionator \u00een cazul persoanelor fizice, fiind aplicabil\u0103 aceea\u0219i pedeaps\u0103, respectiv, \u00eenchisoarea de la 2 la 7 ani. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Ca \u0219i perspectiv\u0103 practic\u0103, apreciem c\u0103 infrac\u021biunea va fi \u00eencadrat\u0103, conform art. 5 Cod penal, \u00een dispozi\u021biile art. 3 din Legea nr. 319\/2024 ori de c\u00e2te ori sunt \u00eendeplinite cerin\u021bele esen\u021biale ale acestui text de lege, \u00een caz contrar, fapta urm\u00e2nd a fi \u00eencadrat\u0103 \u00een dispozi\u021biile art. 294 raportat la art. 290 Cod penal. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span>Probleme reale din perspectiva legii penale mai favorabile se ridic\u0103 numai <i>\u00een cazul f\u0103ptuitorului persoan\u0103 juridic\u0103<\/i>, av\u00e2nd \u00een vedere c\u0103 tratamentul sanc\u021bionator nou-introdus prin Legea nr. 319\/2024 este mai sever. \u00cen consecin\u021b\u0103, dac\u0103 fapta persoanei fizice care \u00eentrune\u0219te elementele de tipicitate ale normei poate fi \u00eencadrat\u0103 \u00een dispozi\u021biile legii noi chiar dac\u0103 ar fi fost comis\u0103 sub imperiul legii vechi, \u00een cazul persoanei juridice, pentru fapte comise anterior intr\u0103rii \u00een vigoare a Legii nr. 319\/2024, opin\u0103m c\u0103 <i>principiul legii penale mai favorabile<\/i> se opune \u00eencadr\u0103rii \u00een prevederile art. 3 din Legea nr. 319\/2024, fiind aplicabile dispozi\u021biile art. 294 raportat la art. 290 Cod penal. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\">\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<div id=\"sdfootnote1\">\n<p class=\"sdfootnote\"><span><span><a class=\"sdfootnotesym\" name=\"sdfootnote1sym\" class=\"sdfootnote\" align=\"JUSTIFY\"><span><span><a class=\"sdfootnotesym\" name=\"sdfootnote2sym\" href=\"https:\/\/www.luju.ro\/coruptia-transfrontaliera-consideratii-privind-noua-infractiune-de-dare-de-mita-in-legatura-cu-un-functionar-al-unui-stat-strain-si-cu-desfasurarea-unor-operatiuni-economice-internationale#sdfootnote2anc\">2<\/a> Legea nr. 319\/2024 privind stabilirea unor m\u0103suri pentru punerea \u00een \taplicare a Conven\u021biei privind combaterea coruperii func\u021bionarilor \tpublici str\u0103ini \u00een cadrul
