But it&#8217;s looking increasingly likely that Nintendo will lose.<\/p>\n<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Nintendo and The Pok\u00e9mon Company are currently embroiled in <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/nintendo-and-the-pokmon-company-officially-suing-palworld-developer-over-multiple-patent-infringements\"><u>ongoing litigation with Pocketpair<\/u><\/a> in Japan, with patents that revolve around how Pok\u00e9mon games work at the heart of the lawsuit.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Palworld arrived on Steam priced $30 and launched straight into Game Pass on Xbox and PC in early 2024, breaking sales and concurrent player number records in the process. Pocketpair boss Takuro Mizobe has said Palworld&#8217;s launch was so big that the developer <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-says-massive-profits-are-too-big-for-a-studio-with-our-size-to-handle\"><u>couldn\u2019t handle the massive profits the game generated<\/u><\/a>. Still, Pocketpair acted swiftly to capitalize on Palworld\u2019s breakout success, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-signs-deal-with-sony-to-form-palworld-entertainment-and-expand-the-ip\"><u>signing a deal with Sony<\/u><\/a> to form a new business called Palworld Entertainment that\u2019s tasked with expanding the IP. It later launched the game on PS5.<\/p>\n<div class=\"jsx-2896921488 video jsx-2008855984 aspect-ratio aspect-ratio-16-9\">\n<div class=\"badge jsx-1349606671 jsx-3647116352\"><span class=\"ign-icon icon-play jsx-2750866048 jsx-1044454891\" role=\"img\" aria-hidden=\"false\" data-cy=\"icon-play\" aria-label=\"Play\" style=\"background:currentColor\"><\/span><\/div>\n<\/div>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">After Palworld\u2019s huge launch, comparisons were made between Palworld\u2019s Pals and Pok\u00e9mon, with some accusing Pocketpair of &#8220;ripping off&#8221; Pok\u00e9mon designs. But rather than file a copyright infringement lawsuit, Nintendo and The Pok\u00e9mon Company went down the patent route. In the initial lawsuit, the two companies called for 5 million yen (approx $30,000) each plus late payment damages, as well as an injunction against Palworld that would block its release.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">In November 2024, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-reveals-patents-at-the-heart-of-nintendo-and-the-pokmon-company-lawsuit-and-how-much-money-its-being-sued-for\"><u>Pocketpair confirmed the three Japan-based patents<\/u><\/a>, which revolve around catching Pok\u00e9mon in a virtual field, it was being sued over. Palworld did include a mechanic that involved throwing a ball-like object (called a Pal Sphere) at monsters out in a field to capture them, similar to the mechanic seen in the 2022 Nintendo Switch exclusive <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/games\/pokemon-legends-arceus\"><u>Pok\u00e9mon Legends: Arceus<\/u><\/a>. <\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Pocketpair subsequently made changes to Palworld it admitted were the direct result of the legal threats. Patch v0.3.11, released in November 2024, removed the ability to summon Pals by throwing Pal Spheres and instead changed it to a static summon next to the player. Several other game mechanics were also changed with this patch. If a Pok\u00e9mon is distressed, you\u2019re tasked to calm it down. If one goes missing, you have to go find it. If there\u2019s a fire, you can use a nearby water Pok\u00e9mon to help put it out. Cute missions like these are strung together in a run, which replicates the sort of little tasks you\u2019d see in cosy games. And they\u2019re funny, too! Pok\u00e9mon has always been fun, but rarely has it displayed actual comedic chops in the way it does here.&lt;br&gt;&lt;br&gt;\n\nWhile Ranger definitely has its fans, it\u2019s not higher on this list because the missions can get\u2026 repetitive. The main gameplay loop is literally about loops \u2013 you have to physically draw circles around the Pok\u00e9mon you want to temporarily capture for each task using the Nintendo DS\u2019 stylus. This has more depth than it sounds, but even the most challenging captures don\u2019t feel completely satisfying. It\u2019s an example of a really fun idea that doesn\u2019t quite fully hold up in execution. Though lacking in significant story beats for lore-hungry fans, Stadium 2 in particular was a dream for the most competitive members of the fanbase, offering a myriad of battle formats. It also introduced Earl\u2019s Pok\u00e9mon Academy, which both taught battle strategies and tested newfound skills.&lt;br&gt;&lt;br&gt; \n\nBut there\u2019s more to Stadium 2 than just the stadium itself. Let\u2019s not forget the endlessly entertaining Pok\u00e9mon mini-games and quizzes of the Kids Club, or the returning magic trick introduced in the first game: importing the exact same Pokemon you had raised in GameBoy games straight into the Nintendo 64. Taking your favourites on a cross-console journey to the big Stadium hit upon one of the core appeals of the series: strengthening the lasting connection you have with these digital creatures. While it\u2019s a similar style of RPG to the classic games, instead of starting out as a young trainer with a level five starter looking to become the Pok\u00e9mon champion, you\u2019re dropped into the shoes of a more experienced protagonist who uses the decidedly cool (and level 25!) Espeon and Umbreon. Your adventure begins right after escaping from the nefarious Team Snagem with stolen technology, a story set up that, along with a Star Wars-inspired desert community setting, ensures Colosseum occupies its own distinct space in the Pok\u00e9mon library. &lt;br&gt;&lt;br&gt;\n\nColosseum was where Shadow Pok\u00e9mon were first introduced to the franchise. These are Pok\u00e9mon who have been &quot;closed off from their hearts&quot; and need to be purified before they can properly be used in battle. It lends new weight to the idea of Shadow Pok\u00e9mon, explored through the addition of Shadow Lugia \u2013 the only pocket monster to get a full, dark redesign, and said to be the ultimate Shadow Pok\u00e9mon, unable to be purified. &lt;br&gt;&lt;br&gt;\n\nSet five years after the events of Colosseum, you\u2019re tasked with taking down the Cipher criminal syndicate and purifying Pok\u00e9mon across the Orre region. While inheriting Colosseum\u2019s gameplay style, complete with the excellent doubles battle system that brings Pok\u00e9mon a little closer to feeling like a party-based JRPG, Gale of Darkness differentiates itself from its predecessor by casting you as a rookie trainer. This change means the experience falls more in line with the typical Pok\u00e9mon journey, which arguably robs the game of a bit of originality. However, the 3D world and continued exploration of the Shadow Pok\u00e9mon phenomenon makes up for any feeling of repetition, with each new story beat deepening the worldbuilding and adding more layers to the Orre region. This crossover introduces a variety of elements you\u2019d never expect to see in a Pok\u00e9mon game, including historical figures from Japan\u2019s Sengoku period, such as daimy\u014d Oda Nobunaga himself. It also combines Pok\u00e9mon\u2019s traditions with very non-traditional characters, art style, and dialogue. This makes for an unusual game, but it becomes easy to accept such a strange mixture as soon as you jump into a battle. &lt;br&gt;&lt;br&gt;\n\nPok\u00e9mon fits the strategy game genre like a glove. Conquest\u2019s type match-ups, interactive battlefields, and each Pok\u00e9mon\u2019s hidden abilities all make for a compelling strategy battle system that can, at times, feel even more engaging than the core series\u2019 turn-based combat. &lt;br&gt;&lt;br&gt;\n\nConquest may not scratch the itch of those looking to immerse themselves further in the traditional world of Pok\u00e9mon, as the game probably takes place in its own universe with its own rules. However, its completely fresh approach makes it a genuinely unique prospect in a franchise that can often fall foul of delivering the same experience over and over again. Pocketpair called these changes \u201ccompromises\u201d the studio was being forced to make out of fear of an injunction being granted that could block the development and sale of Palworld.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">\u201cWe understand that this will be disappointing for many, just as it is for us, but we hope our fans understand that these changes are necessary in order to prevent further disruptions to the development of Palworld,\u201d Pocketpair said at the time.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Now, writing on <a href=\"https:\/\/gamesfray.com\/ahead-of-october-1-court-hearing-nintendo-has-zero-chance-of-prevailing-over-current-palworld-versions-it-may-get-30k-chump-change\/\" class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" target=\"_blank\" rel=\"noopener noreferrer\">games fray<\/a>, IP expert Florian Mueller said that late last year, Nintendo and The Pok\u00e9mon Company amended the scope of their claims so the case was limited to older versions of Palworld, as opposed to all Palworld versions. The belief here is that they did so because of the changes Pocketpair made to the way Palworld worked in response to the lawsuit, as outlined above.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">The upshot of this, Mueller said, is that \u201cwe cannot see any pathway to victory over any current or very recent Palworld version (nor Palworld 1.0, which should launch soon) for Nintendo. Pocketpair boss Takuro Mizobe has said Palworld&#8217;s launch was so big that the developer <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-says-massive-profits-are-too-big-for-a-studio-with-our-size-to-handle\"><u>couldn\u2019t handle the massive profits the game generated<\/u><\/a>. Still, Pocketpair acted swiftly to capitalize on Palworld\u2019s breakout success, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-signs-deal-with-sony-to-form-palworld-entertainment-and-expand-the-ip\"><u>signing a deal with Sony<\/u><\/a> to form a new business called Palworld Entertainment that\u2019s tasked with expanding the IP. It later launched the game on PS5.<\/p>\n<div class=\"jsx-2896921488 video jsx-2008855984 aspect-ratio aspect-ratio-16-9\">\n<div class=\"badge jsx-1349606671 jsx-3647116352\"><span class=\"ign-icon icon-play jsx-2750866048 jsx-1044454891\" role=\"img\" aria-hidden=\"false\" data-cy=\"icon-play\" aria-label=\"Play\" style=\"background:currentColor\"><\/span><\/div>\n<\/div>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">After Palworld\u2019s huge launch, comparisons were made between Palworld\u2019s Pals and Pok\u00e9mon, with some accusing Pocketpair of &#8220;ripping off&#8221; Pok\u00e9mon designs. But rather than file a copyright infringement lawsuit, Nintendo and The Pok\u00e9mon Company went down the patent route. In the initial lawsuit, the two companies called for 5 million yen (approx $30,000) each plus late payment damages, as well as an injunction against Palworld that would block its release.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">In November 2024, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-reveals-patents-at-the-heart-of-nintendo-and-the-pokmon-company-lawsuit-and-how-much-money-its-being-sued-for\"><u>Pocketpair confirmed the three Japan-based patents<\/u><\/a>, which revolve around catching Pok\u00e9mon in a virtual field, it was being sued over. Palworld did include a mechanic that involved throwing a ball-like object (called a Pal Sphere) at monsters out in a field to capture them, similar to the mechanic seen in the 2022 Nintendo Switch exclusive <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/games\/pokemon-legends-arceus\"><u>Pok\u00e9mon Legends: Arceus<\/u><\/a>. <\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Pocketpair subsequently made changes to Palworld it admitted were the direct result of the legal threats. Patch v0.3.11, released in November 2024, removed the ability to summon Pals by throwing Pal Spheres and instead changed it to a static summon next to the player. Several other game mechanics were also changed with this patch. Cute missions like these are strung together in a run, which replicates the sort of little tasks you\u2019d see in cosy games. And they\u2019re funny, too! Pok\u00e9mon has always been fun, but rarely has it displayed actual comedic chops in the way it does here.&lt;br&gt;&lt;br&gt;\n\nWhile Ranger definitely has its fans, it\u2019s not higher on this list because the missions can get\u2026 repetitive. The main gameplay loop is literally about loops \u2013 you have to physically draw circles around the Pok\u00e9mon you want to temporarily capture for each task using the Nintendo DS\u2019 stylus. This has more depth than it sounds, but even the most challenging captures don\u2019t feel completely satisfying. It\u2019s an example of a really fun idea that doesn\u2019t quite fully hold up in execution. These are Pok\u00e9mon who have been &quot;closed off from their hearts&quot; and need to be purified before they can properly be used in battle. While inheriting Colosseum\u2019s gameplay style, complete with the excellent doubles battle system that brings Pok\u00e9mon a little closer to feeling like a party-based JRPG, Gale of Darkness differentiates itself from its predecessor by casting you as a rookie trainer. This change means the experience falls more in line with the typical Pok\u00e9mon journey, which arguably robs the game of a bit of originality. However, the 3D world and continued exploration of the Shadow Pok\u00e9mon phenomenon makes up for any feeling of repetition, with each new story beat deepening the worldbuilding and adding more layers to the Orre region. This makes for an unusual game, but it becomes easy to accept such a strange mixture as soon as you jump into a battle. &lt;br&gt;&lt;br&gt;\n\nPok\u00e9mon fits the strategy game genre like a glove. Conquest\u2019s type match-ups, interactive battlefields, and each Pok\u00e9mon\u2019s hidden abilities all make for a compelling strategy battle system that can, at times, feel even more engaging than the core series\u2019 turn-based combat. &lt;br&gt;&lt;br&gt;\n\nConquest may not scratch the itch of those looking to immerse themselves further in the traditional world of Pok\u00e9mon, as the game probably takes place in its own universe with its own rules. However, its completely fresh approach makes it a genuinely unique prospect in a franchise that can often fall foul of delivering the same experience over and over again. Pocketpair called these changes \u201ccompromises\u201d the studio was being forced to make out of fear of an injunction being granted that could block the development and sale of Palworld.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">\u201cWe understand that this will be disappointing for many, just as it is for us, but we hope our fans understand that these changes are necessary in order to prevent further disruptions to the development of Palworld,\u201d Pocketpair said at the time.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Now, writing on <a href=\"https:\/\/gamesfray.com\/ahead-of-october-1-court-hearing-nintendo-has-zero-chance-of-prevailing-over-current-palworld-versions-it-may-get-30k-chump-change\/\" class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" target=\"_blank\" rel=\"noopener noreferrer\">games fray<\/a>, IP expert Florian Mueller said that late last year, Nintendo and The Pok\u00e9mon Company amended the scope of their claims so the case was limited to older versions of Palworld, as opposed to all Palworld versions. The belief here is that they did so because of the changes Pocketpair made to the way Palworld worked in response to the lawsuit, as outlined above.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">The upshot of this, Mueller said, is that \u201cwe cannot see any pathway to victory over any current or very recent Palworld version (nor Palworld 1.0, which should launch soon) for Nintendo. There will be no injunction with real-world impact.\u201d<\/p>\n<div class=\"jsx-2896921488 video jsx-2008855984 aspect-ratio aspect-ratio-16-9\">\n<div class=\"badge jsx-1349606671 jsx-3647116352\"><span class=\"ign-icon icon-play jsx-2750866048 jsx-1044454891\" role=\"img\" aria-hidden=\"false\" data-cy=\"icon-play\" aria-label=\"Play\" style=\"background:currentColor\"><\/span><\/div>\n<\/div>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">And even if Nintendo wins its case against the older versions of Palworld, the most it could get in terms of a payout is 5 million yen (approx. $30,000). \u201cThat is chump change for either party, and just a rounding error compared to Nintendo\u2019s litigation expenses,\u201d Mueller.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">That\u2019s because there was only a short window, with limited sales volume in Japan only, for which Nintendo can seek damages. That\u2019s one option, but Mueller said that Nintendo may be put off doing because of how hard it&#8217;s been to obtain game-rule patents in key jurisdictions. For example, in April, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/uspto-rejects-nintendos-controversial-summon-character-and-let-it-fight-pokemon-patent-in-non-final-ruling-as-palworld-legal-battle-rumbles-on\">the USPTO rejected Nintendo\u2019s controversial &#8216;summon character and let it fight&#8217; Pok\u00e9mon patent<\/a>, after it was heavily criticized by IP lawyers.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">We should get some resolution to all this later this year. The court has scheduled a presentation of evidence for October 1, and will express an opinion on November 9, 2026.
