Here, we speak to the activists who fought to get the ruling overturned about what <span class=\"nowrap\">happens next<\/span><\/h2>\n<\/div>\n<p><time datetime=\"2026-02-25T08:00:00+00:00\" class=\"timestamp\" title=\"25 February 2026\"><span class=\"month\">February<\/span>\u00a0<br \/>\n<span class=\"day\" data-day=\"25\">25,<\/span>\u00a0<br \/>\n<span class=\"year\">2026<\/span><\/time><\/div>\n<\/div>\n<p><time datetime=\"2026-02-25T08:00:00+00:00\" class=\"timestamp\" title=\"25 February 2026\"><span class=\"month\">February<\/span>\u00a0<br \/>\n<span class=\"day\" data-day=\"25\">25,<\/span>\u00a0<br \/>\n<span class=\"year\">2026<\/span><\/time><\/p>\n<div class=\"providers\">\n<div class=\"contributors\"><span class=\"contributor\" data-contributor-role=\"Text\"><span class=\"contributor-role\">Text<\/span><a class=\"contributor-name\" href=\"https:\/\/www.dazeddigital.com\/user\/FreyaRobinson\">Freya Robinson<\/a><\/span><\/div>\n<\/div>\n<\/div>\n<\/header>\n<div class=\"article-body-container\">\n<div class=\"article-body wrapper\">\n<div class=\"embed-content\" data-embed-type=\"raw-html\">\n<p><span>On a Saturday last August, I spent the morning admiring the pelicans in London\u2019s St James\u2019s Park, then sharpied a solicitor\u2019s number on my inner arm and committed a terrorist offence \u2013 or so the government thought. I did nothing violent: I only sat in a public park, holding a piece of cardboard scrawled with the phrase \u2018I support Palestine Action\u2019.\u00a0<\/span><\/p>\n<p><span>A staggering <\/span><a href=\"https:\/\/observer.co.uk\/news\/national\/article\/police-spent-10m-tackling-palestine-action-its-astonishing-says-co-founder\"><span>\u00a310 million was spent<\/span><\/a><span> policing actions like this last summer, with veterans, doctors, and vicars among those risking arrest to support the group, which was controversially proscribed as a terrorist organisation in July. As Palestine Action only damages property (namely that of Elbit Systems, the largest manufacturer of weapons for Israel), the proscription sparked outrage from <\/span><a href=\"https:\/\/www.amnesty.org.uk\/knowledge-hub\/all-resources\/open-letter-members-house-commons-and-peers-house-lords-regarding-palestine-action\/\"><span>Amnesty International<\/span><\/a><span> and <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/07\/uk-palestine-action-ban-disturbing-misuse-uk-counter-terrorism-legislation\"><span>the UN<\/span><\/a><span>, with the latter declaring it a misuse of terrorism legislation, and \u201cat odds with the UK\u2019s obligations under international human rights law\u201d.\u00a0<\/span><\/p>\n<p><span>Now, six months, over 2,700 arrests, and one heavily contested trial later, the High Court has agreed<\/span><span> that the ban on Palestine Action <\/span><a href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2026\/02\/R-Ammori-v-SSHD-OPEN-Judgment-final.pdf\"><span>contravenes the Human Rights Act<\/span><\/a><span> and must be lifted. While <\/span><span>this result has come as a relief to many, those of us arrested for holding placards are still facing an uncertain future. As the government <\/span><a href=\"https:\/\/www.bbc.co.uk\/news\/live\/c8x90q9nyzyt\"><span>plans to appeal the court\u2019s decision<\/span><\/a><span>, the original ban and charges are being kept in place through the remaining legal process.<\/span><\/p>\n<p><span>Raj Chada, a criminal defence lawyer who has previously represented Greta Thunberg, among other activists, tells me that this could take a while. \u201c[The case] will go to the Court of Appeal first, which will take a couple of months. Then it could go to the Supreme Court, which will take until the end of the year, and if they decide in favour of the government, it will go to the European Court of Human Rights, which will take two or three years at least\u201d, he says. Throughout all this, thousands of people are set to be stuck in legal limbo, unsure when \u2013 or if \u2013 they will go to court. While they wait, some are already paying a price.<\/span><\/p>\n<\/div>\n<div class=\"instagram-container embed-content\" data-embed-type=\"media-instagram\" data-script-depends=\"instagram-embeds\">\n<script async src=\"https:\/\/www.instagram.com\/embed.js\"><\/script><\/div>\n<div class=\"embed-content\" data-embed-type=\"raw-html\">\n<p><span>37-year-old Sin\u00e9ad, from Limerick, says that since her arrest, she has been \u201clooked at like a proper criminal\u201d in her community. Having travelled to London to attend one of the protests last August, she now fears being extradited back to the UK to stand trial, something she\u2018d respond to with a hunger strike. \u201cI feel it\u2019s important to show the UK government that if they do try to imprison us, we won\u2019t be taking no for an answer\u201d, she says. \u201cI doubt I\u2019ll be imprisoned. I\u2019d say it\u2019ll be community service, a fine, and a slap on the wrist \u2013 but we don\u2019t know because everything is up in the air. Because many activists have been arrested over a short period of time and the courts are so weighed down by it, it\u2019s very difficult to know what they\u2019ll try to do\u201d.<\/span><\/p>\n<p><span>This sense of uncertainty is weighing on a lot of people. \u201cIt\u2019s hard to plan, as you don\u2019t know if or when you\u2019ll need to go to court\u201d, says Saffy, 44, from North West England. She has faced considerable stress since her arrest, particularly in hiding her legal situation from her mother, who has dementia and for whom she is a carer. \u201cI have to make sure I get to the post first in case there\u2019s an envelope from the police\u201d, she tells me, adding that \u201cthe only time I cried was in custody, when they asked me about any caring responsibilities, and I had to explain about my mum\u201d.\u00a0<\/span><\/p>\n<p><span>Others have been penalised more directly. Following her arrest, 78-year-old Sue, from Essex, was suspended from the volunteer role she\u2019d worked in for seven years. Although the charity\u2019s CEO had initially agreed she could continue working for them, Sue later received a phone call telling her this would not be the case as the organisation feared losing government funding if she was kept on. \u201cIt\u2019s been my passion and structure, and now I feel I\u2019m a leper. I even asked if I could work out in the back kitchen washing up \u2013 but no\u201d, she says. \u201cIt\u2019s bad enough for me being denied the opportunity to return to volunteering, but for those who have lost jobs, it\u2019s much more worrying\u201d.\u00a0<\/span><\/p>\n<\/div>\n<div class=\"embed-content\" data-embed-type=\"raw-html\">\n<blockquote>\n<p><span>I believe this action has been the most detrimental to my career, but I don\u2019t care, it doesn\u2019t faze me at all<\/span><\/p>\n<\/blockquote>\n<\/div>\n<div class=\"embed-content\" data-embed-type=\"raw-html\">\n<p><span>That was the case for 54-year-old Caeryn, from Wigan, who was sacked from her role as a senior manager following her arrest last year, with, in her words, \u201cno suspension, no hearing, no warning, no appeal\u201d. Her new employer is more understanding, but the job\u2019s considerably lower pay has been tough on her as a single parent and sole breadwinner for her family. She says they now have \u201cquite a restrictive life, so no luxuries. We can afford to eat, but no extras\u201d.\u00a0<\/span><\/p>\n<p><span>Although Imogen, who is 30 and lives near Hastings, hasn\u2019t lost her job, the stress and recurring nightmares she suffers over her arrest recently led to her being booked off on health grounds. Having previously considered becoming a teacher, she now doesn\u2019t see herself applying for training in the foreseeable future. \u201cI probably wouldn\u2019t pass an enhanced DBS check\u201d, she says. \u201cIn the context of a teaching shortage, I think I have a lot to offer \u2013 I have degrees from Bristol and Oxford \u2013 so it seems so silly that I\u2019m deemed a terror threat for taking a principled stance. Being in legal limbo feels like punishment by process\u201d.<\/span><\/p>\n<p><span>To prevent this \u2018punishment by process\u2019, Chada suggests it would be \u201csensible\u201d for the Crown Prosecution Service to dismiss these charges until the appeal process has concluded. Of course, any time and public money spent prosecuting sign-holders now would be wasted if the government\u2019s appeal is rejected, which is what he foresees happening. \u201cI do not think that they will win. In a competitive field of disastrous decisions by the government, the decision to appeal has to rank up there as one of the worst\u201d, he tells me, noting the absurdity that \u201cthe most common terrorist in 2026 in the UK is a pensioner holding a placard\u201d.\u00a0<\/span><\/p>\n<p><span>Despite the legal consequences, participating in the protest has changed Sin\u00e9ad\u2019s life for the better. \u201cI\u2019d been so numb to the world, and it\u2019s the first time in my life where I actually feel like I\u2019m human\u201d, she says. \u201cI believe this action has been the most detrimental to my career, but I don\u2019t care; it doesn\u2019t faze me at all. In any other action I\u2019ve done, I never felt it had any impact. This particular action, it just felt like I was making a dent\u201d. Elbit Systems certainly felt that dent in January, when the government abandoned its previous plans to <\/span><a href=\"https:\/\/www.telegraph.co.uk\/news\/2026\/01\/14\/palestine-action-hunger-strikers-claim-victory\/\"><span>award them a \u00a32 billion contract<\/span><\/a><span>, something many attribute to the pressure applied by Palestine Action. \u201cThat was a huge win for us, and it was way more of a win than this judicial review\u201d, Sin\u00e9ad says. \u201cI feel so proud of what we\u2019ve done, all of us. I did nothing violent: I only sat in a public park, holding a piece of cardboard scrawled with the phrase \u2018I support Palestine Action\u2019.\u00a0<\/span><\/p>\n<p><span>A staggering <\/span><a href=\"https:\/\/observer.co.uk\/news\/national\/article\/police-spent-10m-tackling-palestine-action-its-astonishing-says-co-founder\"><span>\u00a310 million was spent<\/span><\/a><span> policing actions like this last summer, with veterans, doctors, and vicars among those risking arrest to support the group, which was controversially proscribed as a terrorist organisation in July. As Palestine Action only damages property (namely that of Elbit Systems, the largest manufacturer of weapons for Israel), the proscription sparked outrage from <\/span><a href=\"https:\/\/www.amnesty.org.uk\/knowledge-hub\/all-resources\/open-letter-members-house-commons-and-peers-house-lords-regarding-palestine-action\/\"><span>Amnesty International<\/span><\/a><span> and <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/07\/uk-palestine-action-ban-disturbing-misuse-uk-counter-terrorism-legislation\"><span>the UN<\/span><\/a><span>, with the latter declaring it a misuse of terrorism legislation, and \u201cat odds with the UK\u2019s obligations under international human rights law\u201d.\u00a0<\/span><\/p>\n<p><span>Now, six months, over 2,700 arrests, and one heavily contested trial later, the High Court has agreed<\/span><span> that the ban on Palestine Action <\/span><a href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2026\/02\/R-Ammori-v-SSHD-OPEN-Judgment-final.pdf\"><span>contravenes the Human Rights Act<\/span><\/a><span> and must be lifted. While <\/span><span>this result has come as a relief to many, those of us arrested for holding placards are still facing an uncertain future. As the government <\/span><a href=\"https:\/\/www.bbc.co.uk\/news\/live\/c8x90q9nyzyt\"><span>plans to appeal the court\u2019s decision<\/span><\/a><span>, the original ban and charges are being kept in place through the remaining legal process.<\/span><\/p>\n<p><span>Raj Chada, a criminal defence lawyer who has previously represented Greta Thunberg, among other activists, tells me that this could take a while. \u201c[The case] will go to the Court of Appeal first, which will take a couple of months. Then it could go to the Supreme Court, which will take until the end of the year, and if they decide in favour of the government, it will go to the European Court of Human Rights, which will take two or three years at least\u201d, he says. Throughout all this, thousands of people are set to be stuck in legal limbo, unsure when \u2013 or if \u2013 they will go to court. While they wait, some are already paying a price.<\/span><\/p>\n<\/div>\n<div class=\"instagram-container embed-content\" data-embed-type=\"media-instagram\" data-script-depends=\"instagram-embeds\">\n<script async src=\"https:\/\/www.instagram.com\/embed.js\"><\/script><\/div>\n<div class=\"embed-content\" data-embed-type=\"raw-html\">\n<p><span>37-year-old Sin\u00e9ad, from Limerick, says that since her arrest, she has been \u201clooked at like a proper criminal\u201d in her community. Having travelled to London to attend one of the protests last August, she now fears being extradited back to the UK to stand trial, something she\u2018d respond to with a hunger strike. \u201cI feel it\u2019s important to show the UK government that if they do try to imprison us, we won\u2019t be taking no for an answer\u201d, she says. \u201cI doubt I\u2019ll be imprisoned. I\u2019d say it\u2019ll be community service, a fine, and a slap on the wrist \u2013 but we don\u2019t know because everything is up in the air. Because many activists have been arrested over a short period of time and the courts are so weighed down by it, it\u2019s very difficult to know what they\u2019ll try to do\u201d.<\/span><\/p>\n<p><span>This sense of uncertainty is weighing on a lot of people. \u201cIt\u2019s hard to plan, as you don\u2019t know if or when you\u2019ll need to go to court\u201d, says Saffy, 44, from North West England. She has faced considerable stress since her arrest, particularly in hiding her legal situation from her mother, who has dementia and for whom she is a carer. \u201cI have to make sure I get to the post first in case there\u2019s an envelope from the police\u201d, she tells me, adding that \u201cthe only time I cried was in custody, when they asked me about any caring responsibilities, and I had to explain about my mum\u201d.\u00a0<\/span><\/p>\n<p><span>Others have been penalised more directly. Following her arrest, 78-year-old Sue, from Essex, was suspended from the volunteer role she\u2019d worked in for seven years. Although the charity\u2019s CEO had initially agreed she could continue working for them, Sue later received a phone call telling her this would not be the case as the organisation feared losing government funding if she was kept on. \u201cIt\u2019s been my passion and structure, and now I feel I\u2019m a leper. I even asked if I could work out in the back kitchen washing up \u2013 but no\u201d, she says. \u201cIt\u2019s bad enough for me being denied the opportunity to return to volunteering, but for those who have lost jobs, it\u2019s much more worrying\u201d.\u00a0<\/span><\/p>\n<\/div>\n<div class=\"embed-content\" data-embed-type=\"raw-html\">\n<blockquote>\n<p><span>I believe this action has been the most detrimental to my career, but I don\u2019t care, it doesn\u2019t faze me at all<\/span><\/p>\n<\/blockquote>\n<\/div>\n<div class=\"embed-content\" data-embed-type=\"raw-html\">\n<p><span>That was the case for 54-year-old Caeryn, from Wigan, who was sacked from her role as a senior manager following her arrest last year, with, in her words, \u201cno suspension, no hearing, no warning, no appeal\u201d. Her new employer is more understanding, but the job\u2019s considerably lower pay has been tough on her as a single parent and sole breadwinner for her family. She says they now have \u201cquite a restrictive life, so no luxuries. We can afford to eat, but no extras\u201d.\u00a0<\/span><\/p>\n<p><span>Although Imogen, who is 30 and lives near Hastings, hasn\u2019t lost her job, the stress and recurring nightmares she suffers over her arrest recently led to her being booked off on health grounds. Having previously considered becoming a teacher, she now doesn\u2019t see herself applying for training in the foreseeable future. \u201cI probably wouldn\u2019t pass an enhanced DBS check\u201d, she says. \u201cIn the context of a teaching shortage, I think I have a lot to offer \u2013 I have degrees from Bristol and Oxford \u2013 so it seems so silly that I\u2019m deemed a terror threat for taking a principled stance. Being in legal limbo feels like punishment by process\u201d.<\/span><\/p>\n<p><span>To prevent this \u2018punishment by process\u2019, Chada suggests it would be \u201csensible\u201d for the Crown Prosecution Service to dismiss these charges until the appeal process has concluded. Of course, any time and public money spent prosecuting sign-holders now would be wasted if the government\u2019s appeal is rejected, which is what he foresees happening. \u201cI do not think that they will win. In a competitive field of disastrous decisions by the government, the decision to appeal has to rank up there as one of the worst\u201d, he tells me, noting the absurdity that \u201cthe most common terrorist in 2026 in the UK is a pensioner holding a placard\u201d.\u00a0<\/span><\/p>\n<p><span>Despite the legal consequences, participating in the protest has changed Sin\u00e9ad\u2019s life for the better. \u201cI\u2019d been so numb to the world, and it\u2019s the first time in my life where I actually feel like I\u2019m human\u201d, she says. \u201cI believe this action has been the most detrimental to my career, but I don\u2019t care; it doesn\u2019t faze me at all. In any other action I\u2019ve done, I never felt it had any impact. This particular action, it just felt like I was making a dent\u201d. Elbit Systems certainly felt that dent in January, when the government abandoned its previous plans to <\/span><a href=\"https:\/\/www.telegraph.co.uk\/news\/2026\/01\/14\/palestine-action-hunger-strikers-claim-victory\/\"><span>award them a \u00a32 billion contract<\/span><\/a><span>, something many attribute to the pressure applied by Palestine Action. \u201cThat was a huge win for us, and it was way more of a win than this judicial review\u201d, Sin\u00e9ad says. \u201cI feel so proud of what we\u2019ve done, all of us.
