During a January 12 visit to Aspen Snowmass<\/a>, Colorado, a son of an Australian family fell 24 feet from the resort\u2019s Alpine Springs chairlift, reports Aspen Daily News<\/a><\/em>. <\/strong>The Quigley family has now filed a lawsuit against Aspen Ski Co., claiming the chairlift operator and attendant were not paying attention when the boy \u201cmisloaded the carrier and was not securely seated.\u201d The family is suing for gross negligence<\/a> and negligence per se<\/a> (which establishes that a defendant is negligent if they violate a safety law or regulation).<\/p>\n

Aspen Ski Co. Chairlift Lawsuit: What the Quigley Family Alleges<\/strong><\/h3>\n

The fall left the boy with a broken pelvis and a concussion.\u00a0<\/strong>He was in a wheelchair for multiple weeks, according to the lawsuit.<\/p>\n

Shaun Quigley, the boy\u2019s father, claims both lift workers were unaware his son was \u201cdangling from the carrier.\u201d <\/strong>He claims that his son was dangling for \u201cmore than 20 seconds\u201d and that the lift continued, despite reaching a \u201cconsiderable distance and height from the boarding area.\u201d<\/p>\n
