De\u0219i \u00een momentul de fa\u021b\u0103 nu mai activeaz\u0103 \u00een magistratur\u0103, informa\u021bia este una de interes, av\u00e2nd in vedere ca Daniela Panioglu este prezentat\u0103 de presa de propagand\u0103 #rezist-USR \u0219i guvernamental\u0103 drept un avertizor de integritate \u0219i un personaj care se lupt\u0103 pentru salvarea Justi\u021biei. <\/span><\/span><\/span><\/p>\n<hr>\n<p>\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span><b><span lang=\"ro-RO\">Panioglu a fost ac\u021bionat\u0103 \u00een instan\u021b\u0103 de Asocia\u021bia de Proprietari nr. 190 din Gala\u021bi (al\u0103turi de Lauren\u021biu Panioglu, probabil fratele ei), dup\u0103 ce nu a mai pl\u0103tit \u00eentre\u021binerea timp de aproximativ trei ani. Mai exact, \u00een perioada octombrie 2016-septembrie 2019. <\/span><\/b><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><span lang=\"ro-RO\">Litigiul a fost solu\u021bionat de Judec\u0103toria Sectorului 4 Bucure\u0219ti dupa trei ani de proces (2021-2024). Prin <\/span><span lang=\"ro-RO\"><b>Sentin\u021ba nr. 16277 din 26 septembrie 2024<\/b><\/span><span lang=\"ro-RO\">, pronun\u021bat\u0103 \u00een <\/span><span><span lang=\"ro-RO\"><b>dosarul 24135\/233\/2019<\/b><\/span><\/span><span lang=\"ro-RO\">, <\/span><span lang=\"ro-RO\"><b><span>judec\u0103toarea M\u0103d\u0103lina-Gabriela Fechete de la Judec\u0103toria Sectorului 4 a dispus obligarea judec\u0103toarei Daniela Panioglu la plata a 3422,63 lei, dintre care 2.119,46 lei reprezint\u0103 cotele de \u00eentre\u021binere restan\u021be, iar 1.303,17 lei reprezent\u00e2nd penalit\u0103\u021bi de \u00eent\u00e2rziere<\/span><\/b><\/span><span lang=\"ro-RO\">.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><span lang=\"ro-RO\">Sentin\u021ba Judec\u0103toriei Sectorului 4 a fost atacat\u0103 cu apel la Tribunalul Bucure\u0219ti de Daniela Panioglu. La termenul din 29 mai 2025 Tribunalul Bucure\u0219ti a suspendat judecarea cauzei din cauza lipsei p\u0103r\u021bilor, stabilind urm\u0103torul termen pentru 26 februarie 2026.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\">\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span><b><span lang=\"ro-RO\">Ap\u0103rarea lui Panioglu<\/span><\/b><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><br \/><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><span lang=\"ro-RO\">\u00cen instan\u021b\u0103, judec\u0103toarea Daniela Panioglu a dat vina pe administratorul blocului. Astfel, Panioglu a precizat ca a refuzat s\u0103 mai achite cotele de \u00eentre\u021binere pe motiv c\u0103 acestea ar fi prea mari pentru un apartament \u00een care nu mai locuie\u0219te nimeni, de c\u00e2nd mama sa a decedat. <\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><span lang=\"ro-RO\">De asemenea, Panioglu a sus\u021binut c\u0103 administratorul ar fi refuzat s\u0103 \u00eei prezinte documentele justificative pentru o serie de cheltuieli comune. <\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span><span><span lang=\"ro-RO\">O alt\u0103 nemul\u021bumire a fostei judec\u0103toare a privit modul \u00een care s-a hot\u0103r\u00e2t schimbarea u\u0219ii de la intrarea \u00een scar\u0103 \u0219i desemnarea c\u00e2\u015ftig\u0103torului.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\">\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span><b><span lang=\"ro-RO\">Panioglu avea bani s\u0103 pl\u0103teasc\u0103 \u00eentre\u021binerea<\/span><\/b><\/span><\/span><\/p>\n<p align=\"JUSTIFY\">\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span><span lang=\"ro-RO\">\u00cen final trebuie spus c\u0103 \u00een cei trei ani \u00een care nu a mai pl\u0103tit \u00eentre\u021binerea la apartamentul din Gala\u021bi (2016-2019), judec\u0103toarea Daniela Panioglu era \u00een activitate, fiind suspendat\u0103 din func\u021bie pentru prima dat\u0103 in decembrie 2022 (suspendare ca urmare pan\u0103 la solu\u021bionarea recursului \u00eempotriva deciziei de excludere din magistratur\u0103). A\u0219adar nu exist\u0103 varianta ca Panioglu s\u0103 nu fi avut bani pentru a achita \u00eentre\u021binerea, ba dimpotriv\u0103 aceasta \u00eencasa lun\u0103 de lun\u0103 c\u00e2teva mii de euro.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\">\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span><b><span lang=\"ro-RO\">Red\u0103m un fragment din sentin\u021ba Judec\u0103toriei Sectorului 4 (documentul este ata\u0219at integral la finalul articolului):<\/span><\/b><\/span><\/span><\/p>\n<p align=\"JUSTIFY\">\u00a0<\/p>\n<p align=\"JUSTIFY\"><img loading=\"lazy\" decoding=\"async\" height=\"779\" width=\"700\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2026\/01\/panioglu_js4.jpg\" title=\"panioglu_js4\"><\/p>\n<p align=\"JUSTIFY\">\u00a0<\/p>\n<p align=\"JUSTIFY\"><span><span><i>\u201ePrin cererea \u00eenregistrat\u0103 pe rolul Judec\u0103toriei ###### la data de 06.12.2019 sub nr. #####\/233\/2019, <span><b>reclamanta Asocia\u021bia de Proprietari nr. 190 a solicitat, \u00een contradictoriu cu p\u00e2r\u00e2\u021bii <\/b><span lang=\"ro-RO\"><b>Panioglu<\/b><\/span><span lang=\"ro-RO\"><b>Daniela<\/b><\/span><b> \u0219i <\/b><span lang=\"ro-RO\"><b>Panioglu<\/b><\/span><span lang=\"ro-RO\"><b>Lauren\u021biu<\/b><\/span><\/span> ca prin hot\u0103r\u00e2rea ce se va pronun\u021ba <b><span>s\u0103 fie obliga\u021bi p\u00e2r\u00e2\u021bii la plata sumei de 2119,46 lei cu titlu de contribu\u021bii restante la cheltuielile de \u00eentre\u021binere \u0219i 1303,17 lei cu titlu de penalit\u0103\u021bi de \u00eent\u00e2rziere<\/span><\/b>. Reclamanta a solicitat \u0219i obligarea p\u00e2r\u00e2\u021bilor la plata cheltuielilor de judecat\u0103. <\/i><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><i><span><span>\u00cen fapt, reclamanta a ar\u0103tat c\u0103,<b><span>p\u00e2r\u00e2\u021bii, proprietarii apartamentul nr.34 situat \u00een ######, ### ##, str. #### ##### nr. 5 au r\u0103mas cu rea credin\u021b\u0103 restan\u021bi la plata cheltuielilor de \u00eentre\u021binere pe perioada octombrie 2016 &#8211; septembrie 2019 cu suma de 2119,46 lei sold restant si 1303,17 lei penalit\u0103\u021bi de \u00eent\u00e2rziere pe aceia\u0219i perioada, ceea ce a facut ca prin aceasta comportare s\u0103 aduca un prejudiciu asocia\u021biei consistent, dar \u0219i o atingere a regulilor impuse de lege<\/span><\/b>. \u00cen drept, a fost \u00eentemeiat\u0103 pe dispozi\u021biile art. 1349, art. 1522, art. 1523, art. 1528 Cod civil \u0219i art. 49 \u0219i 50 din Legea nr. 230\/2007. \u00cen proba\u0163iune, reclamanta a solicitat \u00eencuviin\u021barea probei cu \u00eenscrisuri. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>P\u00e2r\u00e2ta ######### ####### a depus la data de 22.03.2021 \u00eent\u00e2mpinare (filele 145-146 dosar Judec\u0103toria ######), prin care a solicitat respingerea cererii, ca ne\u00eentemeiat\u0103. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>\u00cen fapt, p\u00e2r\u00e2ta a sus\u021binut c\u0103 neplata cotelor de \u00eentre\u021binere nu a fost cauzat\u0103 de reaua sa credin\u021b\u0103, ci de modul defectuos \u00een care condominiul este administrat \u0219i de atitudinea administratorului, care nu a fost \u00een m\u0103sur\u0103 s\u0103-i prezinte documente justificative pentru anumite cheltuieli comune. <\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>Mai precis, p\u00e2r\u00e2ta a ar\u0103tat c\u0103, \u00een apartament nu mai locuie\u0219te nimeni din data de 29.07.2015, de c\u00e2nd a decedat masa sa, proprietar\u0103 \u0219i, a achitat cotele de \u00eentre\u021binere p\u00e2n\u0103 la un moment dat, c\u00e2nd acestea i s-au p\u0103rut nejustificat de mari, \u00een condi\u021biile \u00een care acolo nu locuie\u0219te nimeni. <\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>Astfel, p\u00e2r\u00e2ta a \u00eenvederat c\u0103, i-a solicitat administratorului s\u0103 \u00eei justifice cuantumul ridicat al cotelor de intretinere si a formulat contestatie la lista de \u00eentretinere afi\u0219ate, la care a primit un r\u0103spuns evaziv, practic o reluare a sumelor solicitate cu titlu de cote de \u00eentretinere, f\u0103r\u0103 alte explica\u021bii \u0219i acte doveditoare. <\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>Ulterior, i-a solicitat administratorului procesul-verbal al adun\u0103rii generale a proprietarilor, prin care s-a hot\u0103r\u00e2t schimbarea u\u0219ii de la intrarea \u00een scar\u0103, cu ofertele de pre\u021b \u0219i desemnarea c\u00e2\u015ftig\u0103torului. Cu acea ocazie, a constatat c\u0103 administratorul nu de\u021bine niciun fel de document reglementat de lege, prezent\u00e2ndu-i simple foi volante care con\u021bineau calcule, de unde reie\u0219ea c\u0103 sumele pe care le stabilea aveau un caracter arbitrar. <\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>A mai constatat c\u0103 exist\u0103 diferen\u021be \u00eentre cuantumul sumelor trecute pe listele de \u00eentre\u021binere afi\u0219ate \u0219i cuantumul sumelor men\u021bionate \u00een listele de \u00eentre\u0163inere pe care reclamantul le-a depus la dosar. Spre exemplu, luna ianuarie a anului 2019 con\u021bine, \u00een ansamblu, date diferite fa\u021b\u0103 de lista de \u00eentretinere afi\u0219at\u0103, fiind modificate rubricile \u201etotal acoperi\u0219&#8221;, \u201epenalit\u0103\u021bi de \u00eent\u00e2rziere&#8221; \u0219i \u201etotalul de plat\u0103&#8221;. P\u00e2r\u00e2ta a mai ar\u0103tat c\u0103, \u00een anul 2016 i-a solicitat administratorului documente justificative pentru u\u0219a din termopan montat\u0103 la intrarea \u00een ##### ### acesta din urm\u0103, abia 3 ani mai t\u00e2rziu le-a solicitat proprietarilor s\u0103 semneze un proces-verbal antedatat cu privire la aceasta, anterior introducerii prezentei cereri. <\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>P\u00e2r\u00e2ta a sus\u021binut c\u0103 administratorul nu a respectat niciodat\u0103 procedura legal\u0103 prev\u0103zut\u0103 de art. 49 din Legea nr. 196\/2018, lu\u00e2nd, \u00een mod unilateral, toate deciziile privind lucr\u0103rile efectuate \u00een condominiu, \u00een condi\u021biile \u00een care atribu\u021biile sale se limiteaz\u0103 la punerea \u00een executare a hot\u0103r\u00e2rilor luate de adunarea general\u0103 a proprietarilor.<\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>\u00cen ceea ce prive\u0219te penalit\u0103\u021bile de \u00eent\u00e2rziere, a invocat nulitatea procesului-verbal nr. 1.625\/28.XII.2010, prin care s-a stabilit cuantumul penalita\u021bilor de \u00eent\u00e2rziere, av\u00e2nd \u00een vedere c\u0103 dintre cei 3 membri ai Comitetului Executiv, lipsesc semn\u0103turile pre\u0219edintelui ###### ##### \u0219i a membrului ######## ########, semn\u00e2nd doar vicepre\u0219edintele ##### ######. Ca atare, a ar\u0103tat c\u0103, acest \u00eenscris nu poate s\u0103 aib\u0103 nicio valoare juridic\u0103 \u0219i, prin urmare, nu poate constitui fundament al oblig\u0103rii sale la plata de penalit\u0103\u021bi de \u00eent\u00e2rziere, \u00een condi\u021biile \u00een care hot\u0103r\u00e2rea a fost luat\u0103 doar de vicepre\u015fedintele asocia\u021biei de proprietari. <\/b><\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>\u00cent\u00e2mpinarea nu a fost motivat\u0103 \u00een drept. \u00cen proba\u0163iune, a solicitat \u00eencuviin\u021barea probei cu \u00eenscrisuri, proba testimonial \u0219i expertiza tehnic\u0103 judiciar\u0103 contabil\u0103. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>Prin sentin\u021ba civil\u0103 nr. ####\/06.05.2021 pronun\u021bat\u0103 de Judec\u0103toria ######, Sec\u021bia Civil\u0103, instan\u021ba a admis excep\u021bia necompeten\u021bei teritoriale, invocate de p\u00e2r\u00e2t\u0103 prin \u00eent\u00e2mpinare \u0219i a declinat competen\u021ba de solu\u021bionare a cauzei \u00een favoarea Judec\u0103toriei Sectorului 4 Bucure\u0219ti (fila 158 dosar Judec\u0103toria ######). <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>Dosarul a fost \u00eenregistrat sub acela\u0219i nr. #####\/233\/2019 pe rolul Judec\u0103toriei Sectorului 4 Bucure\u0219ti la data de 18.05.2021. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>La termenul din data de 09.12.2021, instan\u021ba a calificat cererea p\u00e2r\u00e2\u021bilor cu privire la nulitatea procesului-verbal \u00eentocmit cu ocazia Adun\u0103rii Generale nr. 1.625\/12.08.2018 ca fiind cerere reconven\u021bional\u0103 (fila 26). Prin \u00eenscrisul de la fila 23, p\u00e2r\u00e2ta a ar\u0103tat c\u0103 este vorba de procesul-verbal nr. 1625\/12.08.2010. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>Cererea reconven\u021bional\u0103 a fost legal timbrat\u0103 cu 100 de lei, potrivit dovezii de la fila 34. \u00cen cauz\u0103, instan\u021ba a \u00eencuviin\u021bat \u0219i administrat proba cu \u00eenscrisuri, precum \u0219i proba cu expertiza contabil\u0103 prin comisie rogatorie. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>Raportul de expertiz\u0103 \u00eentocmit de c\u0103tre expert ###### ####### a fost depus la filele 88-95 \u00een volumul I al dosarului Judec\u0103toriei Sectorului 4. \u00cempotriva acestui raport au formulat obiec\u021biuni p\u00e2r\u00e2\u021bii (filele 99-103 dosar Judec\u0103toria Sectorului 4). \u00centruc\u00e2t s-a constatat imposibilitatea expertului de a formula r\u0103spuns la obiec\u021biunile formulate, \u00een cauz\u0103 s-a dispus efectuarea unei noi expertize contabile (filele ) La termenul din data de 12.09.2024, instan\u021ba, constat\u00e2nd c\u0103 p\u00e2r\u00e2\u021bii nu au achitat onorariul de expert \u015fi a dispus dec\u0103derea acestora din proba cu expertiza contabil\u0103. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>Analiz\u00e2nd materialul probator administrat, instan\u021ba re\u021bine urm\u0103toarele:<\/b> \u00cen fapt, imobilul apartament situat \u00een ######, pe #### #### ##### ### # ### ## ### # ### # ##. 34 a fost proprietatea numi\u021bilor ######## ##### \u0219i ######, fiind dob\u00e2ndit prin contractul de v\u00e2nzare-cump\u0103rare cu plata \u00een rate nr. 30.930\/1992 (f. 84-85 dosar Judec\u0103toria ######). Potrivit certificatului de atestare fiscal\u0103 nr. 1762876 din data de 29.09.2020 eliberat de c\u0103tre Prim\u0103ria Municipiului ######, p\u00e2r\u00e2\u021bii figureaz\u0103 \u00een eviden\u021b\u0103 fiscal\u0103 cu apartamentul din #### #### ##### ### # ### ## ##. 34 (fila 102 dosar Judec\u0103toria ######). Imobilul nu figureaz\u0103 \u00eenscris \u00een cartea funciar\u0103, potrivit adresei OCPI de la fila 76 din dosarul Judec\u0103toriei #######. Prin procesul-verbal nr. 1\/17.01.2009 s-a votat constituirea Asocia\u021biei de Proprietari nr. 190 \u0219i s-a ales comitetul executiv \u0219i comisia de cenzori (f.16-17 dosar Judec\u0103toria ######). Reclamanta Asocia\u021bia de proprietari nr.190 a dob\u00e2ndit personalitate juridic\u0103 prin \u00cencheierea din data de 10.04.2009 pronun\u021bat\u0103 de Judec\u0103toria ###### \u00een dosarul nr. ####\/233\/2009 (f.20 dosar Judec\u0103toria #######) \u0219i are codul de \u00eenregistrare fiscal\u0103 ### ######## atribuit la data de 21.10.2010 (f.10 dosar Judec\u0103toria #######). \u00cen administrarea reclamantei se afl\u0103 \u0219i imobilul p\u00e2r\u00e2\u0163ilor. Prin procesul-verbal nr.1625\/28.12.2010 al Adun\u0103rii Generale Extraordinare a Asocia\u021biei de Proprietari nr. 190, s-a stabilit c\u0103 penalit\u0103\u021bile de \u00eent\u00e2rziere se vor calcula cu procentul de 0.15 lei%\/zi (fila 9 dosar Judec\u0103toria #######). <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span>(&#8230;)<\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><i><span><span><b>Instan\u021ba re\u021bine c\u0103, prin prezentarea listelor de plat\u0103, a fost f\u0103cut\u0103 de c\u0103tre reclamanta-p\u00e2r\u00e2t\u0103 dovada existen\u0163ei obliga\u0163iei de plat\u0103 a cotelor de \u00eentre\u0163inere \u00een sarcina p\u00e2r\u00e2\u0163ilor, iar aceasta din urm\u0103 nu a f\u0103cut dovada achit\u0103rii debitului.<\/b> Mai mult dec\u00e2t at\u00e2t, urmare a neachit\u0103rii onorariului de expert pe parcursul mai multor ani (f. 197), instan\u0163a a dispus dec\u0103derea p\u00e2r\u00e2\u0163ilor din administrarea probei cu expertiza tehnic\u0103 de specialitate. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>Prin urmare, fa\u0163\u0103 de cele re\u021binute anterior, instan\u0163a va admite solicitarea reclamantei-p\u00e2r\u00e2te de acordare a cotelor de \u00eentre\u0163inere restante pentru lunile octombrie 2016-septembrie 2019 \u015fi va dispune obligarea p\u00e2r\u00e2tului la plata cu acest titlu c\u0103tre reclamant\u0103 a sumei de 2119,46 lei, reprezent\u00e2nd cote de \u00eentre\u0163inere aferente acestor luni.<\/b><\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><i><span><span>Asupra penalit\u0103\u021bilor de \u00eent\u00e2rziere, instan\u0163a observ\u0103 c\u0103 acestea au fost stabilite prin Procesul-verbal nr. 28.12.2010 al Adun\u0103rii Generale a Asocia\u0163iei reclamante-p\u00e2r\u00e2te. Observ\u0103 instan\u0163a \u015fi c\u0103 p\u00e2r\u00e2ta-reclamant\u0103 a solicitat anularea acestui proces-verbal printr-o cerere reconven\u0163ional\u0103. Instan\u0163a va respinge, ca ne\u00eentemeiat\u0103, aceast\u0103 solicitare \u015fi va face o serie de men\u0163iuni. Astfel, observ\u0103 c\u0103 procesul-verbal este un act care a intrat \u00een circuitul civil cu aproximativ 11 ani \u00eenainte de introducerea cererii reconven\u0163ionale de c\u0103tre p\u00e2r\u00e2ta-reclamant\u0103. Prin urmare, \u00een decursul a 11 ani, acesta a produs efecte juridice, penalit\u0103\u0163ile fiind calculate potrivit acestui act, \u00een sarcina tuturor persoanelor care s-au f\u0103cut vinovate de neplata cotelor de \u00eentre\u0163inere la timp. De asemenea, mai mult dec\u00e2t at\u00e2t, instan\u0163a observ\u0103 c\u0103 exist\u0103 semn\u0103turi pe respectivul proces-verbal, singura semn\u0103tur\u0103 care ar ap\u0103rea c\u0103 nu exist\u0103 ar fi cea a membrului ######## ########. Cu toate acestea, procesul-verbal a fost \u00eensu\u015fit prin semn\u0103tur\u0103 vizibil\u0103 de majoritatea membrilor comitetului executiv, de cenzor \u015fi de administrator. Prin urmare, chiar dac\u0103 ar fi lips\u0103 semn\u0103tura membrului ######## ########, p\u00e2r\u00e2ta-reclamant\u0103 nu justific\u0103 o v\u0103t\u0103mare fundamental\u0103 a intereselor sale prin prisma lipsei respectivei semn\u0103turi, \u00een contextul \u00een care ceea ce se pune \u00een balan\u0163\u0103 este \u00eendep\u0103rtarea din circuitul juridic civil a unui act care a produs efecte o perioad\u0103 extrem de lung\u0103 de timp. Mai mult dec\u00e2t at\u00e2t, instan\u0163a observ\u0103 c\u0103 respectivul proces-verbal a fost emis \u00eenainte de intrarea \u00een vigoare a Deciziei Cur\u0163ii Constitu\u0163ionale nr. 670\/2011, iar \u00een virtutea principiului for\u0163ei obligatorii \u015fi pentru viitor a deciziilor CCR, acest proces-verbal trebuia, la momentul respectiv, contestat \u00een termenul de 45 zile prev\u0103zut de art. 26 din Legea nr. 230\/2007, care, \u00een spe\u0163\u0103, este dep\u0103\u015fit cu aproximativ 11 ani. Pe cale de consecin\u0163\u0103, instan\u0163a va respinge cererea reconven\u0163ional\u0103, ca ne\u00eentemeiat\u0103. <\/span><\/span><\/i><\/p>\n<p align=\"JUSTIFY\"><span><i><span><b>\u00cen continuare, observ\u00e2nd c\u0103 asocia\u0163ia are un sistem propriu de penalit\u0103\u0163i, instan\u021ba va admite cap\u0103tul de cerere referitor la penalit\u0103\u021bile de \u00eent\u00e2rziere \u00een sensul c\u0103 va obliga p\u00e2r\u00e2\u0163ii-reclaman\u0163i, \u00een solidar, la plata c\u0103tre reclamanta-p\u00e2r\u00e2t\u0103 a sumei de 1303,17 lei, reprezent\u00e2nd penalit\u0103\u0163i de \u00eent\u00e2rziere, aferente lunilor octombrie 2016-septembrie 2019<\/b>. <\/span><\/i><\/span><\/p>\n<p align=\"JUSTIFY\"><i><span><span>Cu privire la Asa cu nu despre asta este vorba ci de calitatea umana a personajului. Dar cand lua chirie de la stat 600 euro pe luna, desi avea casa proprietate personala in Bucuresti nu insemna ca baga in buzura bani nemeritati, si acum o face pe moralista vietii. Intr-adevar, putea contesta-n instanta lista de-ntretinere. Cu sanse ZERO. In 99% din cazuri, infractorii din asociatii sunt protejati de catre &#8220;autoritati&#8221;: Justitie &amp; MAI. Dar in special de Primarii, care-n loc a-i controla, ii spaguiesc, cand primesc sesizari.
