Practic, rom\u00e2nii aveau la dispozi\u021bie o platform\u0103 de dialog \u0219i negociere cu banca, \u00een afara instan\u021belor, gratuit\u0103 \u0219i cu un timp de rezolvare rapid. Acest dialog era intermediat de un conciliator, adic\u0103 de un profesionist \u00een drept \u0219i \u00een domeniul financiar-bancar, care c\u0103uta o solu\u021bie pentru diminuarea ratelor \u0219i continuarea contractului existent \u00eentre p\u0103r\u021bi, \u00eentr-o form\u0103 nou\u0103, ajustat\u0103 pe nevoile consumatorului.<\/p>\n<p>\u00cen intervalul temporal de 10 ani de la \u00eenfiin\u021bare CSALB, b\u0103ncile \u0219i consumatorii lor au trecut \u00eempreun\u0103 \u0219i prin criza pandemic\u0103, iar perioada dificil\u0103 precizat\u0103 a consolidat\u00a0 \u00eencrederea dintre aceste p\u0103r\u021bi.<\/p>\n<p>Astfel, \u00een to\u021bi ace\u0219ti 10 ani, \u00een cadrul CSALB s-au desf\u0103\u0219urat peste 4.800 de negocieri \u00eencheiate cu \u00eemp\u0103carea p\u0103r\u021bilor, iar 800 de procese \u00eencepute \u00een instan\u021b\u0103 s-au \u00eencheiat amiabil prin conciliere. Beneficiile ob\u021binute \u00een urma acestor negocieri dep\u0103\u0219esc 15,5 milioane de euro. De unde a pornit construc\u021bia acestei entit\u0103\u021bi \u0219i care era contextul social \u0219i economic c\u00e2nd a fost \u00eenfiin\u021bat\u0103 prin Ordonan\u021ba Guvernului 38, \u00een anul 2015?<\/p>\n<p><strong>VIDEO:<\/strong><a href=\"https:\/\/www.youtube.com\/shorts\/o9oh8omz4lY\"><strong>https:\/\/www.youtube.com\/shorts\/o9oh8omz4lY<\/strong><\/a><\/p>\n<p><strong>Alexandru P\u0103unescu<\/strong>: Contextul financiar \u00een urm\u0103 cu 10 ani era unul complicat. Se manifestau efectele crizei financiare din 2008-2009. Erau destul de multe, aproximativ 40-50 de mii de litigii pe rolul instan\u021bilor de judecat\u0103, \u00eentre b\u0103nci \u0219i consumatori. Apoi era o afluen\u021b\u0103 de proiecte de acte normative \u00een Parlament care priveau sistemul bancar, printre care \u0219i darea \u00een plat\u0103 a bunurilor pentru stingerea datoriilor. Tot \u00een 2015 a fost \u0219i criza legat\u0103 de cursul Francului Elve\u021bian. \u00cen acest context m\u0103 \u00eentreba cineva dac\u0103 CSALB a fost providen\u021bial, pentru c\u0103 a ap\u0103rut exact \u00een 2015. De fapt, era vorba doar despre transpunerea unei directive europene \u00een legisla\u021bia rom\u00e2neasc\u0103. De\u0219i Directiva nu vorbe\u0219te despre gratuitatea serviciilor de negociere pentru consumatori, ci doar despre pre\u021buri modice, la acel moment b\u0103ncile au fost dispuse s\u0103-\u0219i asume \u00eentregul cost al acestei solu\u021bion\u0103ri alternative a disputelor din domeniul financiar\u2013bancar. Cu toate acestea, \u00eenceputul CSALB a fost marcat de ne\u00eencredere. At\u00e2t din partea institu\u021biilor financiare, c\u00e2t \u0219i din partea consumatorilor care voiau s\u0103 pedepseasc\u0103 b\u0103ncile pentru ceea ce li se \u00eent\u00e2mplase, ca urmare a crizei financiare. Au fost vreo 2-3 ani p\u00e2n\u0103 c\u00e2nd cele dou\u0103 p\u0103r\u021bi au avut \u00eencredere \u00een aceast\u0103 entitate.<\/p>\n<p>Dac\u0103 facem un arc peste timp, vedem c\u0103 ast\u0103zi lucrurile arat\u0103 mult mai bine: num\u0103rul litigiilor a sc\u0103zut de aproximativ patru ori, p\u00e2n\u0103 la 12.000 de procese \u00eentre consumatori \u0219i b\u0103ncile comerciale.<\/p>\n<p>\u00cen plus, disponibilitatea de negociere din partea institu\u021biilor de credit a cunoscut o evolu\u021bie semnificativ\u0103. Acum exist\u0103 mecanisme de solu\u021bionare alternativ\u0103 la nivel intern al b\u0103ncilor \u0219i mai multe persoane din interiorul institu\u021biei de credit colaboreaz\u0103 cu echipa CSALB.<\/p>\n<p><strong>Florin D\u0103nescu: <\/strong>CSALB este transpunerea unei directive europene, dar dac\u0103 nu ar fi fost aceast\u0103 directiv\u0103, cred c\u0103 ideea asta trebuia s\u0103-i vin\u0103 cuiva, pentru c\u0103 era nevoie de o astfel de solu\u021bie. Ideea ne-a mobilizat s\u0103 sus\u021binem un proiect care nu st\u0103tea deloc \u00een cultura institu\u021bional\u0103 rom\u00e2neasc\u0103, nu exista un precedent. Iat\u0103 c\u0103 aceast\u0103 construc\u021bie european\u0103 s-a \u00eent\u00e2mplat f\u0103r\u0103 nicio presiune din afar\u0103, \u00een condi\u021bii de conflict \u00eentre consumatori \u0219i b\u0103nci. De aceea este o construc\u021bie de invidiat \u00een succesul ei, ast\u0103zi. C\u00e2nd vorbim de nevoia clien\u021bilor, b\u0103ncile \u0219tiu c\u0103 sunt nu numai consumatori care, pe bun\u0103 dreptate, au o nevoie pe care nu o pot \u00eendeplini sau nu pot s\u0103-\u0219i pl\u0103teasc\u0103 un credit. Noi \u0219tim c\u0103 sunt \u0219i oameni care se folosesc de acest acces \u0219i care n-ar fi trebuit s\u0103 fie acolo. Iar asta, \u00een condi\u021biile \u00een care b\u0103ncile au devenit un fel de \u201c\u021bapi isp\u0103\u0219itori\u201d ai crizei financiare \u0219i politice. Politicienii care f\u0103ceau promisiuni electorale pe care nu \u0219i le puteau \u021bine, c\u0103utau vinova\u021bi. A\u0219a au ajuns s\u0103 arate spre b\u0103nci chiar \u0219i atunci c\u00e2nd oamenii nu-\u0219i mai puteau pl\u0103ti creditele din cauza t\u0103ierii salariilor sau cre\u0219terii taxelor. B\u0103ncile \u0219tiau c\u0103 au acordat un credit, clientul l-a luat \u0219i l-a consumat. Deci, era o situa\u021bie foarte dificil\u0103. C\u0103 tot am amintit de comunism, ceea ce se \u00eent\u00e2mpla atunci venea \u0219i din cultura asta colectivist\u0103, \u00een care oamenilor le era foarte greu s\u0103-\u0219i asume responsabilit\u0103\u021bi individuale.
