Robinson of Robinson Bramlet LLC, who is representing the Wuerslin estate.

The lawsuit seeks damages that meet the mandatory federal court threshold. The complaint requests financial compensation exceeding $75,000 to cover medical bills, funeral costs, and emotional distress. In federal cases where parties live in different states, this exact dollar figure serves as a mandatory minimum floor required to bring a case to federal court, rather than a maximum cap on total damages.

The defense denies any negligence. Shell, represented by attorney Dane C. Mueller, stated in court documents that the case cannot be brought to trial due to state assumption-of-risk laws. The legal filings point to the protections of the 1979 Wyoming Ski Safety Act, which dictates that anyone on the mountain must assume the “inherent risks” of alpine skiing. Pointing back to the sheriff’s finding that both men turned into each other simultaneously, the defense argues that skier-versus-skier collisions are an expected hazard of the sport. Mueller contends this legally shields Shell from liability under the 1995 Wyoming Supreme Court precedent Halpern v. Wheeldon, which established that participants cannot sue over foreseeable, natural risks of a recreational sport.

Veteran Jackson Hole Ski Instructor Peter Wuerslin | Image: Facebook

Community Impact and the Fight Against Excessive Speed

Wuerslin had been with the Jackson Hole Mountain Sports School since 1978. His passing shook the local ski community.
