Concret, fosta \u0219ef\u0103 a ICCJ sus\u021bine c\u0103 motivarea con\u021bine prevederi formulate ca \u0219i cum decizia ar fi fost de admitere a excep\u021biei de neconstitu\u021bionalitate, nu de respingere.<\/strong><\/p>\n<p data-index=\"2\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-527446\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2024\/09\/jnc9odawjmhhc2g9mmm5odu3ogu2yty0mwezzjgwnddjoti5ytiymdu2yza-thumb_.jpg\" width=\"800\" height=\"533\" data-skip-htmlfix=\"1\" title=\"jnc9odawjmhhc2g9mmm5odu3ogu2yty0mwezzjgwnddjoti5ytiymdu2yza-thumb_\"><\/p>\n<p data-index=\"3\"><span>\u00ab<\/span>Chiar dac\u0103 afirm\u0103 \u00een mod corect c\u0103 nu este competent\u0103 s\u0103 controleze pretinsa lips\u0103 de coeren\u021b\u0103 legislativ\u0103, Curtea constat\u0103 existen\u021ba unei \u201econtrariet\u0103\u021bi\u201d, stabilind obliga\u021bia Parlamentului \u0219i Consiliului Legislativ de a \u201eunifica legisla\u021bia\u201d \u00een materie<span>\u00bb<\/span><span>, argumenteaz\u0103 fosta \u0219ef\u0103 a \u00cenaltei Cur\u021bi de Casa\u021bie \u0219i Justi\u021bie.<\/span><\/p>\n<p data-index=\"4\"><span>Stanciu atrage aten\u021bia \u0219i c\u0103, un paragraf mai jos \u00een motivare, Curtea stabile\u0219te obliga\u021bia Parlamentului de a realiza \u201eo corelare necesar\u0103 \u00eentre condi\u021biile de acces \u00een func\u021bia de membru al Guvernului \u0219i cea de membru al Parlamentului\u201d.<\/span><\/p>\n<p data-index=\"5\">\u201e<span><strong>Or, astfel de considerente nu sus\u021bin dispozitivul de inadmisibilitate, ci ar fi sus\u021binut o eventual\u0103 decizie de admitere a excep\u021biei de neconstitu\u021bionalitate.<\/strong> Numai \u00een situa\u021bia \u00een care, declar\u00e2ndu-se competent\u0103, Curtea ar fi constatat o incoeren\u021b\u0103 legislativ\u0103 contrar\u0103 normelor constitu\u021bionale, a\u0219adar ar fi constatat o \u00eenc\u0103lcare a Constitu\u021biei, ar fi putut re\u021bine obliga\u021bia autorit\u0103\u021bilor men\u021bionate, impus\u0103 de art.147 alin.(4) din Constitu\u021bie (iar nu de Curtea Constitu\u021bional\u0103), de a pune \u00een acord normele neconstitu\u021bionale cu prevederile Legii fundamentale \u00een sensul precizat de Curte. Ca urmare, aceste considerente nu ar fi trebuit s\u0103 se regaseasc\u0103, \u00een aceast\u0103 redactare, \u00een prezenta decizie. <strong>Curtea nu poate impune obliga\u021bii unor autorit\u0103\u021bi publice c\u00e2t\u0103 vreme ea \u00eens\u0103\u0219i, \u00een cuprinsul aceleia\u0219i decizii, a constatat c\u0103 nu este competent\u0103 s\u0103 o fac\u0103<\/strong>\u201d, argumenteaz\u0103 Livia Stanciu.<\/span><\/p>\n<p data-index=\"6\"><span>\u00cen plus, \u00een ceea ce prive\u0219te sintagma criticat\u0103 de Avocatul Poporului \u0219i <a href=\"https:\/\/www.digi24.ro\/stiri\/actualitate\/justitie\/ccr-cand-inceteaza-interdictia-ca-persoanele-condamnate-sa-faca-parte-din-guvern-746470\" data-skip-linkfix=\"1\">interpretat\u0103 de CCR<\/a>, Livia Stanciu spune c\u0103 CCR nu ar fi trebuit s\u0103 includ\u0103 aceast\u0103 interpretare obligatorie \u00een motivare, din moment ce decizia a fost de respingere a sesiz\u0103rii Avocatului Poporului.<\/span><\/p>\n<p data-index=\"7\"><span>\u00ab<\/span><span>Curtea realizeaz\u0103 interpretarea obligatorie a normei criticate, cu raportare la art. 4, art. 152 alin. (1) \u0219i, respectiv art. 165-171 din Codul penal, conchiz\u00e2nd c\u0103 sintagma \u201enu au suferit condamn\u0103ri penale\u201d \u00eenceteaz\u0103 s\u0103 mai constituie o interdic\u021bie la dob\u00e2ndirea calit\u0103\u021bii de membru al Guvernului \u00een ceea ce prive\u0219te persoanele care cad sub inciden\u021ba\/sunt beneficiare ale unei legi de dezincriminare sau de amnistie sau care au fost reabilitate printr-o hot\u0103r\u00e2re judec\u0103toreasc\u0103 definitiv\u0103, persoane cu privire la care condamnarea penal\u0103 \u00eenceteaz\u0103 s\u0103 mai produc\u0103 efectele extrapenale prev\u0103zute de lege.\u201d Mai mult, Curtea subliniaz\u0103 c\u0103 orice alt\u0103 interpretare data sintagmei \u00een cauz\u0103 \u201ear fi contrar\u0103 literei \u0219i spiritului Constitu\u021biei\u201d (paragraf 37), realiz\u00e2nd \u00een continuare un veritabil test de propor\u021bionalitate (paragraf 38) menit s\u0103 sus\u021bin\u0103 neconstitu\u021bionalitatea sintagmei criticate<\/span><span>\u00bb, argumenteaz\u0103 judec\u0103torul CCR \u00een opinia concurent\u0103.<\/span><\/p>\n<p data-index=\"8\"><span>Livia Stanciu mai arat\u0103 c\u0103, \u00een opinia sa, nu se poate vorbi nici de o lips\u0103 de coeren\u021b\u0103 legislativ\u0103, nici de o norm\u0103 lipsit\u0103 de claritate \u00een ceea ce prive\u0219te prevederea criticat\u0103. Fosta \u0219ef\u0103 a ICCJ sus\u021bine c\u0103 autorit\u0103\u021bile chemate s\u0103 interpreteze \u0219i s\u0103 aplice sintagma criticat\u0103 \u201etrebuie s\u0103 aib\u0103 \u00een vedere ra\u021biunea reglement\u0103rii, \u0219i anume <strong>asigurarea integrit\u0103\u021bii persoanei care ocup\u0103 func\u021bia de membru al Guvernului, nevoia de a asigura protec\u021bia prestigiului func\u021biei de demnitate public\u0103<\/strong>, \u00een considerarea specificului acestei func\u021bii, diferit\u0103 de cele de demnitate public\u0103 alese\u201d. <\/span><\/p>\n<p data-index=\"9\">\u201e<span><strong>Or, s\u0103v\u00e2r\u0219irea unei fapte penale pentru care exist\u0103 sau a existat o condamnare definitiv\u0103 plaseaz\u0103 prin ea \u00eens\u0103\u0219i persoana \u00een cauz\u0103 \u00een afara cadrului legal de exercitare a func\u021biei, descalific\u00e2nd-o pe aceasta din punct de vedere legal \u0219i moral pentru ocuparea unei astfel de demnit\u0103\u021bi<\/strong>\u201d, argumenteaz\u0103 Stanciu, invoc\u00e2nd dou\u0103 decizii anterioare ale CCR (nr. 536\/2016 \u0219i 654\/2016).<\/span><\/p>\n<p data-index=\"10\"><span>Din aceast\u0103 perspectiv\u0103, <strong>Stanciu consider\u0103 c\u0103 nu are relevan\u021b\u0103 distinc\u021bia f\u0103cut\u0103 cu privire la forma de vinov\u0103\u021bie cu care a fost s\u0103v\u00e2r\u0219it\u0103 infrac\u021biunea, iar prezum\u021bia de bun\u0103 credin\u021b\u0103 \u0219i de loialitate a fost \u201epractic desfiin\u021bat\u0103 ca efect al hot\u0103r\u00e2rii de condamnare\u201d<\/strong>.<\/span><\/p>\n<p data-index=\"11\">\u201e<span>A\u0219a \u00eenc\u00e2t, indiferent dac\u0103 o astfel de persoan\u0103 a fost reabilitat\u0103, nu i se mai poate \u00eencredin\u021ba exerci\u021biul autorit\u0103\u021bii publice\u201d, concluzioneaz\u0103 fosta \u0219ef\u0103 a ICCJ.<\/span><\/p>\n<p data-index=\"12\"><span>Similar, \u00een privin\u021ba reabilit\u0103rii, Stanciu arat\u0103 c\u0103 at\u00e2t reabilitarea de drept, c\u00e2t \u0219i cea judec\u0103toreasc\u0103 \u201enu \u0219terge condamnarea\u201d. \u201eReabilitarea, ca \u0219i amnistia, prescrip\u021bia \u0219i alte cauze care \u00eenl\u0103tur\u0103 aplicarea, executarea \u0219i consecin\u021bele pedepsei, reprezint\u0103 o renun\u021bare din partea societ\u0103\u021bii (statului) &#8211; pentru ra\u021biuni conforme scopului represiunii &#8211; la m\u0103surile de precau\u021bie luate fa\u021b\u0103 de fostul condamnat. <strong>Aceasta nu \u00eenseamn\u0103 \u00eens\u0103 \u0219i \u00eendrept\u0103\u021birea de a ocupa func\u021bii de demnitate public\u0103, unde exigen\u021bele de integritate trebuie aplicate \u00een cel mai \u00eenalt grad<\/strong>\u201d, scrie judec\u0103torul CCR \u00een opinia concurent\u0103.<\/span><\/p>\n<h5>Cite\u0219te \u0219i:\u00a0CCR: <a href=\"https:\/\/www.digi24.ro\/stiri\/actualitate\/justitie\/ccr-cand-inceteaza-interdictia-ca-persoanele-condamnate-sa-faca-parte-din-guvern-746470\" data-skip-linkfix=\"1\">C\u00e2nd \u00eenceteaz\u0103 interdic\u021bia ca persoanele condamnate s\u0103 fac\u0103 parte din Guvern<\/a><\/h5>\n<h5><a href=\"https:\/\/www.digi24.ro\/stiri\/actualitate\/justitie\/cei-trei-judecatori-ccr-care-ar-fi-permis-condamnatilor-penal-sa-fie-ministri-746503\" data-skip-linkfix=\"1\">Cei trei judec\u0103tori CCR care ar fi permis condamna\u021bilor penal s\u0103 fie mini\u0219tri<\/a><\/h5>\n<\/div>\n<p> Source URL: https:\/\/www.digi24.ro\/stiri\/actualitate\/politica\/opinie-livia-stanciu-interferenta-nepermisa-a-ccr-in-competentele-altor-autoritati-746527<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00centr-o opinie concurent\u0103, judec\u0103torul Livia Stanciu arat\u0103 c\u0103 CCR \u0219i-a dep\u0103\u0219it competen\u021bele \u00een redactarea motiv\u0103rii deciziei din 4 mai referitoare la interdic\u021bia ca persoanele condamnate s\u0103 fac\u0103 parte din Guvern (legea care l-a \u00eempiedicat pe Liviu Dragnea s\u0103 pretind\u0103 func\u021bia de premier).
