I\u2019m willing to drop the trademark, and if I do that, you drop the lawsuit,\u201d Wiley said in a video posted to Instagram. \u201cI\u2019m handing you what you\u2019re asking for. So it\u2019s your move, Patagonia.\u201d<\/p>\n<ul>\n<li><strong>Related: <em><a href=\"https:\/\/snowbrains.com\/when-saving-the-planet-meets-intellectual-property-why-patagonia-is-suing-queer-climate-activist-pattie-gonia\/\">When Saving the Planet Meets Intellectual Property: Why Patagonia Is Suing Queer Climate Activist Pattie Gonia<\/a><\/em><\/strong><\/li>\n<\/ul>\n<p><strong>About 14 hours later, Patagonia issued a public statement acknowledging the controversy and expressing a desire to resolve the dispute. <\/strong>\u201cWe wish this lawsuit had not been necessary, and we want to acknowledge any hurt it has caused, especially in the LGBTQ+ community,\u201d the company wrote. \u201cImportantly, we continue to want to resolve this.\u201d<\/p>\n<h2>Where the Two Sides Differ<\/h2>\n<p><strong>While Wiley offered to withdraw the trademark application, Patagonia\u2019s proposed resolution goes further. <\/strong>The company said settlement would require Pattie Gonia to:<\/p>\n<ul>\n<li>Withdraw all trademark applications<\/li>\n<li>Stop using Patagonia\u2019s logos<\/li>\n<li>Stop selling and promoting apparel and other products as Pattie Gonia<\/li>\n<\/ul>\n<p><strong>\u201cIf we can agree on this, we can work out everything else, and Pattie Gonia could continue as a performer and activist,\u201d Patagonia wrote. <\/strong>The difference is significant. Wiley\u2019s proposal addresses the trademark application itself, while Patagonia is also seeking changes to branding and merchandise sales.<\/p>\n<h2>Disagreement Over What Happened<\/h2>\n<p><strong>Wiley also challenged Patagonia\u2019s account of events leading up to the lawsuit. <\/strong>According to Wiley, Patagonia never attempted to discuss the trademark application before filing suit in federal court. \u201cThe first time we heard from Patagonia after filing our trademark application was four months later when their internal lawyer emailed to say that Patagonia had filed the lawsuit against me for trademark infringement,\u201d Wiley said.<\/p>\n<p><strong>Patagonia has previously stated in court filings that the parties had discussed trademark-related concerns during earlier conversations, including discussions surrounding a proposed Hydro Flask collaboration in 2022. <\/strong>The conflicting accounts have become a central issue in the increasingly public dispute.<\/p>\n<h2>The Trademark Question<\/h2>\n<p><strong>In the video, Wiley also noted that the U.S. Patent and Trademark Office initially found the Pattie Gonia trademark application \u201cnot confusingly similar\u201d to Patagonia\u2019s trademarks.<\/strong><\/p>\n<p><strong>However, trademark applications that pass an initial USPTO review can still be challenged by third parties, which is effectively what Patagonia is attempting to do through its lawsuit.<\/strong><\/p>\n<p><strong>Patagonia argues that Pattie Gonia\u2019s commercial activities, including merchandise sales and trademark registrations, overlap with categories covered by Patagonia\u2019s own trademarks and could create consumer confusion.<\/strong><\/p>\n<h2>What Happens Next<\/h2>\n<p><strong>The exchange marks the clearest sign yet that both sides may be interested in avoiding a lengthy court battle.<\/strong><\/p>\n<p><strong>Patagonia stated that it shares \u201ccommon ground\u201d with Pattie Gonia, including environmental protection and creating a more inclusive outdoors.<\/strong> Wiley has similarly argued that their activism aligns closely with the values Patagonia has promoted for decades.
