{"id":1547768,"date":"2026-01-29T08:53:00","date_gmt":"2026-01-29T05:53:00","guid":{"rendered":"https:\/\/analyse.optim.biz\/?p=1547768"},"modified":"2026-01-29T08:53:00","modified_gmt":"2026-01-29T05:53:00","slug":"sindicatele-cer-interventia-ccr-pentru-oprirea-introducerii-zilei-de-concediu-medical-neplatite","status":"publish","type":"post","link":"https:\/\/analyse.optim.biz\/?p=1547768","title":{"rendered":"Sindicatele cer interven\u021bia CCR pentru oprirea introducerii zilei de concediu medical nepl\u0103tite"},"content":{"rendered":"<div class=\"articleBody\" data-key=\"articleBody\">&#8220;V\u0103 solicit\u0103m respectuos s\u0103 sesiza\u021bi Curtea Constitu\u021bional\u0103 a Rom\u00e2niei cu excep\u021bia de neconstitu\u021bionalitate a prevederilor men\u021bionate, care introduc, \u00een mod mascat, &#8220;ziua de caren\u021b\u0103&#8221; (zi de concediu medical nepl\u0103tit\u0103), \u00eenc\u0103lc\u00e2nd drepturile fundamentale ale lucr\u0103torilor rom\u00e2ni&#8221;, se arat\u0103 \u00een sesizarea confedera\u021biei sindicale transmis\u0103 Avocatului Poporului \u0219i publicat\u0103 joi.<\/p>\n<p>Sindicali\u0219tii precizeaz\u0103 c\u0103 prin respectiva prevedere din actul normativ s-a stabilit c\u0103, pentru certificatele de concediu medical eliberate \u00een perioada 1 februarie 2026 &#8211; 31 decembrie 2027, indemniza\u021biile de asigur\u0103ri sociale de s\u0103n\u0103tate prev\u0103zute de OUG nr. 158\/2005 &#8220;se calculeaz\u0103 \u0219i se pl\u0103tesc prin diminuarea cu o zi&#8221;, iar suportarea se realizeaz\u0103, \u00een cazul indemniza\u021biilor pentru incapacitate temporar\u0103 de munc\u0103, &#8220;de c\u0103tre angajator, din a doua zi p\u00e2n\u0103 inclusiv \u00een a \u0219asea zi&#8221;, iar din FNUASS \u00eencep\u00e2nd cu ziua urm\u0103toare celor suportate de angajator; pentru indemniza\u021biile suportate integral din FNUASS, plata \u00eencepe &#8220;cu a doua zi&#8221;.<\/p>\n<p>Efectul juridic const\u0103 \u00een suprimarea pl\u0103\u021bii pentru prima zi de concediu medical indiferent de stagiu de cotizare \u0219i de cauza medical\u0103. &#8220;M\u0103sura urmeaz\u0103 s\u0103 se aplice \u00eencep\u00e2nd cu 1 februarie 2026, ceea ce reclam\u0103 o interven\u021bie prompt\u0103 a institu\u021biei Avocatului Poporului pentru a preveni producerea de efecte ireversibile asupra s\u0103n\u0103t\u0103\u021bii lucr\u0103torilor&#8221;, consider\u0103 CNSLR Fr\u0103\u021bia.<\/p>\n<p>Potrivit sursei citate, neconstitu\u021bionalitatea se refer\u0103, mai \u00eent\u00e2i, la \u00eenc\u0103lcarea art. 115 alin. (4) din Constitu\u021bie (lipsa unei situa\u021bii extraordinare \u0219i a urgen\u021bei reale).<\/p>\n<p>Astfel, articolul specificat arat\u0103 c\u0103 ordonan\u021bele de urgen\u021b\u0103 pot fi adoptate numai \u00een situa\u021bii extraordinare a c\u0103ror reglementare nu poate fi am\u00e2nat\u0103, cu obliga\u021bia de motivare a urgen\u021bei \u00een cuprinsul actului. Curtea Constitu\u021bional\u0103 a statuat constant c\u0103 sunt condi\u021bii cumulative: existen\u021ba unei situa\u021bii extraordinare, imposibilitatea am\u00e2n\u0103rii reglement\u0103rii \u0219i motivarea urgen\u021bei \u00een preambul.<\/p>\n<p>\u00cen preambulul OUG nr. 91\/2025, Guvernul invoc\u0103 \u00een principal considerente de eficientizare bugetar\u0103 \u0219i de organizare a fluxurilor financiare. Ori, ra\u021biunile de oportunitate \u0219i gestiune bugetar\u0103 nu echivaleaz\u0103, \u00een sine, cu o &#8220;situa\u021bie extraordinar\u0103&#8221;\u00a0\u00een sens constitu\u021bional, care trebuie s\u0103 fie obiectiv\u0103 \u0219i s\u0103 impun\u0103 o interven\u021bie imediat\u0103. Mai mult, m\u0103sura contestat\u0103 nu produce efecte imediat: actul a fost publicat la 31.12.2025, \u00eens\u0103 aplicarea art. II alin. (1) \u00eencepe la 1.02.2026. Acest decalaj infirm\u0103 caracterul de &#8216;reglementare care nu poate fi am\u00e2nat\u0103&#8217; \u0219i demonstreaz\u0103 c\u0103 interven\u021bia putea urma procedura legislativ\u0103 ordinar\u0103, cu dezbatere parlamentar\u0103 \u0219i consultare a partenerilor sociali.<\/p>\n<p>\u00cen viziunea juri\u0219tilor CNSLR Fr\u0103\u021bia, neconstitu\u021bionalitatea se refer\u0103 \u0219i la \u00eenc\u0103lcarea art. 115 alin. (6) din Constitu\u021bie (ordonan\u021ba de urgen\u021b\u0103 afecteaz\u0103 drepturi fundamentale).<\/p>\n<p>Astfel, articolul citat interzice ordonan\u021belor de urgen\u021b\u0103 s\u0103 afecteze drepturile, libert\u0103\u021bile \u0219i \u00eendatoririle prev\u0103zute de Constitu\u021bie. CCR a interpretat no\u021biunea de &#8220;a afecta&#8221;\u00a0ca av\u00e2nd sens juridic de: &#8220;a suprima&#8221;, &#8220;a aduce atingere&#8221;, &#8220;a prejudicia&#8221;, &#8220;a v\u0103t\u0103ma&#8221;, &#8220;a leza&#8221;, a\u00a0antrena consecin\u021be negative&#8221;. Art. II alin. (1) din OUG nr. 91\/2025 suprim\u0103 presta\u021bia aferent\u0103 primei zile de risc asigurat \u0219i antreneaz\u0103 consecin\u021be negative certe pentru asigura\u021bi. \u00cen consecin\u021b\u0103, actul normativ afecteaz\u0103 drepturi fundamentale \u0219i este interzis a fi adoptat pe calea ordonan\u021bei de urgen\u021b\u0103.<\/p>\n<p>Sindicali\u0219tii sus\u021bin \u0219i c\u0103 se \u00eencalc\u0103 art. 47 alin. (2), art. 34 alin. (1) \u0219i art. 41 (alin. 2) din Constitu\u021bie (protec\u021bia social\u0103, ocrotirea s\u0103n\u0103t\u0103\u021bii \u0219i protec\u021bia social\u0103 a muncii).<\/p>\n<p>Indemniza\u021biile pentru incapacitate temporar\u0103 de munc\u0103 sunt presta\u021bii de asigur\u0103ri sociale de s\u0103n\u0103tate \u0219i instrumente de protec\u021bie social\u0103 a muncii, destinate acoperirii pierderii de venit cauzate de boal\u0103 \u0219i prevenirii agrav\u0103rii st\u0103rii de s\u0103n\u0103tate\/riscurilor la locul de munc\u0103. Reducerea cu o zi a indemniza\u021biei afecteaz\u0103 dreptul la m\u0103suri de asigur\u0103ri sociale \u0219i diminueaz\u0103 protec\u021bia social\u0103 a muncii, \u00eentr-un moment de vulnerabilitate. \u00cen plus, prin stimularea prezent\u0103rii la munc\u0103 \u00een stare de boal\u0103 sau am\u00e2narea consultului, m\u0103sura interfereaz\u0103 cu obliga\u021bia statului de a asigura ocrotirea s\u0103n\u0103t\u0103\u021bii.<\/p>\n<p>Literatura de specialitate arat\u0103 c\u0103 reducerea\/condi\u021bionarea pl\u0103\u021bii concediului medical poate diminua unele absen\u021be, dar poate cre\u0219te &#8220;sickness presenteeism&#8221;\u00a0(prezentarea la munc\u0103 \u00een stare de boal\u0103), inclusiv &#8216;contagious presenteeism&#8217;, cu efecte externe negative (infectarea colegilor, cre\u0219terea \u00eemboln\u0103virilor), se mai arat\u0103 \u00een motivarea sesiz\u0103rii.<\/p>\n<p>Conform confedera\u021biei, studii economice \u0219i de s\u0103n\u0103tate public\u0103 indic\u0103 faptul c\u0103 accesul la concediu medical pl\u0103tit este asociat cu sc\u0103derea ratelor de \u00eemboln\u0103viri la nivel popula\u021bional, \u00een special pentru afec\u021biuni de tip gripal, iar introducerea unor perioade de a\u0219teptare poate deplasa comportamentul c\u0103tre munc\u0103 \u00een stare de boal\u0103, cu consecin\u021be asupra productivit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii.<\/p>\n<p>Prin urmare, m\u0103sura contestat\u0103 nu este doar o &#8220;ajustare bugetar\u0103&#8221;, ci produce un efect normativ asupra comportamentelor de s\u0103n\u0103tate: descurajeaz\u0103 utilizarea concediului medical \u00een primele 24 de ore, tocmai c\u00e2nd izolarea \u0219i recuperarea precoce sunt esen\u021biale, sus\u021bin sindicali\u0219tii. Aceste considerente \u00eent\u0103resc testul de propor\u021bionalitate (art. 53) \u0219i obliga\u021bia statului de ocrotire a s\u0103n\u0103t\u0103\u021bii (art. 34), inclusiv din perspectiva s\u0103n\u0103t\u0103\u021bii publice.<\/p>\n<p>\u00cen sesizare, sindicali\u0219tii men\u021bioneaz\u0103 c\u0103 se \u00eencalc\u0103 \u0219i alte dispozi\u021bii legislative, cum ar fi: \u00eenc\u0103lcarea art. 53 din Constitu\u021bie (restr\u00e2ngere nejustificat\u0103 \u0219i dispropor\u021bionat\u0103); \u00eenc\u0103lcarea art. 44 din Constitu\u021bie \u0219i a art. 1 din Protocolul nr. 1 la CEDO (protec\u021bia patrimonial\u0103 a crean\u021belor de asigur\u0103ri sociale); jurispruden\u021ba Cur\u021bii Europene a Drepturilor Omului (A1P1 \u0219i art. 14).<\/p>\n<p>CNSLR Fr\u0103\u021bia sus\u021bine, \u00een concluzie, c\u0103 m\u0103sura prev\u0103zut\u0103 de art. II alin.
