ANALIZA CONSTITU\u021aIONAL\u0102<\/h2>\n<p>1. Fundament juridic al OUG<\/p>\n<p>Pe fond, modific\u0103rile sunt compatibile cu jurispruden\u021ba Cur\u021bii Constitu\u021bionale. Vulnerabilitatea posibil\u0103 este exclusiv procedural\u0103 \u2013 justificarea urgen\u021bei conform art. 115 alin. (4) din Constitu\u021bie, arat\u0103\u00a0<a href=\"https:\/\/umpmv.eu\/analiza-integrata-finala-ordonanta-de-urgenta-pentru-stabilirea-unor-masuri-referitoare-la-resursele-umane-necesare-institutiilor-de-aparare-ordine-publica-si-securitate-nationala\/\" target=\"_blank\" rel=\"noopener\">umpmv.eu.<\/a><\/p>\n<p>2. Neretroactivitate<\/p>\n<p>Se respect\u0103 principiul constitu\u021bional al neretroactivit\u0103\u021bii. Persoanele care \u00eendeplineau condi\u021biile anterior pot solicita pensia conform reglement\u0103rii vechi.<\/p>\n<p>3. Drepturi c\u00e2\u0219tigate<\/p>\n<p>Nu se taie pensiile \u00een plat\u0103 \u0219i nu se modific\u0103 baza de calcul. Modificarea condi\u021biilor viitoare de pensionare este permis\u0103 de cadrul constitu\u021bional.<\/p>\n<p>4. Interdic\u021bia cumulului pensie anticipat\u0103 + salariu la stat<\/p>\n<p>M\u0103sura este justificabil\u0103 prin echilibrul bugetar \u0219i evitarea dublei finan\u021b\u0103ri din fonduri publice. Este probabil constitu\u021bional\u0103 pe fond.<\/p>\n<p>Concluzie constitu\u021bional\u0103:<\/p>\n<p>Ordonan\u021ba este solid\u0103 juridic pe fond. Singura zon\u0103 sensibil\u0103 r\u0103m\u00e2ne justificarea urgen\u021bei.<\/p>\n<h2>II. ANALIZA BUGETAR\u0102<\/h2>\n<p>1. Cre\u0219terea v\u00e2rstei standard la 65 ani dup\u0103 2030<\/p>\n<p>Reprezint\u0103 o reform\u0103 structural\u0103 pe termen lung menit\u0103 s\u0103 reduc\u0103 presiunea asupra bugetului de stat \u0219i s\u0103 stabilizeze sistemul de ap\u0103rare \u0219i ordine public\u0103.<\/p>\n<div>\n<div id=\"div-gpt-ad-1625071038116-0\">\u00a0<\/div>\n<div id=\"div-gpt-ad-1625070477342-0\">\u00a0<\/div>\n<\/div>\n<p>2. Indemniza\u021bia de reten\u021bie \u2013 10%<\/p>\n<p>Cost temporar controlat, f\u0103r\u0103 impact asupra bazei de calcul a pensiei. Mecanism de men\u021binere a personalului cu experien\u021b\u0103.<\/p>\n<p>3. POZI\u021aIONARE STRATEGIC\u0102 UMPMV<\/h2>\n<p>UMPVM sus\u021bine respectarea drepturilor c\u00e2\u0219tigate, monitorizeaz\u0103 aplicarea constitu\u021bional\u0103 a ordonan\u021bei \u0219i recunoa\u0219te necesitatea echilibrului bugetar.
