{"id":1233496,"date":"2023-01-09T11:02:42","date_gmt":"2023-01-09T08:02:42","guid":{"rendered":"https:\/\/analyse.optim.biz\/?p=1233496"},"modified":"2023-01-09T11:02:42","modified_gmt":"2023-01-09T08:02:42","slug":"noi-reguli-pentru-angajatori-a-intrat-in-vigoare-noua-lege-a-dialogului-social-ziarul-de-vaslui","status":"publish","type":"post","link":"https:\/\/analyse.optim.biz\/?p=1233496","title":{"rendered":"Noi reguli pentru angajatori: a intrat \u00een vigoare noua Lege a Dialogului Social &#8211; Ziarul de Vaslui"},"content":{"rendered":"<div class=\"entry-content clearfix\">\n<p>\u00cen data de 25 decembrie 2022 a intrat \u00een vigoare noua Lege a Dialogului Social, respectiv <strong>Legea nr. 367\/2022<\/strong> (a fost publicat\u0103 \u00een Monitorul Oficial nr. 1238\/2022), Legea nr. 62\/2011 fiind abrogat\u0103 odat\u0103 cu apari\u0163ia noului cadru legislativ. Noua lege aduce importante modific\u0103ri \u015fi vom enumera c\u00e2teva dintre acestea:<\/p>\n<p>Conform art.97 alin 1, la nivelul angajatorilor care au <strong>mai mult de 10 salaria\u0163i<\/strong>, este obligatorie \u00eencheierea unui contract colectiv de munc\u0103 \u00eentre angajator \u015fi reprezentan\u0163ii salaria\u0163ilor sau \u00a0sindicatul\u00a0 reprezentativ, dup\u0103 caz, prin care se stabilesc clauze privind condi\u0163iile de munc\u0103, salarizarea, precum \u015fi alte drepturi \u015fi obliga\u0163ii ce decurg din raporturile de munc\u0103. <strong>Initia\u0163iva negocierii colective apar\u0163ine oric\u0103ruia dintre partenerii sociali.<\/strong><\/p>\n<p>Conform alin 4 al aceluia\u0219i articol din acela\u0219i act normativ : \u201d Durata negocierii colective nu poate dep\u0103\u015fi <strong>45 de zile<\/strong> dec\u00e2t prin acordul p\u0103r\u0163ilor.\u201d<\/p>\n<p>Conform art.57 alin 2 <em>\u201creprezentan\u021bii angaja\u0163ilor\/lucr\u0103torilor sunt ale\u0219i cu votul a cel pu\u021bin jum\u0103tate <u>plus unu<\/u> din num\u0103rul total al angaja\u021bilor\/lucr\u0103torilor din unitatea respectiv\u0103\u201d<\/em>.<\/p>\n<p>Conform art.58 se reglementeaz\u0103 situa\u021bia \u00een care, dac\u0103 nu se realizeaz\u0103 un acord \u00eentre angajator \u0219i salaria\u021bi, num\u0103rul de reprezentan\u021bi ale\u0219i ai salaria\u021bilor nu poate fi mai mare de 2 reprezentan\u021bi la angajatorii care au sub 100 de angaja\u021bi, ori 3 reprezentan\u021bi la angajatorii care au \u00eentre 101 \u0219i 500 de angaja\u021bi.<\/p>\n<p>O schimbare important\u0103 este generat\u0103 de reglementarea mai mult sau mai pu\u021bin expres\u0103 a conflictului de interese \u00een materie, fiind reglementat expres c\u0103 <em>\u201cPersoanele care ocup\u0103 func\u0163ii de conducere care asigur\u0103 reprezentarea administra\u0163iei \u00een raporturile cu angaja\u0163ii\/lucr\u0103torii sau care particip\u0103 la decizia conducerii \u00eentreprinderii la nivelul unit\u0103\u0163ii, nu pot fi ale\u015fi ca reprezentan\u0163i ai angaja\u0163ilor\/lucr\u0103torilor\u201d<\/em>.<\/p>\n<p>\u00cen ceea ce prive\u0219te <strong><em><u>sindicatele,<\/u><\/em><\/strong> se remarc\u0103 faptul c\u0103 noua Lege a Dialogului Social, art.54 lit. C- reduce procentajul necesar pentru ca un sindicat s\u0103 devin\u0103 reprezentativ, stabilind c\u0103 un sindicat poate fi reprezentativ dac\u0103 cuprinde cel <strong>pu\u021bin 35%<\/strong> dintre angaja\u021bii\/lucr\u0103torii afla\u021bi \u00eentr-un raport juridic de munc\u0103\/serviciu cu societatea respectiv\u0103 (fa\u021b\u0103 de cel pu\u021bin 50%+1, cum era p\u00e2n\u0103 acum), gener\u00e2nd astfel o posibilitate cel pu\u021bin teoretic\u0103 interesant\u0103, respectiv aceea de a avea \u00een aceea\u0219i unitate dou\u0103 sindicate care reprezint\u0103 cel pu\u021bin 35% dintre salaria\u021bi.<\/p>\n<p>Mai mult, condi\u021biile de \u00eenfiin\u021bare a unui sindicat au fost \u201crelaxate\u201d, astfel c\u0103 un sindicat poate fi \u00eenfiin\u021bat de cel pu\u021bin <strong>10 salaria\u021bi<\/strong> din aceea\u0219i unitate sau cel pu\u021bin 20 salaria\u021bi din unit\u0103\u021bi diferite, dar din cadrul aceluia\u0219i sector de activitate, iar posibilitatea de apartenen\u021b\u0103 la un sindicat a fost extins\u0103 inclusiv, de exemplu, c\u0103tre \u0219omeri sau lucr\u0103tori independen\u021bi.<\/p>\n<p>\u201dNu \u00een ultimul r\u00e2nd, atragem aten\u021bia asupra faptului c\u0103 exist\u0103 reglementari cu privire la regimul sanc\u021bionator prev\u0103zut de noua Lege nr. 367\/2022 (ce a fost \u00een\u0103sprit, at\u00e2t din perspectiv\u0103 contraven\u021bional\u0103, c\u00e2t \u0219i penal\u0103);<\/p>\n<p>Acestea, \u00eempreun\u0103 cu toate celelalte modific\u0103ri implementate prin noua Lege a Dialogului Social, impun o analiz\u0103 atent\u0103 a noului cadru legislativ, ce poate da na\u0219tere unei noi dinamici a dialogului social pe pia\u021ba muncii din Rom\u00e2nia.\u201d, a precizat Gheorghe Chirvase, \u00a0Inspectorul Sef al\u00a0 Inspectoratul Teritorial de Munca Vaslui.<\/p>\n<aside class=\"mashsb-container mashsb-main \">\n<div class=\"mashsb-box\">\n<div class=\"mashsb-count mash-medium\">\n<div class=\"counts mashsbcount\">0<\/div>\n<p><span class=\"mashsb-sharetext\">SHARES<\/span><\/div>\n<div class=\"mashsb-buttons\"><a class=\"mashicon-facebook mash-medium mashsb-noshadow\" href=\"https:\/\/www.facebook.com\/sharer.php?u=https%3A%2F%2Fwww.ziaruldevaslui.ro%2Fnoi-reguli-pentru-angajatori-a-intrat-in-vigoare-noua-lege-a-dialogului-social%2F\" target=\"_top\" rel=\"nofollow\"><span class=\"text\">Share\u00a0pe\u00a0facebook<\/span><\/a><a class=\"mashicon-twitter mash-medium mashsb-noshadow\" href=\"https:\/\/twitter.com\/intent\/tweet?text=Noi%20reguli%20pentru%20angajatori%3A%20a%20intrat%20%C3%AEn%20vigoare%20noua%20Lege%20a%20Dialogului%20Social&amp;url=https:\/\/www.ziaruldevaslui.ro\/?p=42133\" target=\"_top\" rel=\"nofollow\"><span class=\"text\">Share\u00a0pe\u00a0twitter<\/span><\/a><\/div>\n<\/div>\n<\/aside>\n<\/div>\n<div class=\"entry-content\">\n<p>Ini\u021bial am crezut c\u0103 Ionel Sandu s-a apucat de Stand Up Comedy.
