Dar nici pe canalele pe care se mai pot exprima critici anti-sistem nu mai primim, de mult, dec\u00e2t liric\u0103 g\u0103unoas\u0103, o dezl\u0103n\u021buire neputincioas\u0103 de revolt\u0103, prin \u0219arje inconsistente, care denun\u021b\u0103 pertinent dar s\u0103<span class=\"gmail_default\">\u021b<\/span>ios racilele constatabile\u2026 dar nu propun dec\u00e2t pseudo-solu\u021bii. C\u0103 am e\u0219uat \u00eentr-o \u00een fund\u0103tur\u0103 civiliza\u021bional\u0103 o arat\u0103 \u0219i t\u0103cerea intelectualilor, cei care odinioar\u0103 se sim\u021beau mandata\u021bi s\u0103 corecteze viciile istoriei, iar azi \u00eencep s\u0103 evite, smeri\u021bi, sterila l\u0103tr\u0103tur\u0103. Constat\u00e2ndu-m\u0103 \u0219i eu \u00een aceast\u0103 postur\u0103 penibil\u0103, ca agitator civic ce denun\u021b\u0103 ce nu-i convine dar nu poate ar\u0103ta cu ce ar \u00eenlocui, am \u00eencercat \u00een ace\u0219ti ani s\u0103 organizez un repertoriu de m\u0103suri pe care le-a\u0219 lua dac\u0103 a\u0219 ajunge la putere\u2014 supun\u00e2ndu-m\u0103 la acest exerci\u021biu numai ca s\u0103 v\u0103d dac\u0103 chiar \u0219tiu de ce m\u0103 aflu \u00een treab\u0103.<\/span><\/span><\/p>\n<p><span><span>Reformulate continuu, ideile mele reformatoare nu au rezistat \u00eens\u0103 presiunii criteriilor contradictorii \u2014 care s\u0103l\u0103\u0219luiesc \u00eentr-o singur\u0103 con\u0219tiin\u021b\u0103. Lesne intuiesc implauzibilitatea g\u0103sirii unei formule \u201ejuste\u201d pentru o colectivitate de actori plasa\u021bi de via\u021b\u0103 \u00een tot felul de posturi\u2026<\/span><\/span><\/p>\n<p><span><span>Nu voi analiza aici metodic de ce \u0219i cum am ajuns \u00een acest h\u0103u umplut cu am\u0103giri ofilite, ci voi \u00eencerca s\u0103 deschid o perspectiv\u0103 explicativ\u0103, scrut\u00e2nd o pist\u0103 \u2014 exemplu de naufragiu inevitabil al n\u0103zuin\u021bei spre un\u00a0<b>altfel<\/b>\u00a0confuz. Amintesc doar \u00een treac\u0103t c\u0103 primul izvor de neputin\u021be este contradic\u021bia dintre nevoile\/interesele\/aspira\u021biile individului \u0219i legit\u0103\u021bile\/interesele comunit\u0103\u021bii (a se vedea vestita dilem\u0103 a prizonierilor). Oric\u00e2t s-ar perfecta implantarea intereselor colective \u00een con\u0219tiin\u021be, acestea vor r\u0103m\u00e2ne \u00een slujba fiin\u021belor purt\u0103toare, sprijinind descurcarea care satisface nevoile corpului animalic \u0219i fabricarea sensurilor motivante, \u00eentru satisfacerea nevoilor sufletului.<\/span><\/span><\/p>\n<p><span><span>Contrapunerea paradoxant\u0103 dintre puseurile \u00eemplinirii personale \u0219i asumarea particip\u0103rii voluntare e deja de ajuns pentru a ne arunca \u00een perplexitate. Dar chiar dac\u0103 uit\u0103m de existen\u021ba (devenirea) fiin\u021bei stabile \u00eenzestrat\u0103 cu con\u0219tiin\u021b\u0103 plastic\u0103 \u0219i r\u0103m\u00e2nem la nivelul socialit\u0103\u021bii, c\u0103ut\u00e2nd optimizarea regulilor de joc, nu d\u0103m peste o problem\u0103 (m\u0103car progresiv) solubil\u0103, ci peste o plas\u0103 de criterii\/nevoi\/perspective contradictorii, care \u021bes un sistem m\u0103cinat de absurditate. A\u0219a cum \u0219arpele nu-\u0219i poate \u00eenghi\u021bi capul \u0219i Dumnezeu nu se poate face \u0219i pe El, omenirea nu se poate reconstrui din nimic (supra-revolu\u021bionar), fiind silit\u0103 s\u0103 se transforme progresiv, trebuind s\u0103 fie ce nu vrea. Iner\u021bie a devenirii care atomizeaz\u0103 \u0219i planurile de reconstituire ce nu sunt absurde \u00een principiu, dar presupun \u201emarea resetare\u201d.<\/span><\/span><\/p>\n<p><span><span>Ca atare, dac\u0103 nu vine dup\u0103 o catastrof\u0103, un \u201eproiect de societate\u201d nu poate determina (prin postulare) o nou\u0103 alc\u0103tuire a vie\u021bii, ci trebuie s\u0103 conceap\u0103 un lan\u021b de mut\u0103ri care s\u0103 poat\u0103 duce, pas cu pas, c\u0103tre punctul vizat. Planificare v\u0103dit iluzorie, c\u0103ci nu poate fi evitat\u0103 interven\u021bia nenum\u0103ratelor elemente\/fenomene noi, imprevizibile, incontrolabile. Reformatorii, vor, nu vor, sunt condamna\u021bi la demagogie. Sau, ca \u00een cazul experimentului comunist, sunt activi\u0219ti lipsi\u021bi de scrupule, redu\u0219i la cinism. Transformare prin mutilare, spre orice, pentru orice.<\/span><\/span><\/p>\n<p><span><span>Pu\u021binele \u00eencerc\u0103ri de a formula programe coerente\/credibile nu fac distinc\u021bia \u00eentre m\u0103surile ce pot fi implementate imediat (reprezent\u00e2nd pa\u0219i transformativi, preg\u0103titori) \u0219i cele esen\u021biale \u00een fiziologia vizat\u0103, dar realizabile numai dup\u0103 o anumit\u0103 faz\u0103\/etap\u0103 a transform\u0103rii. Nu voi face nici eu aceast\u0103 filtrare temporar\u0103 a verosimilit\u0103\u021bii \u00een exerci\u021biul care urmeaz\u0103, l\u0103s\u00e2nd cititorilor (ne)pl\u0103cerea de a tran\u0219a temporalizarea fezabilit\u0103\u021bii.<\/span><\/span><\/p>\n<p><span><span>Trec (asumat de iute) de la nivelul procesual\/procedural la acel structural al dificult\u0103\u021bii ingineriei civiliza\u021biei: neputin\u021ba de a \u00eenfrunta complexitatea excesiv\u0103 (care ar fi trebuit s\u0103 ne \u00eendemne s\u0103 resimplific\u0103m metodic existen\u021ba social\u0103, \u00eentru inteligibilitate \u0219i gestionabilitate). Nu \u0219tiu pe ce s-ar baza \u00eencrederea c\u0103 putem reglementa coerent\/predictibil\/fast anatomia \u0219i fiziologia unui organism ce cuprinde (ca celule) miliarde de oameni mult mai diferi\u021bi \u00eentre ei (datorit\u0103 form\u0103rii con\u0219tien\u021biale \u00een rela\u021bie cu contexte variate) ca animalele \u2014 fabricate din na\u0219tere. Nici utilizarea calculatoarelor nu promite un real succes, dac\u0103 nu cumva consider\u0103m mecanizarea vie\u021buirii \u0219i uniformizarea aferent\u0103 un pre\u021b<\/span><\/span><\/p>\n<p><span><span>Un proiect global ar trebui s\u0103 combine cultivarea con\u0219tiin\u021belor, cu ameliorarea rela\u021biilor sociale, \u00eens\u0103n\u0103to\u0219irea mecanismelor institu\u021bionale, protejarea de influen\u021be dinafara zonei emancipate. Ne paralizeaz\u0103 \u00eens\u0103 complexitatea \u015fi dac\u0103 ne oprim la nivelul redefinirii puterilor \u00een stat (instrument dorit\/pretins corector, care a devenit principala cauz\u0103\/surs\u0103 a degener\u0103rii). Nu \u0219tie nimeni, de fapt nu poate \u0219ti, cum ar trebui acordate (constitu\u021bional \u015fi practic) reforma administra\u021biei, cu a legislativului \u0219i cu cea a puterii judec\u0103tore\u0219ti, financiare \u0219i mediatice. Popula\u021bia nu e nici m\u0103car con\u0219tient\u0103 de amploarea\/ad\u00e2ncimea putreziciunii structurale. A \u00eenv\u0103\u021bat s\u0103 critice \u00een van politicienii, par\u021bial \u0219i administra\u021bia (cu care \u00eens\u0103 pune la punct aranjamentele necesare descurc\u0103rii), \u00eencepe s\u0103 m\u00e2r\u00e2ie \u0219i spre media, dar nu \u0219i spre puterea financiar\u0103 (de care nici nu a auzit). Cum nemul\u021bumi\u021bii nu vor (pot) s\u0103 se uite \u00een oglind\u0103, nu vor da niciodat\u0103 peste cauzele ad\u00e2nci, bio-con\u015ftien\u0163iale, ale nereu\u0219itei viselor de emancipare moral\u0103. Mai ciudat pare faptul c\u0103 nu au reperat activitatea distructiv\u0103, criminal\u0103, a aparatului juridic. Poate pentru c\u0103 nu s-au confruntat suficient de des cu el. Poate pentru c\u0103 \u00eencrederea \u00een paznicii legii le-a fost inoculat\u0103 cel mai insistent. R\u0103m\u00e2ne ciudat c\u0103 nu s-a strigat \u00eenc\u0103 \u201eJos juri\u0219tii\u201d. De\u0219i armata de procurori, judec\u0103tori, avoca\u021bi, notari, sistemic asociat\u0103 cu tagma legislatorilor, \u00een folosul uzurpatorilor, fac imposibil\u0103 evadarea.<\/span><\/span><\/p>\n<p><span><span>Dac\u0103 victimele : \u201ejusti\u021biei\u201d nu sunt capabile s\u0103 imagineze o real\u0103 r\u0103scoal\u0103, la ce s\u0103 ne a\u0219tept\u0103m la cei care \u00ee\u015fi c\u00e2\u0219tig\u0103 p\u00e2inea \u00een mla\u0219tina \u201cdreptului\u201d, parazi\u021bii placebo-ului legalist? Chiar \u015fi cei care ajung \u00een conflict cu sistemul (ca doamna \u015eo\u015foac\u0103, care \u00ee\u015fi converte\u0219te neputin\u021ba \u00een turbare) nu pot imagina o adev\u0103rat\u0103 smulgere din ghearele farsei judiciare, care le-a permis s\u0103-\u0219i hr\u0103neasc\u0103 pruncii \u015fi de care le depinde supravie\u021buirea\/bun\u0103starea.<\/span><\/span><\/p>\n<p><span><span>(A se vedea discu\u021biile despre reformarea Cur\u021bii Constitu\u021bionale, \u00een locul \u00een\u021belegerii inadmisibilit\u0103\u021bii func\u021bion\u0103rii ei). De aceea unii propun doar c\u00e2rpeli sau propov\u0103duiesc o aiurit\u0103 meritocra\u021bie sau o utopic\u0103 invadare a sufletelor cu buna credin\u021b\u0103; neput\u00e2nd nici m\u0103car jindui la r\u0103sturnarea ansamblului regulilor de joc, militeaz\u0103 pentru schimbarea juc\u0103torilor\u2026..<\/span><\/span><\/p>\n<p><span><span>Nu are cine s\u0103 sus\u021bin\u0103 m\u0103suri ca:<\/span><\/span><\/p>\n<p><span><span>1. Cur\u0103\u021birea \u00eentregului aparat juridic, prin epurarea parazi\u021bilor nedrept\u0103\u021birii sistemice, sco\u021b\u00e2nd din cale orice protec\u021bie a impunit\u0103\u021bii prin prescriere; studierea vechilor dosare \u015fi eliminarea (pedepsirea aspr\u0103) a judec\u0103torilor care au dat sau dau sentin\u021be injuste, a procurorilor care au favorizat infractori \u0219i inculpat nevinova\u021bi (sau o fac \u00een continuare); tratarea similar\u0103 a avoca\u021bilor care \u015fi-au tr\u0103dat sau \u00ee\u0219i tr\u0103deaz\u0103\/mulg clien\u021bii; monitorizarea (arhivarea) deschis\u0103 publicului a tuturor actelor procesuale; formarea \u0219i selec\u021bia juri\u0219tilor (prin examin\u0103ri pe baza unor cazuri propuse spre rezolvare); eliminarea privilegiilor acordate paznicilor legii (pensii speciale etc.)<\/span><\/span><\/p>\n<p><span><span>2. Simplificarea legii, \u00eenc\u00e2t s\u0103 poat\u0103 fi cunoscuta de to\u021bi cei obliga\u021bi s\u0103 o respecte si introducerea educa\u021biei juridice \u00een programa \u0219colar\u0103 \u2014 \u00eenc\u00e2t s\u0103 se poat\u0103 ajunge la eliminarea nevoii de avocat parazitar, oprind favorizarea judiciar\u0103 a \u00eembog\u0103\u021bi\u021bilor; asigurarea gratuit\u0103\u021bii serviciilor juridice cu adev\u0103rat necesare; st\u00e2rpirea escrocheriei notariale \u2014 notificarea gratuit\u0103 a oric\u0103rui act fiind f\u0103cut\u0103 cu instrumente monitorizabile;<\/span><\/span><\/p>\n<p><span><span>Ca s\u0103 nu mai vorbim chestiuni mai dificile\/problematice, ca:<\/span><\/span><\/p>\n<p><span><span>3. Condamnarea legilor injuste din trecut \u0219i cercetarea efectelor lor, cu eliminarea prescrip\u021biei; revolu\u021bionarea cadrului normativ pe baza unei Constitu\u021bii de \u00eemputernicire reala a Cet\u0103\u021benilor, care sa apere libert\u0103\u021bile fundamentale ce permit prezumarea acordului fiec\u0103ruia la normare cu protec\u021bia fiec\u0103ruia de actele incorecte ale altora; dep\u0103\u0219irea racilelor democra\u021biei directe (costuri, votare neinformat\u0103, instabilitate \u0219i incoeren\u021b\u0103) folosind capacitatea noilor tehnologii de comunicare, plasate sub monitorizare publica;<\/span><\/span><\/p>\n<p><span><span>4. Constituirea unei \u201cmembrane na\u021bionale\u201d , care, f\u0103r\u0103 a bloca fluxurile economice \u015fi culturale benefice, s\u0103 protejeze (ca o carantin\u0103 \u00eempotriva viru\u0219ilor) organismul s\u0103n\u0103tos, pe care l-a realizat o normativitate local\u0103 fast\u0103, de influen\u021be distructive , s\u0103 apere anticorpii na\u021bionali de atacurile rechinilor ce b\u00e2ntuie dup\u0103 profit parazitar \u00een oceanul lumii ; realizarea unui \u201cmai bine ca afar\u0103\u201d presupun\u00e2nd suveranitate normativ\u0103 incompatibil\u0103 cu mondializarea (dac\u0103 nu ap\u0103r\u0103m o socialitate superioar\u0103 de osmoz\u0103, nu mai r\u0103m\u00e2ne dec\u00e2t s\u0103 a\u0219tept\u0103m \u00eens\u0103n\u0103to\u0219irea \u015fi mai iluzorie a \u00eentregii lumi\u2026 ).<\/span><\/span><\/p>\n<p><span><span>5. S\u0103 g\u0103seasc\u0103 (\u00een \u201cdreptul civil\u201d) un just echilibru \u00eentre logica solidariz\u0103rii cu cel nedrept\u0103\u021bit de altul \u015fi logica non-interven\u021biei \u00een ciocnirile inter-personale; s\u0103 instituie (\u201c\u00een dreptul penal\u201d) un echilibru \u00eentre logica protej\u0103rii poten\u021bialelor victime ale agresiunilor \u015fi logica libert\u0103\u021bii ne\u00eengr\u0103dite de fric\u0103 ; p\u00e2n\u0103 c\u00e2nd ne va cople\u0219i bun\u0103starea general\u0103, put\u00e2nd sl\u0103bi intimidarea doar sporind convingerea, cu pre\u021bul inocul\u0103rii unor valori \u00een con\u0219tiin\u021be\u2026 deci \u00eenlocuind teroarea cu manipulare.<span class=\"gmail_default\">\u00a0<\/span>Etc Etc.<\/span><\/span><\/p>\n<p><span><span>E doar o incursiune superficial\u0103, printr-un sector al realit\u0103\u021bii. Dar cred c\u0103 ajunge, pentru a sugera ad\u00e2ncimea h\u0103ului de sub preten\u021biile de reform\u0103 politic\u0103 \u2014 pe care ei \u00eel ascund ca \u00ee\u0219i acopere lucrarea iar noi \u2026. ca s\u0103 nu ame\u021bim.<\/span><\/span><\/p>\n<h1><strong><span class=\"gmail_default\">Analiza analizei<\/span><\/strong><\/h1>\n<div>\n<p><b>Ioan Ro\u0219ca propune un text profund critic la adresa societ\u0103\u021bii contemporane, \u00een special \u00een ceea ce prive\u0219te lipsa de coeren\u021b\u0103 \u0219i viabilitate a ini\u021biativelor reformatoare, fie ele juridice, sociale sau politice. Textul poate fi analizat \u0219i comparat cu ideile altor autori pe mai multe direc\u021bii, subliniind principalele teze sociale \u0219i juridice reformatoare. Iat\u0103 o sintez\u0103:<\/b><\/p>\n<hr>\n<h3><strong>1. Tezele centrale ale textului lui Ioan Ro\u0219ca<\/strong><\/h3>\n<h4>a)\u00a0<strong>Critica\u00a0reformatorilor \u0219i\u00a0<span><span class=\"gmail_default\">a<\/span><\/span><span class=\"gmail_default\">\u00a0<\/span>demagogiei reformatoare<\/strong><\/h4>\n<p>Ro\u0219ca sus\u021bine c\u0103 societatea este blocat\u0103 \u00eentr-un \u201eh\u0103u al am\u0103girilor\u201d, \u00een care cei care propun schimb\u0103ri se confrunt\u0103 cu paradoxuri, incoeren\u021be \u0219i o complexitate social\u0103 care face imposibil\u0103 realizarea unor proiecte revolu\u021bionare coerente. Reformele sunt fie \u201edemagogice\u201d, fie \u201ecinice\u201d, f\u0103r\u0103 s\u0103 aduc\u0103 schimb\u0103ri reale. El exemplific\u0103 acest e\u0219ec cu experimentele comuniste, care au dus la \u201etransformare prin mutilare\u201d.<\/p>\n<h4>b)\u00a0<strong>Complexitatea excesiv\u0103 \u0219i imposibilitatea unui proiect global<\/strong><\/h4>\n<p>Autorul argumenteaz\u0103 c\u0103 societatea modern\u0103 este prea complex\u0103 pentru a putea fi reglementat\u0103 coerent \u0219i predictibil. Complexitatea structural\u0103 face ca orice \u00eencercare de reconstruc\u021bie global\u0103 s\u0103 fie sortit\u0103 e\u0219ecului, iar solu\u021biile propuse (cum ar fi meritocra\u021bia sau reformele constitu\u021bionale) sunt fie utopice, fie insuficiente.<\/p>\n<h4>c)\u00a0<strong>Rolul aparatului juridic \u00een perpetuarea inechit\u0103\u021bii<\/strong><\/h4>\n<p>Ro\u0219ca subliniaz\u0103 c\u0103 sistemul juridic, v\u0103zut de mul\u021bi ca un \u201epaznic al drept\u0103\u021bii\u201d, este de fapt un actor principal al \u201emla\u0219tinii dreptului\u201d. Acesta func\u021bioneaz\u0103 \u00een interesul celor privilegia\u021bi \u0219i \u00eempiedic\u0103 orice evadare din sistem. Propune m\u0103suri radicale, precum epurarea sistemului juridic, simplificarea legisla\u021biei \u0219i eliminarea \u201eprivilegiilor juri\u0219tilor\u201d.<\/p>\n<h4>d)\u00a0<strong>Necesitatea unei \u201ereset\u0103ri sociale\u201d prin pa\u0219i progresivi<\/strong><\/h4>\n<p>El sugereaz\u0103 c\u0103 o reform\u0103 real\u0103 ar trebui s\u0103 fie etapizat\u0103, plec\u00e2nd de la simplificarea structurii sociale pentru a o face inteligibil\u0103 \u0219i gestionabil\u0103. Totu\u0219i, subliniaz\u0103 c\u0103 aceast\u0103 \u201emarea resetare\u201d este extrem de dificil\u0103, deoarece fiecare etap\u0103 este influen\u021bat\u0103 de factori imprevizibili.<\/p>\n<hr>\n<h3><strong>2. Compara\u021bie cu al\u021bi autori \u0219i perspective similare<\/strong><\/h3>\n<h4>a)\u00a0<strong>Critica sistemului juridic<\/strong><\/h4>\n<p>Ro\u0219ca \u00ee\u0219i g\u0103se\u0219te un aliat \u00een ideile lui Michel Foucault, care \u00een\u00a0<em>\u201cA supraveghea \u0219i a pedepsi\u201d<\/em>\u00a0expune modul \u00een care sistemul juridic, \u00een tandem cu cel carceral, func\u021bioneaz\u0103 ca un instrument al puterii dominante. Foucault ar putea fi de acord cu ideea c\u0103 \u201epaznicii legii\u201d sunt parte a unui mecanism mai larg de control social. Totu\u0219i, spre deosebire de Ro\u0219ca, care propune solu\u021bii punctuale, Foucault se limiteaz\u0103 la analiza structural\u0103 a puterii f\u0103r\u0103 a indica direc\u021bii concrete de reform\u0103.<\/p>\n<h4>b)\u00a0<strong>Complexitatea societ\u0103\u021bii \u0219i critica utopiilor<\/strong><\/h4>\n<p>Ideile lui Ro\u0219ca despre imposibilitatea unui proiect global pot fi comparate cu cele ale lui Karl Popper, care, \u00een\u00a0<em>\u201cSocietatea deschis\u0103 \u0219i du\u0219manii ei\u201d<\/em>, critic\u0103 utopiile \u0219i proiectele sociale grandioase, propun\u00e2nd \u00een schimb reforme pas cu pas, bazate pe analiza critic\u0103 a problemelor.
