The Epic Pass specifically, which launched in 2008, now offers skiers and riders access to over 40 resorts around the world, from small local ski areas such as <a href=\"https:\/\/www.crotchedmtn.com\/\">Crotched Mountain, New Hampshire<\/a> and <a href=\"https:\/\/www.stevenspass.com\/\">Stevens Pass, Washington<\/a>, to world class fly-to destinations like <a href=\"http:\/\/whistlerblackcomb.com\/\">Whistler Backcomb<\/a> and <a href=\"https:\/\/www.parkcitymountain.com\/\">Park City<\/a>. Vail, the owner of the Epic Pass, argues that this wide range of resort offerings affords consumers a greater level of freedom when choosing when and where to ski. However, the plaintiffs see it differently.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\"><strong>Landin Goloja, Tyler Maybee, Caitlan Reynolds, and Daniel Sheiner sued Vail Resorts on March 23 of this year on antitrust grounds.<\/strong> They alleged that, via the Epic Pass, Vail coerced consumers into paying for access to not only the destinations which they wished to visit, but a number of smaller local resorts that they had no intention of skiing at. For example, Park City, Beaver Creek, and Keystone are all located near major population areas, yet were labeled as destination resorts in the lawsuit. Third, Vail Resorts feels that mountains were cherry-picked to fit into either category as a means of supporting the plaintiffs\u2019 claims: Stowe was labeled as a local resort even though it is classified as \u201cextra-large\u201d by the <a href=\"https:\/\/nsaa.org\/webdocs\/media_public\/press\/2024\/2024_05_skiervisits.pdf\">National Ski Areas Association<\/a>, while smaller resorts found closer to major population centers such as Okemo and Mount Snow were classified as destinations. Furthermore, if one does not wish to pay for local access, Vail offers destination-only passes for those wishing to only access large-scale, vacation-oriented ski areas. Vail also asserts that the cited spike in daily lift ticket prices driving people toward purchase of the Epic Pass were in reference to peak holiday pricing at just five of Vail\u2019s 42 resorts, thus rendering them cherry-picked statistics unrepresentative of overall pricing at Vail Resorts.<\/p>\n<p class=\"font-claude-response-body break-words whitespace-normal\"><strong>In response to the plaintiffs\u2019 claim that Vail is exercising power over consumers by having a meaningful monopoly, the company states that its share of the ski industry has been gravely misrepresented.<\/strong> In the lawsuit, shares of Alterra and Vail were combined to imply a joint monopoly, forcing consumers to purchase a tied product\u2014the Epic or Ikon Pass. However, Vail Resorts asserts that it is not colluding with Alterra to drive up bundled pass sales, but rather that the two companies are staunch competitors fighting over the same clientele. Image: Loveland<\/figcaption><\/figure>\n<p class=\"font-claude-response-body break-words whitespace-normal\"><strong>Finally, on the point of competing resorts being harmed by Vail\u2019s diversion of regional skiers away from rivals through coercive tying, the company states that plaintiffs once again fail to outline meaningful criteria.<\/strong> The lawsuit does not outline what percentage of regional skiers bought the Epic Pass, nor does it estimate the proportion of Epic buyers who would have bought regional tickets if not for the bundled product. Furthermore, Vail does not punish customers for visiting other resorts.
