It comes at a time where Americans are particularly <a href=\"https:\/\/www.theverge.com\/features\/1017836\/flock-huntington-west-virginia-surveillance-ballot-measure\">on-edge about surveillance technologies like Flock cameras<\/a> and <a href=\"https:\/\/www.pbs.org\/newshour\/economy\/consumer-concerns-grow-as-retailers-adopt-ai-assisted-pricing-tools\">surveillance pricing<\/a>, heading into a midterm election largely defined by affordability issues.<\/p>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\">A combined Kroger-Giant Eagle \u2014 which would add Giant Eagle\u2019s 200-plus stores to Kroger\u2019s 2,700 \u2014 could pose risks in two ways, according to AELP. The first is by enabling Kroger to acquire data on customers across a broader geographic area, which it can use to serve customers personalized pricing based on inferences about their backgrounds and shopping behaviors. It could also use that data to <a href=\"https:\/\/advertisingweek.com\/aw360\/news\/case-study-kroger-precision-marketing-proving-the-power-of-retail-media-at-scale\/8348\/\">fuel its retail media arm<\/a>, which repackages consumer insights for other brands. The second is by expanding or combining an existing physical surveillance network consisting of technologies like <a href=\"https:\/\/www.dispatch.com\/story\/news\/local\/2026\/08\/14\/kroger-easton-among-private-flock-camera-partners-with-columbus-police\/91214608007\/?gnt-cfr=1&amp;gca-cat=p&amp;gca-uir=true&amp;gca-epti=z11xx32p117450l115750c117450e1126xxv11xx32d--60--b--60--&amp;gca-ft=201&amp;gca-ds=sophi\">Flock cameras<\/a> and <a href=\"https:\/\/www.einpresswire.com\/article\/635446062\/cooler-screens-announces-expansion-with-kroger-to-bring-digital-smart-screens-into-stores\">Cooler Screens<\/a>, a company that previously <a href=\"https:\/\/www.theatlantic.com\/technology\/archive\/2019\/01\/walgreens-tests-new-smart-coolers\/581248\/\">touted<\/a> its ability to scan shoppers\u2019 faces but <a href=\"https:\/\/digiday.com\/marketing\/walgreens-expanding-digital-cooler-doors-ad-network\/\">backed off that messaging<\/a> after public backlash. <a href=\"https:\/\/spectrumnews1.com\/ky\/louisville\/news\/2025\/01\/28\/kroger-facial-recognition\">Kroger has denied<\/a> using in-store facial recognition to serve customers\u2019 prices, but has acknowledged in its <a href=\"https:\/\/go.skimresources.com\/?id=87443X1797501&amp;xs=1&amp;url=https%3A%2F%2Fwww.kroger.com%2Fcontent%2Fv2%2Fbinary%2Fdocument%2Fpdfkrogerprivacypolicyseptember92026vf1.pdf\" rel=\"sponsored\">privacy policy<\/a> that it uses facial recognition at some stores for security purposes. Kroger and Giant Eagle did not immediately respond to <em>The Verge<\/em>\u2019s requests for comment.<\/p>\n<\/div>\n<div class=\"duet--article--block-placement _1xorkac2 _1xorkac0 duet--article--article-body-component\">\n<div class=\"duet--article--article-pullquote c39lj10\">\n<div class=\"c39lj11\"><\/div>\n<p class=\"duet--article--dangerously-set-cms-markup c39lj12 _19wv7tc9\">\u201cBuying bleach or yogurt now comes with the prospect of being scanned, tracked, and profiled\u201d<\/p>\n<\/div>\n<\/div>\n<div class=\"duet--article--article-body-component\">\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1044qizi _18mzr4b1 _18mzr4b0 _19wv7tc1\"><a href=\"https:\/\/www.wsj.com\/articles\/kroger-albertsons-merger-would-create-a-big-player-in-retail-advertising-11665791359\">Similar privacy concerns<\/a> were raised during Kroger\u2019s earlier attempted merger with Albertsons, a much larger deal that <a href=\"https:\/\/www.reuters.com\/legal\/us-court-blocks-krogers-25-billion-acquisition-grocery-rival-albertsons-2024-12-10\/\">courts blocked in late 2024<\/a> after the Federal Trade Commission and state attorneys general challenged it. AELP argues that the proposed merger with Giant Eagle is also deserving of scrutiny, because of the way it could significantly reduce options in places like <a href=\"https:\/\/www.grocerydive.com\/news\/kroger-giant-eagle-merger-retailstat-columbus-ohio\/830461\/\">Columbus, Ohio<\/a>, and also because of Kroger\u2019s buying patterns and incentives. They urge the FTC and Ohio attorney general to seek to block the merger, though <a href=\"https:\/\/www.grocerydive.com\/news\/kroger-giant-eagle-merger-regulatory-process\/825130\/\">experts have predicted they might not<\/a>, both because of the relatively small size of the deal compared to Albertsons, and the Trump administration\u2019s more open approach to settlement deals than the prior
