Dac\u0103 ar fi doar o simpl\u0103 pies\u0103 de teatru poate cei afecta\u021bi ar z\u00e2mbi \u0219i ar trece mai departe. Dar c\u00e2nd familii de locatari sunt lovi\u021bi \u00een dreptrurile lor nu mai este de r\u00e2s.<\/strong><\/p>\n<p>Consilierul local Ilie-Vasile S\u00eerbu \u00eencearc\u0103 s\u0103 fac\u0103 lumin\u0103 \u00een cazul de mai jos:<\/p>\n<p><em>\u201eDin luna februarie solicit explica\u021bii \u0219i documente privind situa\u021bia imobilului din strada Protopop George Dragomir nr. 3. Dup\u0103 patru luni de interpel\u0103ri, adrese \u0219i solicit\u0103ri oficiale, r\u0103spunsurile primite din partea Prim\u0103riei Timi\u0219oara nu clarific\u0103 situa\u021bia, ci eviden\u021biaz\u0103 o serie de contradic\u021bii administrative care afecteaz\u0103 at\u00e2t chiria\u0219ii, c\u00e2t \u0219i proprietarii din acest imobil.<br \/>\nPrim\u0103ria recunoa\u0219te c\u0103 prin Dispozi\u021bia Primarului nr. 390 din 16 martie 2022 a pus \u00een executare Sentin\u021ba civil\u0103 nr. 1032\/21.10.2020 a Tribunalului Timi\u0219, prin care s-a dispus restituirea \u00een natur\u0103 a unei cote de 5\/24 din imobil c\u0103tre fo\u0219tii proprietari. Totodat\u0103, administra\u021bia sus\u021bine c\u0103 exist\u0103 un regim juridic neclar, o situa\u021bie de coproprietate \u0219i c\u0103, p\u00e2n\u0103 la finalizarea procedurilor de ie\u0219ire din indiviziune, nu pot fi \u00eencheiate contracte de \u00eenchiriere.<br \/>\n\u00cen acela\u0219i timp \u00eens\u0103, aceea\u0219i administra\u021bie a promovat \u0219i sus\u021binut HCL nr. 442\/2024. Prin aceast\u0103 hot\u0103r\u00e2re, Consiliul Local a aprobat repartizarea unor locuin\u021be \u0219i extinderea unor spa\u021bii din acela\u0219i imobil \u00een vederea \u00eencheierii contractelor de \u00eenchiriere.\u201d<\/em><\/p>\n<p>La art. 16 din HCL nr. 442\/2024 se aprob\u0103 repartizarea apartamentului nr. 8 c\u0103tre doamna Manolea Anamaria Loredana, \u00een vederea \u00eencheierii contractului de \u00eenchiriere. La art. 17 se aprob\u0103 extinderea cu dou\u0103 camere a apartamentului nr. 12 c\u0103tre domnul Sebe\u0219an Dan Emil, tot \u00een vederea \u00eencheierii contractului de \u00eenchiriere.<br \/>\nApare astfel o \u00eentrebare legitim\u0103: dac\u0103 situa\u021bia juridic\u0103 era at\u00e2t de neclar\u0103 \u00eenc\u00e2t \u00eempiedica \u00eencheierea contractelor, de ce a fost promovat\u0103 \u0219i adoptat\u0103 aceast\u0103 hot\u0103r\u00e2re? De ce Consiliul Local nu a fost informat despre existen\u021ba acestui impediment \u00eenainte de vot?<br \/>\nMai grav, \u00eentr-un r\u0103spuns oficial, Prim\u0103ria afirm\u0103 c\u0103 \u201e\u00eencheierea contractului nu a fost refuzat\u0103\u201d, \u00eens\u0103 \u00een aceea\u0219i adres\u0103 precizeaz\u0103 c\u0103 \u201ep\u00e2n\u0103 la finalizarea documentelor pentru ie\u0219irea din indiviziune nu putem \u00eencheia contracte de \u00eenchiriere\u201d. Cu alte cuvinte, contractul nu este semnat, dar administra\u021bia sus\u021bine c\u0103 nu exist\u0103 un refuz.<\/p>\n<p>\u00cen practic\u0103 \u00eens\u0103, efectul este identic: beneficiarul unei hot\u0103r\u00e2ri a Consiliului Local nu poate ob\u021bine contractul aprobat prin acea hot\u0103r\u00e2re.<br \/>\nTotodat\u0103, Prim\u0103ria sus\u021bine c\u0103 nu exist\u0103 o practic\u0103 administrativ\u0103 neunitar\u0103 \u0219i c\u0103 fiecare situa\u021bie este analizat\u0103 individual. Cu toate acestea, \u00een cadrul aceluia\u0219i imobil sunt aprobate repartiz\u0103ri \u0219i extinderi prin HCL, \u00een timp ce pentru alte situa\u021bii se invoc\u0103 imposibilitatea \u00eencheierii contractelor din cauza aceluia\u0219i regim juridic incert.<\/p>\n<p>Mai mult, lipsa de implicare a administra\u021biei \u00een clarificarea situa\u021biei juridice, \u00een dezmembrarea imobilului \u0219i \u00een finalizarea procedurilor de ie\u0219ire din indiviziune nu afecteaz\u0103 doar beneficiarii HCL nr. 442\/2024. Sunt afecta\u021bi \u0219i proprietarii celorlalte apartamente din imobil, persoane care \u00ee\u0219i v\u0103d limitate drepturile asupra propriilor bunuri din cauza unei situa\u021bii juridice care treneaz\u0103 de ani de zile \u0219i pe care administra\u021bia o invoc\u0103 permanent f\u0103r\u0103 s\u0103 o rezolve.<\/p>\n<p>\u00cen r\u0103spunsurile oficiale primite, Prim\u0103ria afirm\u0103 c\u0103 HCL nr. 442\/2024 este \u00een vigoare, nu a fost suspendat\u0103, modificat\u0103 sau revocat\u0103 \u0219i c\u0103 nu exist\u0103 niciun act administrativ prin care s\u0103 fi fost refuzat\u0103 punerea sa \u00een aplicare.<br \/><a href=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q5b.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q5b-145x300.jpg\" alt width=\"145\" height=\"300\" class=\"alignnone size-medium wp-image-413339\"><\/a><\/p>\n<p><a href=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q5a.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q5a-144x300.jpg\" alt width=\"144\" height=\"300\" class=\"alignnone size-medium wp-image-413340\"><\/a><\/p>\n<p><a href=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q1.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q1-300x214.jpg\" alt width=\"300\" height=\"214\" class=\"alignnone size-medium wp-image-413341\"><\/a><\/p>\n<p><a href=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q2.jpg\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q2-300x223.jpg\" alt width=\"300\" height=\"223\" class=\"alignnone size-medium wp-image-413342\"><\/a><\/p>\n<p><a href=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q3.jpg\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.banatulazi.ro\/wp-content\/uploads\/2026\/06\/q3-217x300.jpg\" alt width=\"217\" height=\"300\" class=\"alignnone size-medium wp-image-413343\"><\/a><\/p>\n<p><strong>\u00cen fa\u021ba acestei situa\u021bii ciudate se pun, \u00een mod firesc, urm\u0103toarele \u00eentreb\u0103ri:<\/strong><\/p>\n<p><em>\u201eDac\u0103 hot\u0103r\u00e2rea este legal\u0103 \u0219i produce efecte juridice, atunci de ce nu este executat\u0103?<br \/>\nDac\u0103 situa\u021bia juridic\u0103 \u00eempiedic\u0103 executarea ei, de ce acest lucru nu a fost comunicat Consiliului Local \u00eenainte de adoptarea hot\u0103r\u00e2rii?<br \/>\nDac\u0103 exist\u0103 impedimente reale, cine r\u0103spunde pentru promovarea unei hot\u0103r\u00e2ri care nu poate fi pus\u0103 \u00een aplicare?<br \/>\nDup\u0103 patru luni de solicit\u0103ri \u0219i coresponden\u021b\u0103, \u00eenc\u0103 a\u0219tept r\u0103spunsuri clare la aceste \u00eentreb\u0103ri.
