Este vorba despre colaborarea cu filiala rom\u00e2neasc\u0103 a firmei fran\u021buze\u0219ti de consultan\u021b\u0103 Systra SA, prin intermediul persoanei fizice autorizate pe care Dacian-Cosmin Drago\u0219 a de\u021binut-o din 15 octombrie 2016 p\u00e2n\u0103 \u00een 30 iulie 2025, la 17 zile dup\u0103 ce \u0219i-a \u00eenceput activitatea la CCR <span>(vezi facsimil 1)<\/span>.<\/b><\/span><\/span><\/p>\n<p><span><span><b><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2026\/01\/pfa_dacian_dragos-1.png\" width=\"700\" height=\"297\" title=\"pfa_dacian_dragos-1\"><\/b><\/span><\/span><\/p>\n<p><span><span><b>Or, pentru o asemenea colaborare \u2013 fie \u0219i prin intermediul unei PFA \u2013 Dacian Drago\u0219 ar fi trebuit s\u0103 de\u021bin\u0103 atestarea de avocat (\u00een sensul Legii nr. 51\/1995) sau de consilier juridic (\u00een sensul Legii nr. 514\/2003), subliniaz\u0103 Uscov.<\/b><\/span><\/span><\/p>\n<p><span><span><b>Aten\u021bie: faptul c\u0103 Dacian Drago\u0219 a prestat activit\u0103\u021bi de consultan\u021b\u0103 juridic\u0103 pentru firma francez\u0103 o spune \u00eensu\u0219i judec\u0103torul CCR, \u00een CV-ul publicat pe site-ul instan\u021bei de contencios constitu\u021bional <span>(vezi facsimil 2)<\/span>.<\/b><\/span><\/span><\/p>\n<p><span><span><b><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2026\/01\/cv_dragos.png\" width=\"700\" height=\"147\" title=\"cv_dragos\"><\/b><\/span><\/span><\/p>\n<p><span><span>De asemenea, men\u021bion\u0103m c\u0103 existen\u021ba activit\u0103\u021bii de consultan\u021b\u0103 juridic\u0103 \u00een rela\u021bia de afaceri dintre Dacian Drago\u0219 \u0219i Systra France este consemnat\u0103 at\u00e2t de c\u0103tre contractul \u00eencheiat \u00eentre PFA-ul actualului judec\u0103tor CCR \u0219i compania fran\u021buzeasc\u0103 <b><span>(vezi anexa de la finalul articolului)<\/span><\/b>, c\u00e2t \u0219i de c\u0103tre Drago\u0219 \u00eensu\u0219i, \u00een \u00eent\u00e2mpinarea depus\u0103 \u00een instan\u021b\u0103, unde juristul men\u021bioneaz\u0103 c\u0103 <b>a activat ca \u201eexpert juridic\u201d<\/b> la diverse institu\u021bii (inclusiv la Banca Mondial\u0103) \u0219i c\u0103 <b>a oefrit \u201econsultan\u021b\u0103 juridic\u0103\u201d<\/b> pentru Systra France <b><span>(vezi facsimil 3)<\/span><\/b>.\u00a0\u00a0<\/span><\/span><\/p>\n<p><span><span><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2026\/01\/intampinare_1.png\" width=\"700\" height=\"956\" title=\"intampinare_1\"><\/span><\/span><\/p>\n<p><span><span><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2026\/01\/intampinare_2.png\" width=\"700\" height=\"1087\" title=\"intampinare_2\"><\/span><\/span><\/p>\n<p><span><span><b>De aceea, Silvia Uscov d\u0103 de \u00een\u021beles c\u0103 profesorul universitar ar trebui s\u0103 r\u0103spund\u0103 penal<\/b> pentru infrac\u0163iunea de la art. 348 din Codul penal, potrivit c\u0103ruia <i>\u201eexercitarea, f\u0103r\u0103 drept, a unei profesii sau activit\u0103\u021bi pentru care legea cere autoriza\u021bie ori exercitarea acestora \u00een alte condi\u021bii dec\u00e2t cele legale, dac\u0103 legea special\u0103 prevede c\u0103 s\u0103v\u00e2r\u0219irea unor astfel de fapte se sanc\u021bioneaz\u0103 potrivit legii penale, se pedepse\u0219te cu \u00eenchisoare de la 3 luni la un an sau cu amend\u0103\u201d<\/i>.<\/span><\/span><\/p>\n<p><span><span>\u00a0<\/span><\/span><\/p>\n<p><span><span><b>CAB a r\u0103mas \u00een pronun\u021bare<\/b><\/span><\/span><\/p>\n<p><span><span>\u00a0<\/span><\/span><\/p>\n<p><span><span>\u00cencheiem, men\u021bion\u00e2nd c\u0103 avocata Uscov a depus la Curtea de Apel Bucure\u0219ti dou\u0103 ac\u021biuni separate: una privind anularea Decretului nr. 774\/2025, iar cealalt\u0103 privind suspendarea actului. <span><b>Cauza nr. 112\/2\/2026<\/b><\/span> (privind anularea) s-a format pe rolul CAB \u00een 8 ianuarie 2026, neprimind \u00eenc\u0103 primul termen. \u00cen cealalt\u0103 parte, \u00eens\u0103, <b>judec\u0103toarea CAB Olimpiea Cre\u021beanu<\/b> a r\u0103mas \u00een pronun\u021bare \u00een <b><span>dosarul nr. 8100\/2\/2025<\/span><\/b> pentru ziua de vineri, 16 ianuarie 2026.<\/span><\/span><\/p>\n<p><span><span>\u00a0<\/span><\/span><\/p>\n<p><span><span><b><img loading=\"lazy\" decoding=\"async\" height=\"225\" width=\"400\" src=\"https:\/\/analyse.optim.biz\/wp-content\/uploads\/2026\/01\/dacian_dragos.png\" title=\"dacian_dragos\">Iat\u0103 principalele pasaje din ac\u021biunea Silviei Uscov:<\/b><\/span><\/span><\/p>\n<p><span><span>\u00a0<\/span><\/span><\/p>\n<p><span><span><i>\u201ePe fond. Lipsa criteriului obiectiv al vechimii de cel pu\u021bin 18 ani \u00een activitatea juridic\u0103 sau \u00een \u00eenv\u0103\u021b\u0103m\u00e2ntul juridic superior<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Domnul profesor universitar Dacian Cosmin Drago\u0219, numit de c\u0103tre Pre\u0219edintele Rom\u00e2niei \u00een func\u021bia de judec\u0103tor al Cur\u021bii Constitu\u021bionale prin decretul din data de 8 iulie 2025, nu \u00eendepline\u0219te una dintre condi\u021biile esen\u021biale \u0219i cumulative prev\u0103zute de art. 143 din Constitu\u021bia Rom\u00e2niei \u0219i de art. 38 din Legea nr. 47\/1992 privind organizarea \u0219i func\u021bionarea Cur\u021bii Constitu\u021bionale, \u0219i anume condi\u021bia referitoare la vechimea de cel pu\u021bin 18 ani \u00een activitatea juridic\u0103 sau \u00een \u00eenv\u0103\u021b\u0103m\u00e2ntul juridic superior. (&#8230;)<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Pct. I, IV, V, VI, VII, VIII: expert juridic \u00een diverse proiecte, fie \u00een proiecte desf\u0103\u0219urate de Banca Mondial\u0103, fie \u00een arbitraje interna\u021bionale desf\u0103\u0219urate la ICSID, fie pentru un profesionist (Systra S.A. Sucursala Bucure\u0219ti)<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Dac\u0103 \u2018expert juridic\u2019 \u00een proiecte cu Banca Mondial\u0103 \u00eenseamn\u0103, \u00een fapt, prestarea de servicii juridice pe baz\u0103 de contract civil (de consultan\u021b\u0103, prest\u0103ri servicii) sau contract de proiect, f\u0103r\u0103 exercitarea unei profesii juridice reglementate (de tip avocat \/ consilier juridic) \u0219i f\u0103r\u0103 \u00eencadrare formal\u0103 \u00eentr-o func\u021bie juridic\u0103 recunoscut\u0103 de norma de vechime, atunci aceast\u0103 perioad\u0103 nu poate s\u0103 fie recunoscut\u0103 ca \u2018vechime \u00een func\u021bii de specialitate juridic\u0103\u2019, chiar dac\u0103 activitatea este eminamente juridic\u0103 (analiz\u0103 legislativ\u0103, redactare clauze, note de conformitate, suport pentru autoritate contractant\u0103 etc.). Ra\u021biunea este exact cea din jurispruden\u021b\u0103: func\u021biile nu se echivaleaz\u0103 pe criteriul \u2018atribu\u021biilor\u2019, c\u00e2nd legea cere o anumit\u0103 func\u021bie \/ profesie, iar simpla calificare de jurist nu \u2018transform\u0103\u2019 o func\u021bie de expert \/ consultant \u00eentr-una de consilier juridic. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen schimb, dac\u0103 \u00een proiectele cu Banca Mondial\u0103 activitatea a fost prestat\u0103 \u00een mod formal fie ca avocat (\u00eenscris \u00een barou, cu drept de exercitare, cu formele profesiei), fie pe post de consilier juridic (\u00eencadrat ca atare, \u00een regimul profesiei), atunci perioada poate deveni relevant\u0103 ca vechime juridic\u0103, tocmai pentru c\u0103 se ancoreaz\u0103 \u00eentr-o profesie \/ func\u021bie juridic\u0103 recunoscut\u0103. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Un exemplu practic care, de regul\u0103, \u2018trece\u2019 testul formalit\u0103\u021bii este situa\u021bia \u00een care persoana lucreaz\u0103 \u00eentr-un proiect al unei autorit\u0103\u021bi publice finan\u021bat de Banca Mondial\u0103, dar este \u00eencadrat\u0103 \u00een organigrama autorit\u0103\u021bii pe post de consilier juridic (\u0219i nu \u2018expert\u2019), cu atribu\u021bii corespunz\u0103toare \u0219i eviden\u021bierea acestei calit\u0103\u021bi \u00een documentele de munc\u0103. \u00cen oglind\u0103, un exemplu tipic care genereaz\u0103 respingere este \u2018Legal Expert \/ Key Expert\u2019 angajat pe contract de prest\u0103ri servicii, f\u0103r\u0103 calitate profesional\u0103 reglementat\u0103, chiar dac\u0103 livrabilele sunt exclusiv juridice.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen dosarele ICSID, pot exista mai multe roluri, iar diferen\u021ba juridic\u0103 relevant\u0103 (pentru \u2018vechime \u00een func\u021bii de specialitate juridic\u0103\u2019) nu este forumul (ICSID), ci calitatea profesional\u0103 \u00een care s-a prestat: avocat (counsel), consilier juridic \/ in-house counsel, expert independent (expert witness), secretar \/ tribunal assistant etc.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Dac\u0103 s-a lucrat \u00een arbitraj ICSID ca avocat (counsel) cu drept de exercitare, atunci, din perspectiva dreptului rom\u00e2n, s-ar fi aflat \u00een zona cea mai \u2018curat\u0103\u2019 a vechimii juridice: activitatea avocatului include consultan\u021b\u0103 \u0219i asisten\u021b\u0103 \/ reprezentare \u00een fa\u021ba organelor de jurisdic\u021bie, iar arbitrajul interna\u021bional este, \u00een esen\u021b\u0103, o form\u0103 de jurisdic\u021bie arbitral\u0103. Asta face ca perioada s\u0103 fie, \u00een principiu, vechime ca avocat, indiferent c\u0103 litigiul e intern, ICC \/ VIAC sau ICSID.<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Dac\u0103 s-a lucrat \u00een arbitraj ICSID ca \u2018expert juridic\u2019 f\u0103r\u0103 a avea statut de avocat (de exemplu, consultant \u00eentr-o echip\u0103, redact\u00e2nd memo, cercetare comparat\u0103, cuantificare de prejudiciu juridic, preg\u0103tire de audieri), atunci se aplic\u0103 aceea\u0219i logic\u0103 restrictiv\u0103 din jurispruden\u021ba \u00ceCCJ: nu este suficient c\u0103 munca este juridic\u0103; conteaz\u0103 \u00een ce func\u021bie \/ profesie ai prestat. \u00centr-o astfel de configura\u021bie, se refuz\u0103 recunoa\u0219terea ca \u2018func\u021bie de specialitate juridic\u0103\u2019, exact cum \u00ceCCJ a refuzat echival\u0103ri pe ideea \u2018atribu\u021bii similare\u2019 \u0219i a ar\u0103tat c\u0103 simpla licen\u021b\u0103 \u00een drept nu confer\u0103 automat vechime \u00een specialitate, dac\u0103 func\u021bia este una ocupabil\u0103 \u0219i de non-juri\u0219ti ori nu este una juridic\u0103 recunoscut\u0103 formal de norma special\u0103.<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Un exemplu clar de \u2018nu\u2019 este rolul de expert independent (expert witness) \u00een arbitraj: chiar dac\u0103 opinia e \u2018legal expert report\u2019, aceasta nu este, de regul\u0103, exercitarea unei func\u021bii \/ profesii juridice reglementate \u00een sensul vechimii cerute de o norm\u0103 intern\u0103, ci o activitate de consultan\u021b\u0103 \/ experien\u021b\u0103. Un exemplu clar de \u2018da\u2019 este rolul de counsel, dac\u0103 este exercitat \u00een cadrul profesiei de avocat, cu documentele profesionale care probeaz\u0103 calitatea \u0219i perioada.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Cea mai problematic\u0103 situa\u021bie se reg\u0103se\u0219te \u00een privin\u021ba colabor\u0103rii cu Systra S.A. France Sucursala Bucure\u0219ti.<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Contractul de prest\u0103ri servicii \u00eencheiat ca prestator de c\u0103tre PFA Drago\u0219 Cosmin Dacian \u0219i folosit ca dovad\u0103 a activit\u0103\u021bii juridice \u00een sensul art. 143 din Constitu\u021bie prevede c\u0103 presta\u021biile din contract (\u2018legal advice\u2019, \u2018legal risks\u2019, \u2018any matter relating to Romanian law\u2019, \u2018claims and counterclaims strategy\u2019, \u2018participating to court proceedings and representing the Company\u2019) se suprapun substan\u021bial cu sfera avocaturii. Nu mai vorbim de \u2018consultan\u021b\u0103 de management\u2019 \u00een sensul CAEN 7022 (n.r. \u2018Activit\u0103\u0163i de consultan\u0163\u0103 pentru afaceri \u015fi management\u2019), ci de consultan\u021b\u0103 juridic\u0103 propriu-zis\u0103 \u0219i reprezentare (at\u00e2t la nivel declarativ, c\u00e2t \u0219i contractual).<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Afirma\u021bia pe care o face \u00een cuprinsul \u00eent\u00e2mpin\u0103rii depuse \u00een dosarul nr. 8100\/2\/2025 este \u00een sensul c\u0103 acest contract este folosit ca: \u2018Expert jurist\u2026 Consultan\u021b\u0103 juridic\u0103\u2026 activitate exclusiv juridic\u0103\u2019, \u00eent\u0103rind teza c\u0103 scopul concret nu este unul mixt sau preponderent tehnic, ci unul juridic, asumat ca atare.<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Textul art. 348 Cod penal incrimineaz\u0103 exercitarea, f\u0103r\u0103 drept, a unei profesii sau activit\u0103\u021bi pentru care legea cere autoriza\u021bie ori exercitarea \u00een alte condi\u021bii dec\u00e2t cele legale, atunci c\u00e2nd legea special\u0103 prevede sanc\u021bionarea penal\u0103, cu pedeapsa \u00eenchisorii de la 3 luni la un an sau amend\u0103.<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Aplicat pe situa\u021bia noastr\u0103, \u2018profesia \/ activitatea\u2019 este avocatura (profesie reglementat\u0103), iar \u2018f\u0103r\u0103 drept\u2019 se contureaz\u0103 ca urmare a faptului c\u0103 Drago\u0219 Cosmin Dacian nici nu are calitatea de avocat, iar dac\u0103 ar fi avut-o, oricum ar fi trebuit desf\u0103\u0219urat\u0103 numai \u00een cadrul formelor de exercitare a profesiei strict reglementate de Legea 51\/1995 (avocat colaborator sau salarizat \u00een cadrul cabinetelor individuale de avocat sau societ\u0103\u021bilor profesionale \u2013 toate acestea nu se \u00eenregistreaz\u0103 la Registrul Comer\u021bului, ci la Baroul unde se desf\u0103\u0219oar\u0103 activitatea preponderent\u0103).<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Faptul c\u0103 activitatea este facturat\u0103 \/ derulat\u0103 printr-un PFA cu CAEN 7022 este un indicator suplimentar c\u0103 nu se presteaz\u0103 \u00een cadrul unei forme autorizate de exercitare a avocaturii, mai ales c\u0103 acest cod CAEN exclude exercitarea de activit\u0103\u021bi juridice \u00een mod expres.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Consilierul juridic \u2018poate s\u0103 fie numit \u00een func\u0163ie sau angajat \u00een munc\u0103\u2019, iar consilierul juridic numit are statut de func\u021bionar, iar cel angajat are statut de salariat (art. 2\u20133 Legea nr. 514\/2003). Atunci c\u00e2nd o societate vrea s\u0103 aib\u0103 \u2018juristul ei\u2019 (in-house), mecanismul legal este unul de numire \/ raport de munc\u0103, nu un contract civil de servicii cu un PFA.<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>Prin urmare, dac\u0103 se \u00eencearc\u0103 reconversia presta\u021biei PFA-ului ca fiind de consilier juridic extern, problema nu este doar de titlu, ci de condi\u021biile de exercitare. Un contract de servicii pe PFA, care \u00ee\u0219i asum\u0103 consultan\u021b\u0103 juridic\u0103 permanent\u0103 \u0219i strategie juridic\u0103 a proiectului, ocole\u0219te exact arhitectura Legii 514\/2003 (in-house, \u00een condi\u021biile legii muncii \/ func\u021biei publice).<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen concluzie, exercitarea f\u0103r\u0103 drept a unei profesii reglementate cu siguran\u021b\u0103 nu poate constitui activitate juridic\u0103 \u00een sensul art. 143 din Constitu\u021bia Rom\u00e2niei.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i><span>Pct. III: 30.03.2020 \u2013 30.06.2023 &#8211; 3 ani si 3 luni: Expert achizi\u021bii publice<\/span><\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Calitatea de \u2018expert achizi\u021bii publice\u2019 este reglementat\u0103 \u00een Clasificarea Ocupa\u021biilor din Rom\u00e2nia (COR) prin Ordinul ministrului muncii nr. 1832\/2011 (cu modific\u0103ri ulterioare) sub codul COR 214946 ca o ocupa\u021bie distinct\u0103 \u00een domeniul achizi\u021biilor publice.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Din legisla\u021bia relevant\u0103 (Legea nr. 98\/2016 privind achizi\u021biile publice \u0219i HG nr. 395\/2016 pentru aprobarea normelor metodologice de aplicare) rezult\u0103 c\u0103 exper\u021bii coopta\u021bi \u00een comisiile de evaluare a achizi\u021biilor publice sunt speciali\u0219ti desemna\u021bi pentru a asigura expertiza tehnic\u0103, financiar\u0103, juridic\u0103 sau de alt\u0103 natur\u0103 necesar\u0103 evalu\u0103rii ofertelor. Ace\u0219ti exper\u021bi nu fac parte din comisia de evaluare cu drept de vot, ci contribuie prin rapoarte \u0219i analize specializate care sprijin\u0103 decizia comisiei. Mai exact, exper\u021bii coopta\u021bi au atribu\u021bii de natur\u0103 tehnico-administrativ\u0103 \u0219i de consultan\u021b\u0103 specializat\u0103, f\u0103r\u0103 caracter decizional formal \u0219i f\u0103r\u0103 o calitate juridic\u0103 autonom\u0103 de \u2018func\u021bionar juridic\u2019.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Din punct de vedere legal, \u00een contextul vechimii \u00een func\u021bii de specialitate juridic\u0103 potrivit Legii nr. 303\/2022 privind statutul judec\u0103torilor \u0219i procurorilor (art. 63), aceast\u0103 calitate nu se \u00eencadreaz\u0103 ca \u0219i \u2018func\u021bie de specialitate juridic\u0103\u2019, \u00eentruc\u00e2t nu este o func\u021bie juridic\u0103 integrat\u0103 \u00een structura organizatoric\u0103 a institu\u021biilor de drept, fiind mai degrab\u0103 o colaborare extern\u0103, cu caracter temporar \u015fi consultativ.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Astfel, activitatea ca \u2018expert achizi\u021bii publice\u2019 este o activitate tehnico-specializat\u0103 \u00een domeniul achizi\u021biilor publice, cu caracter consultativ, f\u0103r\u0103 s\u0103 fie o activitate juridic\u0103 \u00een sensul practicilor profesionale juridice reglementate (consilier juridic, avocat, judec\u0103tor, procuror). De asemenea, aceast\u0103 activitate nu confer\u0103 vechime \u00een func\u021bii de specialitate juridic\u0103 \u00een sensul normativ al Legii nr. 303\/2022.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><b><i>\u2018Expert achizi\u021bii publice\u2019 este o calitate profesional\u0103 tehnico-specializat\u0103, f\u0103r\u0103 caracter juridic strict \u0219i f\u0103r\u0103 recunoa\u0219tere legal\u0103 pentru vechimea \u00een func\u021bii de specialitate juridic\u0103. \u00cen consecin\u021b\u0103, aceast\u0103 activitate nu constituie \u2018activitate juridic\u0103\u2019 \u0219i nu se consider\u0103 vechime \u00een func\u021bii de specialitate juridic\u0103 pentru scopuri legale, cum ar fi calculul vechimii \u00een munc\u0103 juridic\u0103 sau a altor drepturi specifice profesiei juridice.<\/i><\/b><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i><span>Pct. II: 2016-2017, 2020-2023 \u2013 4 ani: Presedintele Consiliului Na\u021bional de Etic\u0103 a Cercet\u0103rii \u0218tiin\u021bifice, Dezvolt\u0103rii Tehnologice \u0219i Inov\u0103rii<\/span><\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Pre\u0219edintele Consiliului Na\u021bional de Etic\u0103 a Cercet\u0103rii \u0218tiin\u021bifice, Dezvolt\u0103rii Tehnologice \u0219i Inov\u0103rii (CNECSDTI) exercit\u0103, \u00een principal, o func\u021bie de conducere \u0219i reprezentare \u00eentr-un organism consultativ na\u021bional f\u0103r\u0103 personalitate juridic\u0103, aflat la nivelul ministerului de resort. Regulamentul arat\u0103 expres c\u0103 acest consiliu func\u021bioneaz\u0103 \u00een baza legisla\u021biei relevante \u0219i are atribu\u021bii institu\u021bionale de etic\u0103 \u00een cercetare, nu atribu\u021bii de \u2018asisten\u021b\u0103 juridic\u0103\u2019 \u00een sensul profesiilor juridice. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>CNECSDTI analizeaz\u0103 sesiz\u0103ri \/ contesta\u021bii privind \u00eenc\u0103lcarea normelor de bun\u0103 conduit\u0103 \u00een cercetare \u0219i emite hot\u0103r\u00e2ri prin care constat\u0103 existen\u021ba \/ absen\u021ba abaterilor \u0219i, c\u00e2nd e cazul, stabile\u0219te sanc\u021biuni \u2018conform legii\u2019. Este, deci, o activitate de tip administrativ<\/i><i>\u2011regulator \/ disciplinar <\/i><i><span lang=\"RO\">\u00ee<\/span>n domeniul eticii cercet<\/i><i><span lang=\"RO\">\u0103<\/span>rii, cu efecte juridice <\/i><i><span lang=\"RO\">\u00ee<\/span>n plan administrativ (hot<\/i><i><span lang=\"RO\">\u0103<\/span>r<\/i><i><span lang=\"RO\">\u00e2<\/span>ri, proceduri, termene, cvorum, conflict de interese, comunic<\/i><i><span lang=\"RO\">\u0103<\/span>ri oficiale). <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Regulamentul stabile\u0219te explicit atribu\u021biile pre\u0219edintelui: aplic\u0103 regulamentul, planific\u0103 \u0219i conduce activitatea, stabile\u0219te ordinea de zi, aprob\u0103 minuta, reprezint\u0103 CNECSDTI \u00een rela\u021bia cu ministrul \u0219i cu ter\u021bii \u0219i emite decizii \u00een exercitarea atribu\u021biilor sale. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Aceste atribu\u021bii sunt tipice unei func\u021bii de conducere \u00eentr-un organism administrativ \/ consultativ: management institu\u021bional, reprezentare oficial\u0103 \u0219i emitere de acte interne (decizii), nu \u2018asisten\u021b\u0103 juridic\u0103\u2019.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen sens larg, pre\u0219edintele CNECSDTI desf\u0103\u0219oar\u0103 activit\u0103\u021bi cu relevan\u021b\u0103 juridic\u0103 (proceduri, acte administrative interne, coordonarea adopt\u0103rii hot\u0103r\u00e2rilor, reprezentarea institu\u021bional\u0103), pentru c\u0103 \u00eens\u0103\u0219i activitatea consiliului opereaz\u0103 cu norme legale \u0219i produce acte cu efecte juridice \u00een materia eticii cercet\u0103rii. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen sens profesional (Legea 51\/1995, Legea 514\/2003), func\u021bia nu echivaleaz\u0103, prin ea \u00eens\u0103\u0219i, cu prestarea de servicii juridice de tip consultan\u021b\u0103 \/ asisten\u021b\u0103 \/ reprezentare pentru ter\u021bi, ci cu exercitarea unei atribu\u021bii publice \/ administrative \u00eentr-un organism de etic\u0103. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i><span>Vechimea \u00een specialitate juridic\u0103 \u0219i includerea func\u021biei de pre\u0219edinte CNECSDTI<\/span><\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Lu\u00e2nd ca exemplu Legea nr. 303\/2022 privind statutul judec\u0103torilor \u0219i procurorilor, no\u021biunea de \u2018func\u021bii de specialitate juridic\u0103\u2019 este clar definit\u0103 \u00een cadrul normativ, incluz\u00e2nd, pe l\u00e2ng\u0103 judec\u0103tori \u0219i procurori, personalul de specialitate juridic\u0103 asimilat acestora, precum consilierii juridici, grefierii cu studii superioare juridice, avoca\u021bii, notarii, jurisconsul\u021bii \u0219i alte func\u021bii juridice din institu\u021bii publice.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Legea stabile\u0219te standarde stricte pentru vechimea \u00een astfel de func\u021bii, \u00een special \u00een vederea concursurilor, promov\u0103rilor \u0219i pension\u0103rii. Astfel, candidatul la o func\u021bie de magistrat-asistent trebuie s\u0103 aib\u0103 o vechime minim\u0103 \u00een func\u021biile de specialitate juridic\u0103 corespunz\u0103toare. Vechimea se calculeaz\u0103 doar pentru activitatea efectiv\u0103 \u00een aceste func\u021bii specifice. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen privin\u021ba pozi\u021biei specifice a pre\u0219edintelui Consiliului Na\u021bional de Etic\u0103 a Cercet\u0103rii \u0218tiin\u021bifice, Dezvolt\u0103rii Tehnologice \u0219i Inov\u0103rii (CNECSDTI), aceast\u0103 func\u021bie nu este \u00een mod explicit inclus\u0103 \u00een lista func\u021biilor de specialitate juridic\u0103 reglementate prin legea men\u021bionat\u0103. Pre\u0219edintele CNECSDTI are atribu\u021bii preponderent administrative, de reglementare \u0219i supraveghere \u00een domeniul eticii cercet\u0103rii, f\u0103r\u0103 a exercita \u00een mod direct atribu\u021bii juridice sau judiciare specifice profesiei de magistrat sau de personal de specialitate juridic\u0103 asimilat acestora.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Prin urmare, activitatea \u00een cadrul CNECSDTI, inclusiv func\u021bia de pre\u0219edinte, nu este recunoscut\u0103 ca \u2018vechime \u00een specialitate juridic\u0103\u2019, astfel cum este aceasta \u00een\u021beleas\u0103 \u0219i reglementat\u0103 \u00een legisla\u021bia privind statutul \u0219i cariera magistra\u021bilor \u0219i personalului juridic asimilat acestora. Vechimea \u00een specialitate juridic\u0103 se refer\u0103 la exercitarea efectiv\u0103 a func\u021biilor licen\u021biate, specifice unor profesii juridice concrete (judec\u0103tor, procuror, consilier juridic, avocat, etc.) \u00een institu\u021biile men\u021bionate explicit \u00een lege.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen mod esen\u021bial, art. 87 alin. (3) din Legea nr. 361\/2023 nu construie\u0219te o \u2018categorie profesional\u0103 universal\u0103\u2019 (valabil\u0103 oriunde \u00een administra\u021bie sau \u00een organisme consultative), ci se refer\u0103 la o categorie de personal din arhitectura institu\u021bional\u0103 a Cur\u021bii Constitu\u021bionale, cu un anumit statut \u0219i un anumit tip de atribu\u021bii (cercetare \/ documentare juridic\u0103 \u00een sprijinul activit\u0103\u021bii Cur\u021bii). Din aceast\u0103 perspectiv\u0103, expresia \u2018personalul de specialitate juridic\u0103 ce desf\u0103\u0219oar\u0103 activitate de cercetare sau documentare\u2019 este, juridic vorbind, o calificare func\u021bional\u0103 \u0219i institu\u021bional\u0103 intern\u0103 CCR, nu o etichet\u0103 care se poate \u2018transfera\u2019 automat asupra oric\u0103rui rol unde se cite\u0219te legisla\u021bie sau se redacteaz\u0103 analize.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Chiar dac\u0103, \u00een practic\u0103, pre\u0219edintele CNECSDTI (\u0219i membrii) pot realiza analize cu puternic con\u021binut normativ (inclusiv pe probleme de etic\u0103, integritate, eventual cu implica\u021bii juridice), regimul juridic al CNECSDTI este clar: este un organism consultativ f\u0103r\u0103 personalitate juridic\u0103, iar participarea membrilor este reglementat\u0103 ca activitate desf\u0103\u0219urat\u0103 \u2018\u00een afara activit\u0103\u021bii de baz\u0103\u2019, remunerat\u0103 pe ore efectiv lucrate, cu numire prin ordin de ministru. \u00cen plus, chiar Legea nr. 206\/2004 (\u00een varianta care instituie CNE ca organism) folose\u0219te aceea\u0219i logic\u0103: organism consultativ, indemniza\u021bie pentru membri, func\u021bionare prin bugetul autorit\u0103\u021bii competente.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Din aceste texte rezult\u0103 c\u0103 func\u021bia de pre\u0219edinte CNECSDTI este, juridic, o calitate \u00eentr-un organism consultativ (cu indemniza\u021bie), nu o \u2018func\u021bie de personal de specialitate juridic\u0103\u2019 (\u00een sensul Legii nr. 361\/2023) \u0219i nici o func\u021bie \u00eencadrat\u0103 ca atare \u00eentr-un compartiment de cercetare\/documentare juridic\u0103 de tipul celui avut \u00een vedere pentru CCR. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen materia salariz\u0103rii personalului pl\u0103tit din fonduri publice, \u2018vechimea \u00een specialitate\u2019 (inclusiv \u2018vechimea \u00een specialitate juridic\u0103\u2019, acolo unde este criteriu de \u00eencadrare\/promovare sau de stabilire a drepturilor salariale) este, \u00een practic\u0103, legat\u0103 de perioade efective \u00een care persoana a desf\u0103\u0219urat activitate \u00eentr-o func\u021bie\/post\/raport juridic de munc\u0103 ori de serviciu care are ca cerin\u021b\u0103 relevant\u0103 studiile juridice \u0219i atribu\u021bii specifice domeniului juridic (de tip consilier juridic, func\u021bionar pe post juridic, magistrat, avocat etc.), dovedite prin acte specifice raporturilor de munc\u0103\/serviciu (\u00eencadrare, registru de eviden\u021b\u0103, adeverin\u021be de vechime).<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Prin contrast, o activitate exercitat\u0103 ca membru \u00eentr-un organism consultativ, pe baz\u0103 de mandat\/numire \u0219i remunerat\u0103 punctual prin indemniza\u021bie de \u0219edin\u021b\u0103, \u00een mod obi\u0219nuit nu genereaz\u0103 \u2018vechime\u2019 \u00een sensul utilizat de legisla\u021bia de salarizare (nu \u2018curge\u2019 ca vechime de \u00eencadrare \u00een specialitate, ci cel mult ca experien\u021b\u0103 profesional\u0103 \u00een sens larg).<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Din aceste elemente rezult\u0103, ca regul\u0103, c\u0103 activitatea de membru CNATDCU (inclusiv \u00een Comisia de \u0219tiin\u021be juridice) este o activitate de tip mandat\/numire \u00eentr-un organism consultativ, remunerat\u0103 prin indemniza\u021bie de \u0219edin\u021b\u0103, nu o \u2018\u00eencadrare\u2019 \u00eentr-o func\u021bie juridic\u0103 printr-un raport de munc\u0103\/serviciu. \u00cen consecin\u021b\u0103, \u00een mod obi\u0219nuit, ea nu se contabilizeaz\u0103 ca vechime \u00een specialitate juridic\u0103 pentru \u00eencadrare\/salarizare, tocmai pentru c\u0103 nu este o perioad\u0103 continu\u0103 de exercitare a unei func\u021bii juridice \u00een cadrul unui raport de munc\u0103\/serviciu (ci o activitate punctual\u0103, ocazionat\u0103 de \u0219edin\u021be, \u2018\u00een afara activit\u0103\u021bii de baz\u0103\u2019).<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00cen concluzie, pentru condi\u021bion\u0103ri legate de vechimea \u00een func\u021bii de specialitate juridic\u0103 \u00een contextul justi\u021biei, carierei juridice \u0219i, bine\u00een\u021beles, al calit\u0103\u021bii de judec\u0103tor al CCR, perioada \u0219i func\u021bia de pre\u0219edinte CNECSDTI nu vor fi recunoscute ca vechime \u00een specialitate juridic\u0103.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i><span>Pct. XI: 2011-2012, 2020-2025 \u2013 7 ani: Membru Comisia de \u0219tiin\u021be juridice CNATDCU<\/span><\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>CNATDCU este calificat expres ca \u2018organism consultativ, f\u0103r\u0103 personalitate juridic\u0103, al Ministerului Educa\u021biei\u2019. Membrii CNATDCU sunt \u2018personalit\u0103\u021bi de prestigiu academic \u0219i \u0219tiin\u021bific\u2019 (\u00een principal cadre didactice\/cercet\u0103tori etc.) numite prin ordin al ministrului, iar misiunea lor este \u2018de a sprijini\u2019 ministerul \u00een interesul sistemului de \u00eenv\u0103\u021b\u0103m\u00e2nt superior. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Comisiile de specialitate (inclusiv Comisia de \u0219tiin\u021be juridice) sunt formate din \u2018exper\u021bi\u2019 \u00een domeniile arondate \u0219i au atribu\u021bii de evaluare \u0219i propunere c\u0103tre Consiliul general (de exemplu, pentru acordarea\/neacordarea atestatului de abilitare ori a diplomei de doctor), precum \u0219i atribu\u021bii de elaborare a standardelor minimale. <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Dac\u0103 folosim sensul uzual-profesional \u0219i constitu\u021bional al \u2018activit\u0103\u021bii juridice\u2019 (adic\u0103 activit\u0103\u021bi specifice profesiilor juridice: consultan\u021b\u0103 juridic\u0103, asisten\u021b\u0103 \u0219i reprezentare, redactare de acte juridice pentru ter\u021bi, litigii, avizare juridic\u0103 \u00een cadrul unei func\u021bii juridice), atunci calitatea de membru al Comisiei de \u0219tiin\u021be juridice CNATDCU nu este, prin ea \u00eens\u0103\u0219i, o activitate juridic\u0103 \u00een acest sens.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Din regulament rezult\u0103 c\u0103 rolul comisiilor de specialitate este predominant de expertiz\u0103 academic\u0103 \u0219i administrativ-procedural\u0103: analizarea procedurilor administrative universitare pentru titluri\/abilitare\/doctorat, verificarea respect\u0103rii standardelor minimale, formularea de propuneri \u0219i participarea la decizie prin vot \u00een structurile CNATDCU. Aceasta este o activitate de reglementare \u0219i evaluare \u00een domeniul educa\u021biei \u0219i integrit\u0103\u021bii academice, nu una de furnizare de servicii juridice c\u0103tre public sau de exercitare a unei profesii juridice reglementate.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Faptul c\u0103 domeniul comisiei este \u2018\u0219tiin\u021be juridice\u2019 (drept) \u0219i c\u0103 se lucreaz\u0103 cu norme (standarde, proceduri, conflict de interese, contesta\u021bii) nu transform\u0103 automat rolul \u00eentr-o \u2018activitate juridic\u0103\u2019 profesional\u0103; este o activitate de evaluare \u0219i decizie institu\u021bional\u0103, cu component\u0103 normativ\u0103\/administrativ\u0103. Este relevant \u0219i c\u0103 regulamentul men\u021bioneaz\u0103 existen\u021ba unui consilier juridic \u00een secretariatul tehnic al CNATDCU, ceea ce sugereaz\u0103 c\u0103 suportul juridic specializat este tratat distinct de rolul membrilor comisiilor (care sunt exper\u021bi academici).<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Tot \u00een logica Legii nr. 303\/2022 (statutul judec\u0103torilor \u0219i procurorilor), \u2018vechimea \u00een func\u021biile de specialitate juridic\u0103\u2019 este legat\u0103 de exercitarea efectiv\u0103 a unor func\u021bii juridice determinate, enumerate limitativ la art. 63 alin. (1) (de tip judec\u0103tor\/procuror, personal de specialitate juridic\u0103 asimilat, avocat, consilier juridic etc., precum \u0219i func\u021bii juridice \u00een anumite autorit\u0103\u021bi\/institu\u021bii publice). <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Calitatea de \u2018membru\u2019 \u00eentr-o comisie de specialitate CNATDCU este o calitate \u00eentr-un organism consultativ, numit prin ordin, remunerat\u0103 prin indemniza\u021bie potrivit regulamentului, dar nu este, \u00een sine, o \u2018func\u021bie\u2019 juridic\u0103 dintre cele enumerate de art. 63 alin. (1) \u0219i nici nu echivaleaz\u0103 cu o \u00eencadrare\/ocupare a unui post juridic (de tip consilier juridic, personal asimilat etc.). <\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Prin urmare, perioada \u00een care o persoan\u0103 este membru al Comisiei de \u0219tiin\u021be juridice CNATDCU nu poate s\u0103 fie recunoscut\u0103 ca \u2018vechime \u00een func\u021bii de specialitate juridic\u0103\u2019 deoarece nu reprezint\u0103 exercitarea unei func\u021bii juridice, ci participarea \u00eentr-un organism consultativ de evaluare academic\u0103.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Calitatea de membru \u00eentr-o comisie de specialitate CNATDCU (inclusiv Comisia de \u0219tiin\u021be juridice) este, la fel, o calitate \u00eentr-un organism na\u021bional organizat sub autoritatea Ministerului Educa\u021biei, cu roluri de evaluare\/atestare \u00een zona academic\u0103, nu o \u00eencadrare \u00eentr-o func\u021bie de specialitate juridic\u0103 de tip \u2018personal CCR\u2019, fiind relevante acelea\u0219i considera\u021bii ca \u00een cazul de mai sus.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Calitatea de \u2018Membru \u2013 Comisia de \u0219tiin\u021be juridice CNATDCU\u2019 descrie o activitate institu\u021bional\u0103 de expertiz\u0103 academic\u0103 \u0219i administrativ-procedural\u0103 (evalu\u0103ri, propuneri, vot), nu o activitate juridic\u0103 profesional\u0103 de tip consultan\u021b\u0103\/asisten\u021b\u0103\/reprezentare. \u00cen acela\u0219i timp, aceast\u0103 calitate nu intr\u0103, ca atare, \u00een categoria \u2018func\u021biilor de specialitate juridic\u0103\u2019 pentru care se calculeaz\u0103 vechime conform legii.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i><span>CONCLUZII FINALE<\/span><\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Din analiza exhaustiv\u0103 a parcursului profesional al domnului Dacian Cosmin Drago\u0219, rezult\u0103 \u00een mod indubitabil c\u0103 acesta nu \u00eendepline\u0219te condi\u021bia esen\u021bial\u0103 \u0219i cumulativ\u0103 prev\u0103zut\u0103 de art. 143 din Constitu\u021bia Rom\u00e2niei, respectiv vechimea de cel pu\u021bin 18 ani \u00een activitatea juridic\u0103 sau \u00een \u00eenv\u0103\u021b\u0103m\u00e2ntul juridic superior.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>1. Situa\u021bia real\u0103 a vechimii \u00een \u00eenv\u0103\u021b\u0103m\u00e2ntul juridic superior<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>Conform interpret\u0103rii constitu\u021bionale consacrate de doctrina juridic\u0103 de referin\u021b\u0103 (profesorii Ioan Muraru, Elena Simina T\u0103n\u0103sescu, Antonie Iorgovan, Dana Apostol Tofan) \u0219i sus\u021binut\u0103 de structura sistemului rom\u00e2nesc de \u00eenv\u0103\u021b\u0103m\u00e2nt superior, no\u021biunea de \u2018\u00eenv\u0103\u021b\u0103m\u00e2nt juridic superior\u2019 din art. 143 din Constitu\u021bie se refer\u0103 exclusiv la activitatea didactic\u0103 desf\u0103\u0219urat\u0103 \u00een cadrul Facult\u0103\u021bilor de Drept (domeniul \u2018\u0218tiin\u021be juridice\u2019), nu la orice form\u0103 de predare universitar\u0103 care include discipline juridice.<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>Domnul Drago\u0219 a acumulat:<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>\u2022 Doar 3 ani \u0219i 4 luni (octombrie 1998 &#8211; februarie 2002) la Facultatea de Drept a Universit\u0103\u021bii Dimitrie Cantemir Cluj-Napoca<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>\u2022 Peste 23 de ani la Facultatea de \u0218tiin\u021be Politice \u0219i Administrative a Universit\u0103\u021bii Babe\u0219-Bolyai &#8211; activitate care, de\u0219i valoroas\u0103 academic, nu constituie \u00eenv\u0103\u021b\u0103m\u00e2nt juridic superior \u00een sensul art. 143 din Constitu\u021bie<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>Aceast\u0103 distinc\u021bie se fundamenteaz\u0103 pe:<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u2022 Nomenclatorul oficial al domeniilor de studii universitare (HG 367\/2023, actualizat prin HG 412\/2024), care separ\u0103 structural \u2018\u0218tiin\u021bele juridice\u2019 (domeniul Drept, cod ISCED 0421, 240 ECTS) de \u2018\u0218tiin\u021bele administrative\u2019 (domeniul Administra\u021bie Public\u0103, cod ISCED 0413, 180 ECTS)<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u2022 Sistemul de acreditare ARACIS, care opereaz\u0103 cu comisii distincte pentru cele dou\u0103 domenii<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u2022 Finalitatea diferit\u0103 a form\u0103rii: Facult\u0103\u021bile de Drept formeaz\u0103 juri\u0219ti pentru profesiile juridice reglementate; Facult\u0103\u021bile de Administra\u021bie Public\u0103 formeaz\u0103 func\u021bionari publici \u0219i speciali\u0219ti \u00een management public.\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>2. Absen\u021ba total\u0103 a vechimii \u00een activitatea juridic\u0103<\/i><\/span><\/span><\/b><span><span><i>\u00a0<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>Examinarea fiec\u0103rei perioade invocate de domnul Drago\u0219 ca fiind \u2018activitate juridic\u0103\u2019 relev\u0103 c\u0103 niciuna nu \u00eendepline\u0219te criteriile legale pentru a fi recunoscut\u0103 ca atare:<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>a) Func\u021bii de consultan\u021b\u0103 administrativ\u0103 (consilier ministerial, expert \u00een comisii):<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>\u2022 Reprezint\u0103 activit\u0103\u021bi de elaborare legislativ\u0103 \u0219i consultan\u021b\u0103 \u00een administra\u021bia public\u0103<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>\u2022 nu constituie profesii juridice reglementate (avocat, judec\u0103tor, procuror, notar, consilier juridic)<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u2022 Jurispruden\u021ba constant\u0103 a \u00ceCCJ stabile\u0219te c\u0103 func\u021biile nu se echivaleaz\u0103 pe criteriul \u2018atribu\u021biilor\u2019, ci doar prin \u00eencadrare formal\u0103 \u00een profesii juridice recunoscute<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><b><span><span><i>b) Activit\u0103\u021bi de expert \u00een proiecte interna\u021bionale \u0219i arbitraje ICSID:<\/i><\/span><\/span><\/b><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u2022 Dac\u0103 au fost prestate f\u0103r\u0103 calitatea de avocat cu drept de exercitare SAU f\u0103r\u0103 \u00eencadrare formal\u0103 ca consilier juridic, ele reprezint\u0103 consultan\u021b\u0103 pe baz\u0103 de contract civil<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span><i>\u2022 nu echivaleaz\u0103 cu exercitarea unei profesii juridice, conform jurispruden\u021bei \u00ceCCJ care respinge recunoa\u0219terea vechimii juridice pentru activit\u0103\u021bi prestate \u00een afara profesiilor reglementate<\/i><\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><b><span><i>c) Colaborarea cu Systra SA (decembrie 2024 \u2013 iulie 2025):<\/i><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\"><span><b><span><i>\u2022 Contractul de prest\u0103ri servicii prin PFA prevedea explicit: \u2018legal advice\u2019, \u2018legal risks\u2019, \u2018participating to court proceedings and representing the Company\u2019<\/i><\/span><\/b><\/span><\/p>\n<p class=\"MsoNormal\"><span><b><span><i>\u2022 Aceste presta\u021bii se suprapun cu sfera avocaturii, \u00eens\u0103 au fost executate f\u0103r\u0103 calitatea de avocat \u0219i \u00een afara formelor legale de exercitare a profesiei (Legea 51\/1995);
